Iran amputates the limbs of 4 ‘robbers’ in Isfahan

The Sharia punishment for four robbers with a history of robberies was carried out in the Central Isfahan Prison this morning. One of these people had carried out a robbery in Isfahan and the other three had carried out robberies in the towns of Badroud, Tiran, Kroun and Najaf Abad...
In the ceremony the Sharia punishment for robbery and the also the punishment of flogging was carried out for the Najaf Abad robber on charges of 29 counts of robbery and a case of robbery along with harassment, and for the Isfahan robber on charges of 100 counts of robberies from residential areas. (Note: Although not clearly specified in this report, according to article 201 of Iran’s Islamic Penal Code, the Sharia punishment for robbery is:
a- For the first instance of robbery, the four fingers of the right hand of the robber will be amputated in a way that the thumb and the palm of the hand are left attached.
b- In the second instance, the left foot of the robber is amputated from a specific part of the foot.
c- Life in prison for the third instance
d- In the fourth instance, the robber is to be executed except if the robbery is carried out in prison.)

Dangerous drivers will be punished with 74 lashes in Ahwaz

The Ahwaz Public and Revolutionary Prosecutor said that the plan to deal with dangerous drivers would be carried out in this town...
“In line with this, a commission made up of the head of the Traffic Police, the Security Police and the Assistant Head of the Criminal Prosecutor made the necessary decisions to deal with these people. In this commission it was ratified that dangerous drivers will be identified and arrested and their automobiles will be impounded”, Farhad Afsharnia said.
Afsharnia said that in the first stage of the plan, 100 automobiles were impounded.
“For those who carry out these crimes, according to article 618 of the Islamic Penal Code, they will be sentenced to up to one year of prison and 74 lashes and the Ahwaz Court has requested the maximum punishment for these people”, he added. (ISNA state-run News Agency – Oct. 9, 2011)

Iran sentences actress to 90 lashes

Marzieh Vafamehr, the wife of Naser Taqvani and an actress in the movie, ‘My Tehran for Sale’ who was arrested in July was sentenced to one year of prison and 90 lashes. (Kalameh website – Oct. 9, 2011)

Student political activist flogged 74 times for insulting Ahmadinejad

Student activist Peiman Aref, who was detained in cellblock 350 in Evin Prison said after his 74 lashes sentence was carried out that he was flogged for insulting Ahmadinejad.
“I was flogged in an Iran which Ahmadinejad says is the freest country in the world on charges of insulting Ahmadinejad to the point that my back is still injured and I have a heartache”, he said. [Aref has a history of heart problems.]
Peiman Aref was transferred to the Sentence Implementation Unit of Evin Prison this morning to be released after serving his time but according to him, his 74 lashes sentence for insulting the president was carried out moments before his release. (Jaras website – Oct. 9, 2011)

Australia condemns Iranian actress lashing sentence
Canberra urged Iran to respect the human rights of its citizens Tuesday after an actress in the country was sentenced to 90 lashes for appearing in an Australian film with her head uncovered and shaven.
Australia's Foreign Minister Kevin Rudd expressed 'deep concern' at reports that Marzieh Vafamehr had been sentenced to a year in prison and the lashes for her role in the film 'My Tehran for Sale.’
‘The Australian government condemns the use of cruel, inhuman or degrading treatment or punishment and is deeply concerned by reports that Ms Marzieh Vafamehr has been sentenced to one year in jail and 90 lashes for her role in an Australian-produced film,' a spokesman for Rudd told AFP.
‘The Australian government urges Iran to protect the rights of all Iranians and foreign citizens’.
A report of Vafamehr's sentence appeared on the Iranian opposition website Kalameh.com on Sunday, also saying that her lawyer was lodging an appeal. Iran's Fars news agency said the film had not been approved for distrubution in the country and was being distributed there illegally.
Shot entirely in Tehran and directed by Iranian-Australian Granaz Moussavi, the 2008 film tells the story of a young actress in Iran's capital whose work is banned by the authorities.
Adelaide-based production company Cyan Films said the low-budget, independent movie was never intended for release in Iran and its dissemination on Tehran's black market was 'totally outside the control' of the company.
Cyan producers Kate Croser and Julie Ryan said they were stunned and appalled by Vafamehr's sentence, which her lawyers are appealing, and denied the court's allegations that filming was carried out without a proper permit.
‘We would like to express our deep shock and sadness at the sentence,' Croser and Ryan said in a statement.
‘We continue to offer our support to Marzieh and her family by respecting their wishes to let the case and the appeal follow the proper legal channels’.
They stressed that Vafamehr's role was limited to acting 'and she was not in any other way involved in the behind-the-scenes filmmaking', and also questioned the harshness of the sentence in the context of other films.
‘The producers are aware of several other Iranian films where actresses appear with a shaved head and no hijab, hence the news of Marzieh's sentencing appears to be unprecedented in this regard,' Cyan said.
‘My Tehran For Sale' premiered at the 2009 Adelaide Film Festival and has been screened at other events including the Rotterdam Film Festival and the Global Lens program at New York's Museum of Modern Art.
It was partially funded by the South Australian Film Corporation, and SAFC chief Richard Harris said the body would 'do everything within its power to assist in securing Marzieh's freedom.’
‘We are deeply disturbed by Marzieh Vafamehr's sentence for appearing in Granaz Moussavi's groundbreaking film, which is itself about the risks that artists are prepared to take for creative expression,' he said. (AFP - Oct 11, 2011)

Political prisoner beaten by prison guards in Evin Prison

Political prisoner Reza Jushan who is detained in cellblock 209 in Evin Prison was taken to the prison infirmary after being beaten.
This political prisoner was transferred to this cellblock some time ago and has sustained injuries in his left leg recently because of torture during interrogations. After pursuits by his family and after being informed of his condition, prison agents threatened his family that this time ‘it will not be like before and we know what to do with him’. IRAN: Flogging sentences used to repress free expression
Amnesty International is renewing its call on the Iranian authorities to stop cruel, inhuman and degrading punishments such as flogging after a spate of such sentences in the country. The organization said it feared such punishment is being meted out to deter others from criticising the authorities, particularly in the run-up to parliamentary elections scheduled for March 2012.
Actress Marzieh Vafamehr has become the latest individual to face such a sentence, after she was sentenced on or around 8 October 2011 to a year in prison and 90 lashes in connection to her appearance in the film My Tehran for Sale, in which she appears in one scene without the mandatory head covering which women in Iran are required to wear and appears to drink alcohol in another, although her husband Nasser Taghvai has denied she had actually drunk any alcohol. The exact charge of which she was convicted is not known to Amnesty International.
The consumption of alcohol is a criminal offence in Iran, punishable by 80 lashes for a first offence. Article 640 of the Penal Code also provides for between three to 12 months’ imprisonment and up to 74 lashes for “anyone who exhibits or puts for public viewing ….films … which offends public decency or morals”. Amnesty International considers the imposition of mandatory dress codes, such as that in Iran, to be a violation of the internationally recognized rights to freedom of expression and belief. Her lawyer is reported to have appealed against her conviction and sentence. Marzieh Vafamehr, believed to have been arrested in late June 2011, is held in Gharchak (or Qarchak) Prison in Varamin, where conditions are harsh. If Marzieh Vafamehr is held solely on account of the peaceful exercise of her right to freedom of expression, she should be released immediately and unconditionally.
In September 2011, Somayeh Tohidlou, a well known blogger and opposition activist was flogged 50 times for “insulting” the country’s President. Afterwards, she recounted on her blog how she was taken to Tehran’s Evin Prison on 14 September 2011 and chained hand and foot before being lashed 50 times.
Somayeh Tohidlou confirmed that while the lashing was largely “symbolic” and did not cause extreme pain, it was deeply embarrassing. In a message to those who carried out the punishment she said “Be happy, because if you wanted to humiliate me, my entire body is burning with humiliation.”
More recently, student activist Peyman Aref was flogged 74 times on the day of his release for “insulting the president” after serving a one year prison sentence for his peaceful political activities. He said that the flogging had been carried in a harsher manner than that prescribed by law. Under the law, flogging sentences should be carried out more or less harshly, depending on the offence.
A picture of the wounds to his back can be viewed on the website Human Rights House of Iran. He left prison supported by friends, as his injuries left him unable to walk unaided.
“I could not hold my back straight from the pain of being flogged. My heart condition is not good. On the advice of the doctors I took a shower but the pain and burning sensation is severe,” he told the opposition website Jaras. 'I just sent an open letter to the president to describe the catastrophic situation of universities. It did not bear any insults against him. I only said that I would never greet him,' he added.
Treating “insults” to officials as a criminal offence breaches international law and standards on freedom of expression, which permit only such restrictions as are demonstrably necessary and proportionate for the protection of certain public interests or the rights or reputations of others. It is well established in international human rights law that public officials should tolerate more, rather than less, criticism than private individuals.
The Iranian courts impose flogging sentences for a wide range of offences, including sexual offences, drug-related offences, drinking alcohol, theft, and some relating to freedom of expression and assembly, such as “insulting others” or “disturbing public order”. Most flogging sentences are imposed on men and are in some cases commuted to cash fines.
Another cruel punishment, amputation, is also provided as punishment for certain cases of theft; cross amputation, where a hand and opposite foot is cut off is one of four possible punishments for the offences of “enmity against God” and “corruption on earth”. Amnesty International recorded at least 12 cases of amputation for theft in 2010, with a further case of cross-amputation.
As judicial punishments, flogging and amputation both violate the international prohibition on torture and other cruel, inhuman and degrading treatment. According to Article 7 of the International Covenant of Civil and Political Rights (ICCPR), which Iran is a state party, “no one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.”
IRAN’s report on the implementation of the ICCRP will be considered by the UN Human Rights Committee on 17-18 October 2011 and the authorities will have to answer for their continued resort to a punishment which is banned in international law. (Amnesty International – Oct. 11, 2011)

قطع دست چهار سارق در اصفهان

فارس: صبح امروز اجراي حد شرعي نسبت به چهار سارق سابقه‌دار اصفهاني در زندان مرکزي اصفهان صورت گرفت.

سرقت يک نفر از اين مجرمان در شهرستان اصفهان صورت گرفته بود و سه نفر ديگر در شهرستان‌هاي بادرود، تيران و کرون و نجف‌آباد مبادرت به سرقت کرده بودند...

در اين مراسم حد شرعي سرقت و مجازات حبس و شلاق نسبت به سارق نجف‌آباد به دليل انجام 29 فقره سرقت و يک مورد سرقت همراه با آزار و سارق اصفهان به دليل انجام 100 فقره سرقت از منزل اجرا شده است. (عصر ايران, فارس – 17/7/90)

(توجه: عليرغم اينكه در خبر به صورت روشن ذكر نشده است, بر اساس ماده ۲۰۱ قانون مجازات اسلامي حد سرقت به شرح زير است:

الف – در مرتبه اول قطع چهار انگشت دست راست سارق از انتهاي آن بطوريکه انگشت شست و کف دست او باقي بماند.

ب – در مرتبه دوم ، قطع پاي چپ سارق از پائين برآمدگي بنحوي که نصف قدم و مقداري از محل مسح او باقي بماند.

ج – در مرتبه سوم حبس ابد.

د – در مرتبه چهارم اعدام ، ولوسرقت در زندان باشد)

يك‌سال حبس و 74 ضربه شلاق در انتظار رانندگان پرخطر

دادستان عمومي و انقلاب اهواز از اجراي طرح برخورد با رانندگان پرخطر و خطرساز در اين شهرستان خبر داد...

به گزارش ايسنا، فرهاد افشارنيا افزود: در همين راستا کميسيوني متشکل از رييس پليس راهنمايي و رانندگي، پليس امنيت و معاون دادستان در امور جنايي تشکيل و تصميمات لازم براي برخورد با اين افراد اتخاذ شد. در اين کميسيون مصوب شد رانندگان وسايل نقليه‌اي که اقدام به رفتارهاي پرخطر مي‌کنند، شناسايي و با تعقيبات محسوس و غيرمحسوس دستگير و خودروهاي آنان توقيف شود.

افشارنيا با بيان اين‌که با اجراي مرحله اول اين طرح، 100 دستگاه خودرو توقيف شد، تصريح كرد: براي مرتکبين اين تخلفات، مطابق ماده 618 قانون مجازات اسلامي، تا يک سال حبس و 74 ضربه شلاق در نظر گرفته شده و دادسراي اهواز بالاترين ميزان مجازات را براي اين افراد از دادگاه خواستار شده است. (ايسنا – 17/7/90)

يک سال حبس تعزيري و ۹۰ ضربه شلاق براي مرضيه وفامهر، همسر ناصر تقوايي

مرضيه وفامهر، همسر ناصر تقوايي و بازيگر فيلم “تهران من حراج” که اوايل تيرماه سال جاري بازداشت شده بود، به يک سال حبس تعزيري و 90 ضربه شلاق محکوم شده است.(كلمه – 17/7/90)

گفت و گوي جرس با پيمان عارف پس از اجراي حکم ۷۴ ضربه شلاق: وحشيانه بود

پيمان عارف، فعال دانشجويي محبوس در بند ۳۵۰ زندان اوين، پس از اجراي حکم ۷۴ ضربه شلاق، به خبرنگار جرس مي گويد: من اينجا در ايراني که احمدي نژاد مي گويد آزادترين کشور جهان است، به جرم توهين به احمدي نژاد شلاق خورده ام به گونه اي که جاي زخم هايش هنورز روي تن ام مانده است و قلبم درد مي کند.

پيمان عارف صبح امروز به اجراي احکام زندان اوين منتقل شد که با پايان دوران محکوميتش آزاد شود اما به گفته خود او لحظاتي پيش از آزادي به اتهام توهين به رياست جمهوري ۷۴ ضربه حکم شلاق او به اجرا در آمده است. (جرس – 17/7/90)

استراليا حکم شلاق براي هنرپيشه زن ايراني را محکوم کرد

خبرگزاري فرانسه، 11اکتبر، 2011 - سيدني - کانبرا روز سه‌شنبه از ايران مؤکدانه خواست حقوق‌بشر شهروندش را رعايت کند. اين موضع استراليا بعد از آن است که يک هنرپيشه زن در اين کشور به 90ضربه شلاق محکوم شد به‌خاطر اين‌که در فيلمي در استراليا حاضر شده بود که سرش روسري نداشت و تراشيده هم بود.

کوين راد (kevin) نخست‌وزير استراليا از گزارشات رسيده مبني‌بر يک سال زندان و شلاق براي نقش مرضيه وفامهر به‌خاطر نقش او در فيلم ”تهرانم براي فروش ”، ابراز نگراني عميق کرد. يک سخنگوي راد به خبرگزاري فرانسه گفت دولت استراليا استفاده از رفتار بيرحمانه، غيرانساني و تحقيرآميز يا مجازات تحقيرآميز را محکوم مي‌کند و از گزارشات راجع به خانم مرضيه وفامهر که به يک سال زندان و 90ضربه شلاق محکوم شده عميقاً نگران است. وي گفت دولت استراليا از ايران مؤکدانه مي‌خواهد حقوق همه شهروندان ايراني و خارجي را حفاظت کند. ضرب و شتم رضا جوشن در بند ۲۰۹ و انتقال به بهداري

در پي ضرب و شتم رضا جوشن، زنداني سياسي محبوس در بند ۲۰۹ نامبرده هفته گذشته به بهداري زندان اوين منتقل شد.

اين زنداني سياسي که از مدتي پيش به بند ۲۰۹ زندان اوين منتقل شده است اخيرا به دليل اعمال شکنجه در بازجويي‌ها از ناحيه ساق پاي چپ دچار آسيب ديدگي شده است.در پيگيري‌هاي صورت گرفته از سوي خانواده ايشان و اطلاع از وضعيت جسمي اين زنداني ماموران خانواده وي را تهديد کردند که اينبار به مانند دفعات قبلي نخواهد بود و اينبار مي‌دانيم که چه کاري انجام دهيم. ايران: استفاده از احکام شلاق زدن براي سرکوب آزادي بيان

عفو بين‌الملل فراخوان خود به مقامات ايران براي متوقف نمودن مجازات وحشيانه، غيرانساني و تحقير کننده‌يي مانند شلاق زدن را به‌دنبال موجي از محکوميتهاي اين چنيني در کشور تجديد مي‌کند . اين سازمان گفت، نگران آن است که چنين مجازاتي به‌منظور ارعاب سايرين از انتقاد به مقامات، خصوصاً در آستانه انتخابات مجلس در مارس 2012 صادر مي‌شود.

هنرپيشه مرضيه وفامهر آخرين شخصي است که پس از محکوميت به يک سال زندان و 90 ضربه شلاق در 8اکتبر 2011 يا حوالي اين تاريخ، به‌خاطر حضورش در فيلم تهرانم براي فروش، با چنين حکمي مواجه شده است…

همين اواخر، فعال دانشجو پيمان عارف، پس از سپري نمودن يک سال زندان بابت فعاليتهاي صلح‌آميز سياسي خود، در روز آزادياش به‌خاطر ”توهين به رئيس‌جمهور“ 74 ضربه شلاق خورد…

تلقي ”توهين“ به مقامات به‌عنوان يک جرم جنايي، ناقض قانون بين‌المللي و استانداردهاي آزادي بيان است. قانون بين‌المللي و استانداردهاي آزادي بيان تنها محدوديتهايي را مجاز مي‌دارندکه براي حفاظت از منافع مشخص عموم يا حقوق يا اعتبار سايرين به‌نحو قابل اثباتي ضروري و مناسب باشند . در قانون حقوق‌بشر بين‌المللي به‌خوبي تصريح شده که مقامات عمومي‌بايد انتقاد از جانب اشخاص را بيشتر تحمل کنند و نه کمتر (سايت عفو بين‌الملل- 20/7/1390)
