The Observatory for the Protection of Human Rights Defenders, a joint programme of the International Federation for Human Rights (FIDH) and the World Organisation Against Torture (OMCT), has received new information and requests your urgent intervention in the following situation in Iran.

New information:

The Observatory has been informed by the Iranian League for the Defence of Human Rights (LDDHI) of the ongoing restrictive and arbitrary conditions of detention imposed on Ms. Nasrin Sotoudeh, human rights lawyer known for defending juveniles facing death penalty, prisoners of conscience, human rights activists and children victims of abuse and being a member of the Defenders of Human Rights Centre (DHRC), winner of the 2012 prestigious Sakharov human rights prize awarded by the European Parliament.

According to the information received, on November 20, Ms. Nasrin Sotoudeh, who is serving a six-year imprisonment sentence in Evin prison, was finally allowed to receive a visit from her husband and children, in the presence of security officers. Ms. Sotoudeh is extremely thin now and weighs 43 kilos and continues her hunger strike to protest against the pressures inflicted against her children and husband.

For a few weeks, her family members had been denied the right to visit her, except on November 12 when only her children could visit her.

The Observatory further recalls that Ms. Sotoudeh has been on unlimited hunger strike since October 17, 2012 to protest against these measures restricting her right to visitation, and the pressures on her children and husband.

Following her hunger strike, the prison authorities issued a three-week punitive sentence of solitary confinement against Ms. Sotoudeh [1]. On October 31, a while after she had started her hunger strike, she was illegally transferred from Women’s Section to Section 209 [2] instead of Section 240, which is the “ordinary” solitary cells section of the prison, and is under the prison - and therefore judicial – administration until November 19. Her transfer to Section 209 was therefore illegal.

The Observatory therefore reiterates its demand on the Iranian authorities for the immediate and unconditional release of Ms. Nasrin Sotoudeh, and, more generally, of all human rights lawyers and defenders currently detained in Iran in relation to their human rights activities.

Background information:

On August, 28, 2010, Ms. Sotoudeh’s office and home were searched by members of the services of intelligence and her assets frozen.

On September 4, 2010, Ms. Sotoudeh went to Prosecutor’s Office based in Evin prison, where she had been summoned on allegations of “propaganda against the system” and “collusion and gathering with the aim of acting against national security” following interviews given to international media as well as for “membership in an illegal organisation” [the Defenders of Human Rights Centre (DHRC)]. After her questioning by a magistrate, Ms. Sotoudeh was arrested. Her lawyer was not permitted to be present during the questioning.

Before her arrest, she had reported several times, including in an interview with Radio Farda on May 2, 2010, that the authorities were using tax harassment against human rights lawyers in order to limit their working conditions. She gave the example of Ms. Shirin Ebadi who was subjected to the payment of a tax bill of hundreds of thousands of dollars on the money she had been granted for her Nobel Peace Prize.

During her detention she was held for long periods in solitary confinement and denied contact with her family and lawyer. She came close to death after three dry hunger strikes to protest her prison conditions and violations of due process. She was reportedly tortured in order to force her to confess.

On November 28, 2010, Ms. Nasrin Sotoudeh appeared before the Tehran Islamic Revolution Court. At the hearing, her lawyers requested her release on bail, which was denied by the court.

On January 9, 2011, Ms. Nasrin Sotoudeh was sentenced by Branch 26 of the Islamic Revolution Court to 11 years of imprisonment, and banned from practicing law and traveling abroad for 20 years on charge of “acting against national security” “propaganda against the system”, “collusion and gathering with the aim of acting against national security” and “membership in an illegal organisation”. On September 14, 2011, her sentence was reduced by Branch 54 of the Appeals Court to six years imprisonment and 10 years ban on practicing law. She was also fined by another court for “not wearing hijab during a videotaped message”.

On July 11, 2012, the authorities banned Ms. Sotoudeh’s husband and 12-year-old daughter from travelling abroad. This case has now been referred to the Islamic Revolution Court (Branch 28), which has summoned them to appear.

In September – October 2012, Ms. Sotoudeh’s visiting day was changed from Sunday to Wednesday without any legitimate ground being provided by the prison authorities. In addition to being deprived of face-to-face family visits, the new measure, which contravened the prison’s rules, made it more and more difficult for her to receive visits from her family over the past three months. However, after she went on hunger strike, the authorities changed her visitation days back to Sunday. It is also to be recalled that Ms. Sotoudeh has been banned from making phone calls since May 2011.

Actions requested:

Please write to the Iranian authorities and ask them to:

i. Guarantee in all circumstances the physical and psychological integrity of Ms. Nasrin Sotoudeh as well as all human rights defenders in Iran;

ii. Release her, as well all human rights defenders in Iran, immediately and unconditionally, since her detention is arbitrary as it only aims at sanctioning their human rights activities;

iii. In the meantime, provide her with all the medical treatment she would require during her detention and grant her family unhindered visitation with her;

iv. Put an end to acts of harassment - including at the judicial level - against her as well as against all human rights defenders in Iran;

v. Conform in any circumstances with the provisions of the Declaration on Human Rights Defenders, adopted on December 9, 1998 by the United Nations General Assembly, in particular:

article 1, which states that “everyone has the right, individually or in association with others, to promote the protection and realization of human rights and fundamental freedoms at the national and international levels”,

article 5(c), which reads that “everyone has the right, individually and in association with others, at the national and international levels, [...] to communicate with non-governmental or intergovernmental organizations”,

article 9 which notably states that “everyone has the right, individually and in association with others, inter alia […] to offer and provide professionally qualified legal assistance or other relevant advice and assistance in defending human rights and fundamental freedoms,

and article 12.2 which provides that “the State shall take all necessary measures to ensure the protection by the competent authorities of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration”;

vi. Ensure in all circumstances respect for human rights and fundamental freedoms in accordance with international human rights instruments ratified by Iran.

حبس خودسرانه نسرین ستوده و اعمال فشار بر او ادامه دارد


برنامه نظارت بر حمایت از مدافعان حقوق بشر، که برنامه مشترک «فدراسیون بین المللی جامعه های حقوق بشر» (
FIDH) و «سازمان جهانی مبارزه با شکنجه» (OMCT) است، اطلاعات تازه ای دریافت کرده و از شما درخواست می کند فورا در باره مساله زیر در ایران اقدام کنید.

اطلاعات تازه

برنامه نظارت بر حمایت از مدافعان حقوق بشر از طریق «جامعه دفاع از حقوق بشر در ایران» (
LDDHI) از تداوم فشارهای خودسرانه در حبس بر خانم نسرین ستوده مطلع شده است. خانم نسرین ستوده، وکیل حقوق بشری است که به دفاع از نوجوانان محکوم به اعدام، زندانیان عقیدتی، فعالان حقوق بشری و کودکان قربانی اذیت و آزار شهرت دارد. او عضو کانون مدافعان حقوق بشر بوده و برنده جایزه معتبر حقوق بشری ساخاروفِ پارلمان اروپا در سال 2012 است.

بنا به اطلاع دریافتی، خانم نسرین ستوده که حکم محکومیت شش سال زندان خود را در زندان اوین می‌گذراند، سرانجام در روز 30 آبان 1391 اجازه یافت در حضور مأموران امنیتی با همسر و فرزندان خود دیدار کند. خانم ستوده بسیار لاغر شده و وزن او به 43 کیلو کاهش یافته است. او به اعتصاب غذای خود در اعتراض به فشار علیه فرزندان و همسر خود ادامه می‌دهد.

اعضای خانواده او به مدت چند هفته از دیدار با وی محروم بودند، به‌استثنای دیداری در تاریخ 22 آبان که فقط فرزندانش توانستند با او دیدار کنند.

برنامه نظارت یادآوری می‌کند که خانم ستوده از تاریخ 26 مهرماه در اعتراض به محدودیت بر حق ملاقات خود و فشار بر فرزندان و همسرش دست به اعتصاب غذای نامحدود زده است.

در پی اعتصاب غذای خانم ستوده، مسئولان زندان او را به سه هفته حبس انفرادی تنبیهی محکوم کردند. [1] در تاریخ 10 آبان، چندی پس از شروع اعتصاب غذا، او به صورت غیر قانونی از بند زنان به بند 209 [2] منتقل شد و تا تاریخ 29 آبان در آنجا ماند؛ در حالی که بند "عادی" سلول‌های انفرادی زندان بند 240 است که در اختیار اداره زندان ـ و قوه قضاییه ـ قرار دارد. بنابراین، انتقال او به بند 209 غیرقانونی بود.

برنامه نظارت یک بار دیگر از دولتمردان ایران می‌خواهد که خانم نسرین ستوده‌ و به طور کلی تمام وکلای حقوق بشری و مدافعان حقوق بشر را که در حال حاضر به خاطر فعالیت‌های حقوق بشر خود در ایران در زندان هستند، فوری و بدون قید و شرط آزاد کنند.

اطلاعات پیشینه ای

ماموران امنیتی دفتر کار و منزل خانم نسرین ستوده در روز 6 شهریور 1389 مورد جستجو قرار داده و اموال او را توقیف کردند.

خانم ستوده در روز ۱۳ شهریور ۱۳۸۹ پس از دریافت احضاریه از دادستانی مستقر در زندان اوین به اتهام «تبلیغ علیه نظام» و «تبانی و اجتماع به قصد اقدام علیه امنیت ملی» در پی مصاحبه با رسانه های بین المللی و نیز «عضویت در یک سازمان غیرقانونی» [کانون مدافعان حقوق بشر] به زندان اوین مراجعه کرد. بازپرس پس از بازجویی خانم ستوده را بازداشت کرد. به وکیل او اجازه حضور در بازجویی داده نشد.

خانم ستوده پیش از دستگیری چندین بار، از جمله در گفتگویی با رادیو فردا در تاریخ 12 اردیبهشت 1389، گفته بود که دولتمردان ایران از مالیات برای اذیت و آزار وکلای حقوق بشری و محدود کردن فعالیت آنها استفاده می کنند. او خانم شیرین عبادی را مثال زده بود که برای دریافت وجه نقد جایزه صلح نوبل محکوم به پرداخت صدها هزار دلار شده است.
خانم ستوده در طی بازداشت مدت های طولانی در سلول انفرادی به سر برد و از تماس با خانواده و وکیل محروم بود. او پس از سه بار اعتصاب غذای خشک در اعتراض به شرایط زندان و نقض موازین قضایی با خطر مرگ روبرو شد. بنا به گزارش ها او را برای کسب اعتراف به زور در زندان شکنجه کرده اند.

خانم نسرین ستوده در روز 7 آذر 1389 در دادگاه انقلاب حضور پیدا کرد. وکلای او در دادگاه خواهان آزادی او به قید وثیقه شدند که مورد پذیرش دادگاه قرار نگرفت.

دادگاه انقلاب تهران شعبه 26 در روز 19 دی 1389، خانم نسرین ستوده را به اتهام «اقدام علیه امنیت ملی»، «تبلیغ علیه نظام»، «اجتماع و تبانی به قصد اقدام علیه امنیت ملی» و «عضویت در یک سازمان غیرقانونی» به 11 سال زندان و 20 سال محرومیت از اشتغال به وکالت و سفر به خارج محکوم کرد. در روز 23 شهریور 1390، شعبه 54 دادگاه تجدید نظر حکم او را به 6 سال زندان و 10 سال محرومیت از اشتغال به وکالت کاهش داد. او در دادگاه دیگری به اتهام «عدم رعایت حجاب در یک پیام ویدیویی» به جریمه نقدی محکوم شد.

در تاریخ 21 تیر 1391، دولتمردان خروج همسر و دختر 12 ساله خانم ستوده را از کشور ممنوع کردند. پرونده این دو اکنون به شعبه 28 دادگاه انقلاب ارجاع شده که آنها را احضار کرده است.

مسئولان زندان در مهرماه 1391، بدون ارایه هرگونه دلیل قانونی، روز ملاقات خانم ستوده را از یکشنبه به چهارشنبه تغییر دادند. این اقدامِ مغایر با مقررات زندان، علاوه بر محرومیت او از ملاقات حضوری، ملاقات های خانوادگی را بیش از پیش دشوار کرد. پس از شروع اعتصاب غذا، مسئولان زندان روز ملاقات را دوباره به یکشنبه تغییر دادند. لازم به یادآوری است که خانم ستوده از اردیبهشت 1390 از استفاده از تلفن محروم بوده است.

اقدام های مورد درخواست:
لطفا به دولتمردان ایران نامه بنویسید و از آنها بخواهید:
1- تحت هر شرايطی، سلامت روحی و جسمانی خانم نسرین ستوده و تمام مدافعان حقوق بشر در ايران را تضمين کنند؛
2 ـ فورا و بدون قید و شرط او، و تمام مدافعان حقوق بشر در ايران، را آزاد کنند، زیرا بازداشت آنها خودسرانه و فقط به قصد سرکوب فعالیت های حقوق بشری آنهاست؛
3 ـ تا آن زمان هر گونه مراقبت پزشکی لازم در طی بازداشت او را در اختیارش قرار دهند؛ و امکان دیدار بدون مانع با خانواده اش را فراهم سازند؛
4 ـ به هرگونه اقدام تهديدآميز و آزاردهنده، ازجمله در سطوح قضايی، علیه او و تمامی مدافعان حقوق بشر در ايران پايان دهند؛
5 ـ در هر شرایطی اعلاميه سازمان ملل در باره مدافعان حقوق بشر را، که در تاريخ ۱۸ آذر ۱۳۷۷ (۹ دسامبر ۱۹۹۸) در مجمع عمومی سازمان ملل تصويب شده، رعايت کنند، به ویژه:
• ماده 1 آن که می گويد: «همه افراد حق دارند به صورت فردی يا گروهی در سطوح ملی و بين المللی برای حمايت از حقوق بشر و آزادی های اساسی و تحقق این حقوق و آزادی ها فعالیت کنند،»
• ماده (ج) ۵ که می گويد: «همه افراد حق دارند به صورت فردی یا گروهی و در ارتباط با دیگران در سطوح ملی و بین المللی با سازمان¬های غيردولتی یا بین دولتی ارتباط برقرار کنند،»
• ماده 9 که می گوید: «همه افراد حق دارند به صورت فردی یا گروهی و در ارتباط با دیگران از جمله [...] کمک حرفه ای و تخصصی حقوقی یا مشاوره و یاری از نوع دیگر برای دفاع از حقوق بشر و آزادی های اساسی ارائه کنند»
• ماده 2ـ12 که می گويد: «دولت بايد کليه تدبيرهای لازم را به کار گیرد تا حمايت مراجع ذیصلاح از همه افراد به صورت فردی و گروهی در برابر خشونت، تهديد، اقدامات تلافی جويانه، تبعيض منفی عملی و يا قانونی، فشار یا هرگونه اقدام خودسرانه ديگر در پی استفاده مشروع و قانونی اين افراد از حقوق مذکور در اعلاميه حاضر، تضمين گردد.»
6 ـ به طور کلی، در هر شرایطی تضمین کنند که حقوق بشر و آزادی های اساسی مطابق با عهدنامه های بین المللی حقوق بشر و موازین بین المللی که ایران نیز متعاهد آنهاست رعایت خواهند شد.
