The execution sentence for political prisoner Ali Saremi which was upheld and announced has not even gone through the Iranian regime’s own legal judicial process. According to reports, the right to appeal the death sentence which was issued by Salavati for Saremi in the 15th branch of the court of first instance was not given to him in the Supreme Court.
His death sentence was announced to him on December 29, 2009 in Gohardasht Prison in Karaj. Saremi refused to sign the death sentence and demanded that the sentence be announced to his lawyer. Hosseini, his lawyer was waiting to receive an official sentence from the court of first instance to appeal it in the Supreme Court but after four months, the sentence has still not been announced to him.
On May 15, 2010, Abbas Jafari Dolat Abadi, Tehran’s Prosecutor, announced in an interview that the sentence for Mr. Saremi along with 5 other political prisoners has been finalized. His lawyer Mr. Hosseini was surprised from the announcement because he still had not received an official death sentence from the court of first instance and was not able to appeal the sentence. The question is how the death sentence could have been finalized without it being upheld by the Supreme Court.
On the other hand, Dolat Abadi said that Saremi was arrested on September 18, 2009 while he was arrested on September 4, 2007 after an attack by intelligence agents to his office following his participation in the 19th anniversary of the massacre of political prisoners in 1988.

اظهارات غير واقعي دادستان تهران درمورد اعدام زندانيان سياسي
حكم اعدام كه براي زنداني سياسي علي صارمي مورد تاييد و اعلام گرديده است حتي چارچوب قضايي خود اين رژيم را نيزطي نكرده است .
بنابه گزارشات رسيده به فعالين حقوق بشر و دمکراسي در ايران، حق اعتراض به حکم اعدام در دادگاه بدوي که در شعبه 15 دادگاه انقلاب توسط فردي بنام صلواتي عليه علي صارمي صادر شده است در ديوان عالي کشور از او سلب شده است .
حکم اعدام زنداني سياسي علي صارمي در تاريخ 8 دي ماه 1388 در زندان گوهردشت کرج به وي ابلاغ شد. آقاي صارمي از امضاي حکم اعدام امتناع کرد و خواستار ابلاغ اين حکم به وکيلش شد. آقاي حسيني وكيل آقاي صارمي در انتظار دريافت حکم رسمي ازدادگاه بدوي است تا بر عليه آن در ديوان عالي کشور اعتراض نمايد ولي بعد از گذشت بيش از 4 ماه هنوز اين حکم به وکيلش ابلاغ نشده است.
دركامل تعجب روز 25 ارديبهشت 1389 عباس جعفري دولت آبادي دادستان تهران طي مصاحبه اي اعلام کرد حکم اعدام آقاي صارمي همراه با 5 زنداني سياسي ديگر قطعي شده است. اين خبر باعث شگفتي آقاي حسيني وکيل گرديد، چرا كه هنوز حکم رسمي اعدام را از دادگاه بدوي دريافت نکرده است ونتوانسته عليه اين حكم به ديوان عالي کشور اعتراض كند ، پس چگونه مي شود بدون تاييد ديوان عالي کشور حکم اعدام قطعيت يابد.
از طرفي ديگر جعفري دولت آبادي دادستان تهران در مصاحبه خود دستگيري آقاي صارمي را 27 شهريور 1388 اعلام کرده است در صورتيکه او در تاريخ 13 شهريو 1386 بعداز شرکت در مراسم نوزدهمين سالگرد قتل عام زندانيان سياسي 1367 با يورش مامورين وزارت اطلاعات به محل کارش دستگير شده بود.
