After 161 days imprisonment, Mohamamd Youssefi was set free by bail last night
Mohammad Youssefi had received a 4 year prison sentence by Judge Slavati, but his sentence was commuted to in the court review to release, but the decision was blocked by Intelligence and security forces and he was not released until last night.
He was arrested in 16 Azar gathering of the students in the University as he entered the campus.
It is important to note that other students of Amir Kabir such as Majid Tavakoli and Nima Latif Tojar are still in the dungeons.



Organization against Execution of Kurdistan

According to reports received by this organization, and in a leak by an Iranian regime official working in the strategic planning board of Iranian Kurdistan in the that province, the execution of Habib Latifi is scheduled to be on 7 June 2010

This decision was taken in a board meeting compromised of Iranian regime officials for the Iranian Kurdistan province and 17 special members of the Iranian intelligence who had arrived in Sanandaj in a charted air flight from Tehran, whose job was to review the immediate threats posed to the State in that province and find ways to curb the problem.
The successful general strike in Kurdistan has alarmed the Iranian regime towards the threats posed by the people and their anger towards open suppression. This feeling of "set back" and weakness had envisioned itself in difference of opinion and interest expressed by those present in the close meeting. According to the source, some believed that open suppression has enforced the uprising and would have un controllable consequences for the regime, others such as officials from the Iranian justice and Courts Ministry and judges directly responsible for the events believed that more suppression was necessary.

Back ground to Habib Latifi

The following is a biography of Habibollah Latifi and a brief description of his case, prepared by Kuridstan Committee of Human Right Activists in Iran based on the stories by Mr. Latifi’s family and friends. Habibollah Latifi is a political prisoner on death row being held in Sanandaj prison.
Habibollah Latifi is the seventh child of Soghra and Abbas Latifi. He was born on March 21st, 1981 (first day of spring, and the start of the Iranian new year) in Sanandaj. The first seven years of his life, during the Iran-Iraq war, was spent in the village of Taysar near Sanandaj.

He loves sports and excels in soccer. He played in various soccer teams including Sanandaj Shahrdari (run by the mayor’s office). However, he had to leave the sport just before entering university, because a precondition to continue playing was being a member of the Basij militia. Latifi was an “A” student in the field of industrial engineering. He loves nature and topography in Kurdistan. As a result, Latifi took up mountain climbing. He has climbed many of Kurdistan’s summits.

Although he was born to a wealthy family, he always appeared in public dressed modestly. He was a bright student who received his high school diploma in 2001. In 2002, he was admitted to the University of Ilam for the Industrial Engineering program.

Habibollah Latifi has a keen interest in studying, and discussion and debate around Iran’s social and political issues. In particular, he is most concerned over issues pertaining to Kurdistan. He, along with his friends, was engaged in civil, cultural, environmental, and political activities ranging from involvement with NGOs to more political engagements. He also had the honour of being a member of the environmental associations: Zhianeh Vah and Shahoo.

Habibollah Latifi was arrested on an autumn evening in 2007 on Adab Street in Sanandaj. Eleven Intelligence agents arrested him while he was exiting a computing service shop. He was not able to set eyes on the outside world for four months after his arrest. He spent that time in solitary confinement and he was subject to vicious tortures by Intelligence investigators. On the ninth day of his arrest, he was transferred to a hospital in Sanandaj as a result of a kidney hemorrhage. At the hospital, he was spotted coincidentally by a relative who describes his condition as grave: “A boy with puffed eyes, grey skin, torn lips. He was unable to stand on his feet. He was being dragged by three people while eight military and plainclothes agents were escorting them.” It was later discovered that he had almost died as a result of being kicked and beaten by approximately six people who used batons. His only movement for the four weeks that followed the incident was crawling.

His head was broken in three spots and the repeated kicks had torn his lips. It is noteworthy that Habibollah Latifi protested his condition to Kamyani, the judge assigned to the case. The judge would visit him in his solitary cell to investigate. Kamyani denied any torture and accused Habibollah Latifi of lying.

Meanwhile, the provincial head of Intelligence (at the time it was Amjadi), in a conversation he conducted with Habibollah Latifi from behind a cell door’s slot, promised him that he would help him and Yasser Goli (Habib’s friend) escape, but only if Habib makes confessions against his friends and prepare a monthly report against two individuals (whose names he did not mention). Once he was faced with Habib’s negative reaction, Amjadi threatened him with a death sentence.

After the interrogation ordeal, Habibollah Latifi was transferred to another section of the prison where he was finally able to see the sunshine and his family after four long months. In summer 2008, during a trial that lasted a few minutes and without the presence of his family, Habibollah Latifi was found guilty of acting against national security and the regime. Judge Babayi, who was presiding over the case, cited a verse from the Qur’an and certain chapters from Ayatollah Khomeini’s book to conclude that Habibollah Latifi was a Moharebeh (an enemy and fighter against God). Subsequently, he was sentenced to death. Habibollah Latifi denies all the accusations.

The Court of Appeals also upheld the unlawful verdict in winter 2009.

Judge Babayi told him, “Your sentence is death anyway. You should take responsibility for the crimes of other innocent defendants whose cases are before me, and thereby close their cases.”

It should be mentioned that prior to Ehsan Fattahian’s execution and during when Habibolla’s mother joined in on prisoner hunger strike to protest the death sentences (she also threatened to set herself on fire), Babayi had threatened Elaheh (Habibollah’s sister who gave interviews to foreign media) with imprisonment and harsh legal actions. Previously, when Omid (Habib’s brother) had visited the court to follow up with his brother’s case, he was detained for half a day and beaten in public by the head of the court’s security.

While in prison, Habib’s bronchitis ,which he has been suffering from since childhood, deteriorated further. In addition, his stomach infection and dental problems (caused unsanitary prison conditions and the poor quality food served in solitary confinement) has aggravated his mental suffering. Despite repeated requests by his family and lawyer, officials deny medical care and have only once sent him to a hospital for a sonography test. The results of the test are reportedly lost.

Massoud Mehreban (former head of Sanandaj’s central prison) and Mohammad Khosravi (head of Sanandaj prison) constantly harass and pressure Habibollah Latifi by controlling his interactions with other individuals, and depriving him from family visits and phone contacts.

Only a week after the case was sent to the Supreme Court in early spring 2009, the appeal was denied. The case then went before the Pardoning Committee of the Supreme Court. After 10 months of secrecy, his lawyer, Dr. Nikbakht, was informed that the Committee had refused to hear the case.

With the disclosure of this decision, and in the wake of Eskandari (the head of execution sentences in Sanandaj) who said that there is no impediment to his death sentence being carried out, the possibility of Habibollah’s execution is stronger than ever.

There is no possibility to commute Habibollah’s death. He can be hanged one morning before sunrise any day.

We have to mention that Latifi’s family had trusted a few officials in the intelligence office and judiciary to save his life. These individuals claimed they can influence the outcome of the trial and extorted the family, but they did not deliver on their promises. The family has tried to make an appointment to see the heads of judiciary (current and former), but they were rejected.

Habibollah Latifi tried tirelessly to stop Ehsan Fattahian’s execution by taking part in a hunger strike. His attempts resulted in mounting pressure from prison officials. They searched and confiscated his personal items and cancelled his rights to visitation and phone calls to his family.

In December, he was once again taken to solitary confinement for four days to be tortured.

Moreover, at the time of Ayatollah Khamenei’s visit to Kurdistan, Intelligent agents went to his father’s home in the middle of the night to intimidate the family. As a result, Habibollah’s mother suffered from a heart attack.

Habibollah’s death sentence can be carried out any day, and his family is asking for help from human rights organization to stop his execution.

سازمان ضد اعدام کردستان گزارش های موثق از سنندج حاکی از آن است یک تیم 17 نفره از نیروهای ارشد وزارت اطلاعات و وزارت کشور رژیم اعدام که صبح روز پنجشنبه از طریق یک پرواز اختصاصی جهت شرکت در اجلاس ستاد کنترل بحران وارد سنندج شده بودند صبح روز شنبه، پس از ساعت ها رایزنی، سنندج را به مقصد تهران ترک کردند. یک منبع معتمد در استانداری کردستان فاش کرد موفقیت کم نظیر اعتصاب سراسری مردم کردستان چنان رژیم را شوکه کرده است که شدیدا به دنبال راه گریزی توده پسند در این وضعیت انفعالی است. به گفته ی این منبع حاضر در اجلاس، فضای حاکم بر اجلاس کاملا چند قطبی بوده است به گونه ای که یک گروه به طور کامل در طیف مخالفان اعدام قرار داشتند؛ گروه دیگر که عمدتا ماموران قوه ی قضاییه و کارشناسان ارشد افراطی وزارت اطلاعات بودند قویا از سیاست سرکوب نظام حمایت می کردند


حبیب الله لطیفی، از تولد تا محکومیت به اعدام
آنچه در پی می آید، زندگی نامه و شرح مختصری از پرونده حبیب الله لطیفی، زندانی سیاسی محکوم به اعدام و محبوس در زندان سنندج است که به روایت نزدیکان وی توسط کمیته کردستان مجموعه فعالان حقوق بشر در ایران، تهیه، تنظیم و جهت تنویر افکار عمومی ارائه میشود.
حبیب الله لطیفی هفتمین فرزند صغری و عباس لطیفی، 1 فروردین 1360 در سنندج چشم به جهان گشود. وی 7 سال نخست زندگی خود را به همراه خانواده اش (هنگام جنگ ایران و عراق) در روستای نایسر از توابع شهرستان سنندج و در آوارگی سپری نمود.
از کودکی به ورزش علاقه مند بود و در رشته ی فوتبال استعداد بی نظیری داشت. در حین گذراندن مقاطع تحصیلی ابتدایی و راهنمایی و دبیرستان، در تیم های مختلف فوتبال از جمله تیم شهرداری سنندج بازی کرد. اما در آستانه ی ورود به دانشگاه مجبور به ترک آن شد چرا که پیش شرط ادامه ی آن، ثبت نام در مرکز بسیج بود و بدین ترتیب حبیب که حاضر به ثبت نام در بسیج نبود، علی رغم میل باطنی خویش مجبور به ترک باشگاه و خداحافظی از فوتبال شد. حبیب که عاشق طبیعت کردستان بود، کم کم به ورزش کوهنوردی روی آورد و توانست بسیاری از کوه های کردستان را فتح نماید.
علی رغم آن که حبیب در خانواده ای ثروتمند متولد شده بود، همواره در اجتماع فروتنانه ظاهر می شد. این دانش آموز ممتاز در سال 1380 موفق به اخذ دیپلم و پیش دانشگاهی رشته ی ریاضی و فیزیک شد و در مهرماه 1381 به دانشگاه ایلام راه یافت و در رشته ی مهندسی صنایع ادامه تحصیل داد.
حبیب جوان، علاقه ی ویژه ای به مطالعه و بحث و گفتگو در خصوص مسائل اجتماعی – سیاسی ایران به ویژه کردستان داشت. او به همراه دوستان خود مدام مشغول فعالیت های مدنی، فرهنگی، زیست محیطی و سیاسی بود. از شرکت در NGO ها گرفته تا فعالیت سیاسی. وی همچنین افتخار عضویت انجمن های زیست محیطی ” ژیانه وه ” و ” شاهو ” را داشت.
حبیب الله لطیفی ساعت 7:40 غروب 1 آبان ماه 1386 در خیابان ادب سنندج از سوی 11 تن از نیروهای امنیتی اطلاعات در زمانیکه از یک خدمات کامپیوتری خارج می شد محاصره و بازداشت شد و از آن غروب تا 4 ماه بعد، آفتاب را در آسمانش ندید. وی 4 ماه در زندان انفرادی تحت شکنجه ی شدید بازجویان اطلاعات مورد بازجویی قرار گرفت. روز نهم بازداشتش بر اثر خونریزی کلیه هایش به بیمارستان تامین اجتماعی سنندج (دور افتاده ترین بیمارستان شهر) منتقل می شود و بر حسب اتفاق یکی از بستگان نزدیک اش وی را در وضعیتی بسیار وخیم اینگونه می بیند “پسرکی با چشم هایی ورقلمبیده و پوستی کدر و تیره و لبان پاره شده که 3 نفر وی را که توان راه رفتن نداشت و در میان بازوانشان نیمه خمیده و به سختی قدم بر می داشت، از پله های بیمارستان بالا می بردند و 8 نفر دیگر نظامی و لباس شخصی آنان را اسکورت می کردند”. بعدها معلوم شد که 5 الی 6 نفر او را به باد لگد و باطوم گرفته و تا سرحد مرگ کتک زده اند. او 4 هفته توانایی هیچ حرکتی جز سینه خیز نداشت. سرش از 3 ناحیه شکسته بود و لگدهای پیاپی لبانش را شکافته بود. گفتنی است طی اعتراض حبیب به قاضی کامیانی بازپرس پرونده که هر از گاهی جهت بازپرسی به تک سلولی وی در اطلاعات مراجعه می کرد، کامیانی هرگونه اعمال شکنجه را انکار کرده و حبیب را متهم به اظهارات کذب نموده بود.
در این گیر و دار رئیس کل اطلاعات استان و دادستان آن زمان سنندج (امجدی) طی گفت و گویی که در تک سلولی اطلاعات از پشت دریچه سلول با حبیب انجام داده بودند، قول فراری دادن شخص وی و دوستش یاسر گلی در ازای اعتراف بر علیه دیگر دوستانش و فرستادن گزارش ماهانه در مورد 2 نفر (که مشخص نکرد چه کسانی هستند) را داده بودند که پس از آن که با واکنش منفی حبیب رو به رو شده بودند او را تهدید به اعدام کرده بود.
پس از پروسه بازجویی که توسط ماموران وزارت اطلاعات انجام شد، به بند قرنطینه و سپس بند پاک 2 زندان مرکزی سنندج منتقل شد و پس از 4 ماه چشمانش به نور آفتاب و دیدار خانواده اش روشن شد. حبیب در تاریخ 10 تیرماه 1387 طی دادگاهی چند دقیقه ای و بدون حضور خانواده، در شعبه ی اول دادگاه انقلاب اسلامی سنندج از سوی قاضی حسن بابایی به جرم اقدام علیه امنیت ملی و نظام با استناد به آیه 33 سوره مائده (قرآن کریم) و استناد به مسائل یکم، سوم و پنجم از فصل ششم (حد محارب) جلد چهارم کتاب تحریر الوسیله امام خمینی و مواد 183، 186، 190، 191 قانون مجازات اسلامی، محارب (دشمن خدا) اعلام شده و به اعدام محکوم شد (اتهامی که وی هیچگاه نپذیرفت).
در پی اعتراض به این حکم غیرحقوقی، در 10 بهمن ماه 1387 باردیگر این دانشجوی کرد در دادگاه تجدید نظر به اعدام محکوم شد.
تاسف آور است که قاضی بابایی در این رابطه به وی گفته بود، “تو که حکم ات اعدام است بیا و جرم های پرونده ی دیگر متهمان بی گناه من را به عهده بگیر، بگذار این پرونده ها نیز مختومه شود!!”
لازم به ذکر است در آستانه ی اعدام زندانی سیاسی احسان فتاحیان و زمانی که مادر حبیب به نشانه ی اعتراض به اعدام وی به جمع زندانیان سیاسی اعتصاب کننده پیوست و تهدید به خودسوزی کرده بود، حجت اسلام بابایی “الهه” خواهر حبیب را به دلیل مصاحبه با رسانه های خارجی تهدید به پرونده سازی “چرب” و زندان کرد. پیش از آن نیز امید برادر حبیب که جهت پیگیری پرونده ی او به دادگاه رفته بود، از سوی حمزه ای رئیس سابق حفاظت دادگاه انقلاب سنندج، به مدت نیم روز بازداشت و در مقابل انظار عمومی مورد ضرب و شتم شخص رئیس حفاظت قرار گرفته بود.
در طی مدت بازداشت، کم کم بیماری برونشیت (عفونت ریوی) که در کودکی از آن رنج می برد، باردیگر عود کرده و عفونت معده و دندان ها که همگی بر اثر نبود بهداشت در هوا و غذای تک سلولی اطلاعات و زندان مرکزی سنندج ظاهر شده بودند، بر فشار و شکنجه ی روحی او افزود. اما علیرغم درخواست های مکرر حبیب و خانواده و وکیلش مسوولان اجازه ی درمان نداده و تنها یک بار به منظور انجام سونوگرافی حبیب را به بیمارستان توحید سنندج منتقل کردند که بعدها اعلام کردند جواب سونوگرافی گم شده است. مسعود مهربان (رئیس سابق حفاظت زندان مرکزی سنندج) و محمد خسروی (رئیس زندان مرکزی سنندج) توسط نیروهای خود در زندان حبیب را با کنترل روایط تحت فشار قرار داده و به طرق مختلف از جمله ممنوعیت های بی دلیل و ناگهانی ملاقات و تماس تلفنی او را آزار می دهند.
پس از ارجاع پرونده به دیوان عالی کشور در تاریخ 16 فروردین 1388 که جهت آخرین تجدیدنظر بر این پرونده ی غیرحقوقی صورت گرفت، تنها یک هفته پس از آن، درخواست مزبور، با مخالفت مسوولان مواجه شد و این مسئله که کمیسیون عفو دیوان عالی کشور حاضر به بررسی مجدد پرونده نشده است، پس از 10 ماه مخفی کاری دستگاه مربوطه، هفته ی گذشته و به صورت شفاهی به دکتر صالح نیکبخت وکیل حبیب اعلام شد. بدین ترتیب احتمال اجرای حکم حبیب با فاش شدن این مسئله و پس از آنکه از سوی اسکندری رئیس اجرای احکام دادگاه انقلاب سنندج به وی اعلام کرد که هیچ تضمینی جهت عدم اجرای حکم اعدام وجود ندارد قوت گرفت.
احتمال لغو حکم اعدام حبیب از میان رفته است و هر آن امکان دارد در یک سپیده دم، وی نیز به دار آویخته شود.
لازم است به مصائب خانواده لطیفی نیز اشاره کرد که حسب ادعای مسوولیت و نفوذ چند تن در اداره اطلاعات و قوه ی قضائیه و از آن جا که خانواده ی وی مجبور بودند برای نجات جان فرزندشان به آن ها اعتماد نمایند مبالغ فراوانی از خانواده حبیب وجه نقدی و رشوه دریافت شده و هیچ کاری نیز در ازای آن انجام نشده است.
هم چنین خانواده لطیفی خواستار دیدار با مقامات قضایی همچون آیت الله شاهرودی، آقای لاریجانی و استاندار کردستان (اسماعیل نجار) بوده اند، اما این مقامات به بهانه های مختلف از دادن وقت ملاقات با این خانواده سر باز زده و هیچ یک حاضر به پاسخگویی به درخواست آنان نبوده اند.
حبیب از جمله زندانیان سیاسی و اعتصاب کنندگان معترض به اعدام احسان فتاحیان بود و تا آخرین لحظات از تلاش برای نجات جان این همبندی خود از پای ننشست و این خود دلیلی شد بر تشدید فشار هایی که هم اکنون در حق او اعمال می دارد. منجمله نگهبانان به دستور ریاست زندان، چندین بار وسایل و یادداشت و کتب شخصی حبیب را تفتیش و ضبط، حق ملاقات حضوری با خانواده اش و سپس تلفن را از وی سلب کردند.
در پایان نیز لازم به ذکر است اواسط دی ماه سال گذشته حبیب یک بار دیگر جهت پاره ای توضیحات از زندان به سلول های انفرادی این اداره منتقل شد و مدت 4 روز را تحت شکنجه به سر برده بود. همچنین در زمان آیت الله خامنه ای به کردستان بر اثر رفتن ماموران اداره اطلاعات در پاسی از شب به خانه ی پدری حبیب که به منظور تهدید خانواده وی جهت حبس خانگی تا اتمام سخنرای آیت الله خامنه ای در میدان آزادی سنندج صورت گرفته بود، مادر حبیب دچار سکته ی قلبی شد.
در حال حاضر، زندانی سیاسی حبیب الله لطیفی، 28 ساله، در زندان مرکزی سنندج، بند 2 تحت حکم اعدام قطعی به سر می برد که هر لحظه با استیذان ریاست قوه قضائیه می تواند به اجرا درآید. خانواده وی تمامی مجامع و نهادهای حقوق بشری را برای نجات جان وی به مدد طلبیده اند.

A statement by members of the Committee of Human Rights Reporters

When a dignified and noble palace, after years of proud resistance against upheavals, is destroyed by its inhabitants, what can we do but to sigh out of grief and pity? When the will of evil prevails over the pure and divine self-sacrifice of the heralds of liberty, what is left but regret? And when the wind of lies blows in the sky, how can we take refuge in the message of the disillusioned emissary?

We will emphasize as we have before that“the outlandish and preposterous claim that CHRR is linked to foreign governments or political groups has been repeated for a long time from various government tribunes- be it Tehran’s Prosecutor, the state and military news agencies, the Ministry of Intelligence interrogators, or the internet pirates who are floating in the swamp of their own lies.

Of course, no credible and trustworthy evidence is offered to back up this obvious lie. The Ministry of Intelligence, through its so-called experts, has launched a petty game to cover up the extent and depth of the systematic and organized human rights violations [in Iran]. Repeating these unfounded claims is, in fact, advertisement for and promotion of groups that have no [favourable] place in the Iranian public opinion.”**

We will state again that we confirm “there is no doubt that the Ministry of Intelligence, which spends large amounts of money out of the Iranian people’s pocket, is certainly aware of the independence of CHRR from all political parties and movements. That is why the absurd scheme of tying CHRR to the MKO (Mujahedin Khalq Organization), as it has been suggested by Ministry of Intelligence experts, cannot be considered anything but an attempt to pave the way for physical elimination of a reputable group of people whose activities are based on human rights since its conception.

For CHRR and all human rights activists, defending the human rights of every individual, regardless of their political orientation, religion, and ethnic background, is the most important principle. We candidly declare that in addition to the activities in the field of human rights including women, children, workers, religious, ethnic, and sexual minorities rights, we will be defending the rights of all political prisoners and prisoners of conscious.”**

We have said and we repeat once again that “The Committee of Human Rights Reporters (CHRR) is one of the organizations that has requested, with an emphasis on belief and commitment to the Universal Declaration of Human Rights, the implementation of the Declaration in all aspects of the Iranian people’s lives. As it has been repeatedly stressed, the Committee is independent and does not belong to any political party or branch. The Committee has no political mandate.

The Committee’s activities, which started in 2005, involve presenting reports and providing information on all humans whose rights have been infringed or violated. These people involve women, children, prisoners, workers, etc. CHRR has also tried to prevent the systematic and perpetual violation of human rights by spreading public awareness, seeking assistance from domestic and international institutions to draw the government’s attention to the violation of basic rights for citizens.”**

The intention behind reiterating the above statement is a letter that has been written by a number of CHRR members, including some who were recently released from prison. The purpose is not to blame and badger our dear colleagues, but to remind our readers to disregard [the previously released controversial statements by CHRR that were written with the force of regime interrogators) and judge fairly the situations our friends [referring to the imprisoned members of CHRR] have had to endure.

On May 13, 2010, a statement titled, “Human rights are human rights” was published on the CHRR website. The statement that was full of spelling and grammatical mistakes and had other signs that it was written in a rush (these mistakes are visible to an aware reader) is in clear contrast to the Committee’s conduct in recent years. On May 15, 2010, after the publication of the “letter of aversion,” some websites who picked up the letter and posted it added in the last paragraph that some exiled members of CHRR are accused of “unfairness,” “violation of individual rights,” and “lack of respect for group and organizational efforts.” Thus it has been insinuated that those members of CHRR who have not signed the statement are the subject of outlandish claims made by Intelligence interrogators and state-military media regarding ties with the MKO.

The flagrant and absurd lies published by interrogators and their media has been repeatedly denied by CHRR. However, since we have insisted on our independence and our apolitical activities, we have been trying to report human rights violations from a purely human rights stance to avoid falling in the whirlwind of taking a political stance for or against any political group.

We have always believed that writing “letters of aversion from a certain political group” is not a human rights activity, but rather a political act. We have tried to keep CHRR clear of such effluence. Moreover, it is evident that stepping into this field by those members who are not in jail will only increase the pressure Intelligence interrogators exert not only on the members who are outside of prison but also for those who are detained and may go forward and give false confessions.”

It is not our intention to shed light on the internal issues of CHRR, but to point out a reality that will help the public uncover the truth. After the proposal to write a letter of aversion was put forward by some of the recently released members of CHRR, and not all of them, naturally many of the members opposed the publication of such a statement for the above-mentioned reasons. However, regretfully, and despite the will of the majority of the Committee, another statement which was still contrary to the conduct of CHRR was published on the website on May 7, 2010. The text was temporarily removed since internal negotiations [in prison] were not yet conclusive.

In the wake of these events, some members of CHRR, including a few who have left Iran after perceptible and active threats against their safety, have resigned from their activities in CHRR as they are against the publication of such letters of aversion and consider these letters in clear contrast to the purpose of CHRR. The resignations came after the publication of the May 13th letter titled, “Human Rights Are Human Rights.”

There is no doubt that the majority of the politically-conscious people are aware of the poison that the garden of CHRR has been exposed to. This awareness makes us hopeful that our readers understand the current circumstance. Certainly, the haste of writers and publishers of this non-human rights statement is completely understandable and does not require hair-splitting analyses. Even the year the organization was founded was typed incorrectly in the statement.

The most unfortunate part is the unethical conduct of the writers of the letter in their accusations against those members who opposed the publication of this letter.

Authors of the letter believe that taking sides will only harm human rights activities and will result in the satisfaction of those who violate human rights. Thus, we consider this painful discussion closed. We will strongly avoid engaging in it any further in hopes that the flag of pure and honest human rights reporting shall forever be up and flying.

We wish that our imprisoned friends Shiva Nazar Ahari and Koohyar Goodarzi will be released very soon. There is no doubt that the breeze of freedom shall blow, sooner or later, on this wounded land.

بیانیه جمعی از اعضای کمیته گزارشگران حقوق بشر
آنزمان که کاخی رفیع پس از سالها ایستادگی و سربلندی در برابر طوفان حوادث ، به دست ساکنان آن تخریب می شود، جز آهی از سر حسرت و اندوه چه میتوان کرد ؟ آنگاه که اراده اهریمن بر جانبازی پاک و اهورایی منادیان آزادی پیشی می گیرد جز افسوس چه می ماند؟ و وقتی در آسمان ، دروغ وزیدن می گیرد ، دیگر چگونه می شود
گفته ایم و بار دیگر تاکید می کنیم که “ادعای گزاف ارتباط کمیته گزارشگران حقوق بشر با دولت های خارجی یا گروه های سیاسی، مدت هاست که از بلندگوهای مختلف حکومتی از دادستان تهران گرفته تا خبرگزاری های دولتی و نظامی و از بازجویان اطلاعات گرفته تا راه زنان اینترنتی که در مرداب دروغ خود غوطه می خوردند،‌تکرار می شود. بر این کذب آشکار البته هیچ سند و مدرک معتبر و قابل اعتنایی ارائه نمی شود. وزارت اطلاعات از طریق به اصطلاح کارشناسان خود،‌ چنین بازی سخیفی را به راه انداخته است تا بر گستردگی و عمق نقض سازمان یافته حقوق بشر سرپوش نهد. غافل از اینکه تکرار این مدعای بی بنیاد به واقع تبلیغی است برای گروه هایی که خود جایگاهی در افکار عمومی ایران ندارند. “**
گفته ایم و بار دیگر بر آن صحه می نهیم که “در این تردیدی نیست که وزارت اطلاعات با صرف هزینه های هنگفت از جیب مردم ایران، بطور قطع از استقلال کمیته گزارشگران حقوق بشر از همه احزاب و جریانهای سیاسی مطلع است، از همین روست که طرح یاوه ای چون ارتباط کمیته با سازمان مجاهدین خلق از سوی کارشناسان اطلاعات چیزی جز زمینه سازی برای حذف فیزیکی مجموعه ای خوشنام که از بدو تاسیس صرفا در عرصه حقوق بشر فعالیت کرده است، ارزیابی نمی شود. برای ما و همگی فعالان حقوق بشر دفاع از حقوق انسانی تک تک افراد، فارغ از گرایشات سیاسی، مذهبی، قومی و … اصل بوده است و به صراحت نیز اعلام میداریم در کنار فعالیت در کلیه عرصه های حقوق بشر اعم از حقوق زنان، کودکان، کارگران، اقلیتهای قومی، مذهبی جنسی و … از حقوق همه زندانیان سیاسی و عقیدتی بدون در نظر گرفتن گرایش آنان و حتی بدون در نظر گرفتن مجرم بودن یا نبودن آنان دفاع نموده و ذره ای از این آرمان انسانی عقب نشینی نخواهیم نمود. “**
گفته ایم و بار دیگر تکر می کنیم که “کمیته گزارشگران حقوق بشر نیز یکی از این مجموعه هاست که با تاکید بر اعتقاد و التزام به اعلامیه جهانی حقوق بشر خواستار اجرای آن در تمامی زوایای زندگی مردم ایران بوده و چنانکه بارها مورد تاکید قرار گرفته، مستقل بوده و به هیچ حزب و جناحی تعلق نداشته و فاقد ماهیت سیاسی است. این کمیته فعالیت خویش را در سال 84 آغاز کرده و با ارائه ی گزارش و همچنین آگاهی رسانی نسبت به تمامی افرادی که به نوعی حقوق انسانی آنها مورد تعدی و تجاوز قرار گرفته؛ اعم از زنان، کودکان، زندانیان، کارگران و … و همچنین تلاش در جهت جلوگیری از نقض مستمر حقوق بشر از طریق تنویر افکار عمومی و استمداد از سایر نهادهای داخلی و نیز سازمانهای بین المللی حقوق بشر سعی در ایجاد بستری مناسب به منظور جلب توجه دستگاه حاکم نسبت به عواقب وخیم نقض حقوق اساسی شهروندان داشته است.”**
اما غرض از تکر ار این پیش گفته ها نامه ای است که به قلم برخی اعضای تازه آزاد شده و عزیز کمیته گزارشگران حقوق بشر نگاشته شده و ناباورانه پیش چشم ماست. مقصود نه تخطئه عزیزانمان که تذکره مخاطبانمان است، تا به دیده اغماض بنگرند و عادلانه به قضاوت بنشینند که چرا و چگونه، آنچه مکروه دوستانمان و مقبول دشمنانمان است، رخ نموده است.
آنچه واقع شده از این قرار است که در تاریخ 23 اردیبهشت، اطلاعیه ای با نام “حقوق بشر، حقوق بشر است” در سایت کمیته گزارشگران حقوق بشر منتشر شده است. (با کد داخلی 9636 به تاریخ 23 اردیبهشت( اطلاعيه ای که از يک سو حاوی خطاهايی است املائی، انشايی و محتوايی که حکايت از تعجيل نويسنده در انتشار آن دارد (اين خطاها از ديد ناظران آگاه البته پوشيده نيست) و از سوی ديگر در تقابل آشکار است با عملکرد کميته گزارشگران حقوق بشر در سالهای اخير. اما با کمال تعجب در 25 اردیبهشت ماه و پس از انتشار انزجارنامه در سایت کمیته، نامه ای در پیشگاه برخی سایتها مشاهده شد که در آن علاوه بر باز نشر انزجارنامه، در بخش پایانی آن برخی از اعضای تبعیدی کمیته به “ناجوانمردی” و “نفی حقوق فردی” و “عدم رعایت اصول کار تشکیلاتی” متهم شده و چنان القاء شده است که گویا سایر اعضای کمیته که نامشان در ذیل آن اطلاعیه نیامده، مشول ادعاهای گزاف بازجویان اطلاعات و رسانه های دولتی – نظامی مبنی بر ارتباط با سازمان مجاهدین خلق، هستند.
کذب محض یاوه سرایی بازجویان و رسانه های وابسته به آنان البته روشن و واضح بوده و مکررا از سوی کمیته گزارشگران حقوق بشر، چنانکه در بالا آمده است، مورد تاکید قرار گرفته است. اما همانطور که ما بر استقلال تام خود بارها تاکید کرده ایم، بر فعالیت غیر سیاسی خود نیز پای فشرده و سعی بر آن داشته ایم که از موضعی صرفا حقوق بشری موارد نقض حقوق بشر را گزارش کرده و از در غلتیدن در گرداب موضع گیری سیاسی له، یا علیه گروههای سیاسی بپرهیزیم. همواره بر این باور بوده ایم که نوشتن “انزجار نامه” نه کاری حقوق بشری بلکه فعلی سیاسی است و لذا دامان کمیته را از این آلایش مبرا خواسته ایم. علاوه بر این بدیهی است که پای نهادن در این وادی از سوی اعضای خارج از زندان، فشار اطلاعات برای فراتر رفتن از اینگونه اعترافات را نه تنها برای اعضای بیرون از زندان، که بیشتر و پیشتر از آن برای اعضای دربند کمیته، افزایش خواهد داد.
قصد ما نه بر آفتاب افکندن مسائل داخلی کمیته که صرفا اشاره به واقعیتی است که در محکمه افکار عمومی، به کار کشف حقیقت می آید. پس از آنکه از سوی برخی از اعضای تازه آزاد شده کمیته و نه همه آنها، پیشنهادی بر نوشتن انزجار نامه مطرح گردید، متنی ارائه شد بی شباهت به اطلاعیه ای حقوق بشری و معارض با مرامنامه و موازین مورد قبول کمیته. طبیعی است که اکثریت اعضا با انتشار چنان متنی به دلایل مذکور مخالفت نمودند. اما با کمال تاسف و علیرغم خواست اکثریت اعضا متن دیگری که کماکان با رویه کمیته در تعارض بود، بدون هماهنگی در سایت کمیته منتشر شد (با کد داخلی 9594 به تاریخ 19 اردیبهشت). این متن به دلیل عدم کفایت مذاکرات داخلی موقتا از حال انتشار خارج گردید. متعاقب آن، بخشی از اعضای کمیته، از جمله چند تن که بنا به تهدیدات بالفعل از کشور خارج شده اند، به دلیل مخالفت با انتشار چنین انزجار نامه هایی و از آن رو که چنین حرکتی را در تقابل آشکار با موقعیت حقوق بشری کمیته می دانستند، و به علت پافشاری سوال برانگیز نویسندگان نامه بر انتشار متن، از فعالیت در کمیته کناره گیری کردند. آنچه در 23 اردیبهشت دوباره و تحت نام “حقوق بشر، حقوق بشر است” با تغییراتی اندک و توسط یکی از امضا کنندگان آن در سایت کمیته منتشر گردید، پس از این کناره گیری بوده است.
شکی نیست که عموم آگاهان از آن سموم که بر طرف بوستان کمیته گذشته مطلعند و همین اطلاع است که ما را به درک شرایط پیش آمده از سوی مخاطبان سایت امیدوار می کند. مطمئنا تعجیل نویسندگان و منتشر کنندگان انزجارنامه بر انتشار این متن غیر حقوق بشری، که حتی در اعلام سال تاسیس کمیته خطا کرده است، کاملا قابل فهم بوده و نیازی به موشکافی ندارد. آنچه موجب تاسف است، برخورد غیر اخلاقی نویسندگان نامه با مخالفین و متهم کردن خلاف واقع آنان است.
از نظر نگارندگان نامه حاضر، ادامه این موضعگیری ها جز ضربه به فعالیت حقوق بشری و از این رهگذر خوشنودی ناقضان آن چیزی در پی نخواهد داشت. ازین رو ضمن پوزش از نگاشتن همین چند کلام، این گفتگوی دل آزار را همینجا خاتمه یافته تلقی کرده و قویا از ادامه آن اجتناب خواهیم نمود. به امید آنکه پرچم گزارشگری خالصانه و صادقانه حقوق بشری همواره برافراشته و در اهتزاز ماند. آرزوی ما این است که رفقای دربندمان، شیوا نظرآهاری و کوهیار گودرزی هر چه زودتر از بند برهند. بی تردید نسیم آزادی دیر یا زود بر این دیار محنت زده خواهد وزید.

EU urges Iran to drop death sentence on two 'moharebs'

European Union foreign affairs chief Catherine Ashton on Wednesday pleaded with Iran to drop death sentences imposed on two people awaiting execution for being 'enemies of God'.

The call came after five militants were hanged for similar offences on Sunday, a decision Ashton said the EU "strongly condemns."

Ashton urged Tehran to "consider alternative sentences" for a woman and a man each convicted of being 'moharebs' or 'enemies of God' -- a crime punishable by death under Iran's Sharia-based Islamic law.

Zeynab Jalalian and Hossein Khezri are currently in prison awaiting execution, after Iran on Sunday hanged the five, including a Kurdish woman, convicted of bombing government offices and a gas pipeline to Turkey, state media reported.

"The European Union strongly condemns the executions on 9 May, 2010, in the Evin prison of Iran of Shirin Alamhouli, Farzad Kamangar, Ali Haydarian, Farhad Vakili and Mehdi Eslamian," Ashton's statement read.

The EU "is profoundly concerned by the repeated sentencing to death in Iran of people belonging to minorities, as well as of those who were involved in the post-election protests," she underlined.

Sunday's hangings brought to at least 61 the number of people executed in Iran so far this year, according to an AFP count based on news reports. Last year, at least 270 people were hanged.

Tehran says the death penalty is essential to maintain public security and is applied only after exhaustive judicial proceedings.

Ashton said the EU, which opposes the death penalty in all circumstances, repeated calls for Iran to show "respect of minimum standards in cases of capital punishment."

(Radio Zamaneh) -- Hundreds of people in the city of Jalalabad in Afghanistan demonstrated in protest to execution of Iranian and Afghan prisoners by the Islamic Republic. The demonstrators marched toward Iranian Consulate in Jalalabad and the police failed to stop them from approaching the building.

Demonstrators reportedly beat on the doors of the Consulate and burned images of ruling cleric figures of Iran.

They also carried images of the five Iranian political prisoners that were executed in Iran last Sunday and expressed support for Iranian political prisoners.

The demonstrators called for an end to executions in Iran and chanted “Death to despotism, in Kabul and in Tehran!”

Afghanistan Coalition Party organized the demonstration and issued a statement in support of the families of the executed political prisoners in Iran and condemned Islamic Republic system’s oppressive policies.

This is the fifth demonstration in Afghanistan against executions in Iran. The earlier demonstrations however were concentrated on execution of Afghan prisoners in Iran.

Last month demonstrators protested in front of Iranian embassy in Kabul condemning mistreatment of Afghan residents of Iran. An effigy of Mahmoud Ahmadinejad was burned during these protests and Islamic Republic reacted to the events by summoning Afghanistan charge d'affaires to Iran’s Ministry of Foreign Affairs.

A number of Afghanistan members of Parliament maintain that tens of Afghan citizens have been executed in Iran.

According to a report from an Afghan panel that travelled to Iran to inspect situation of Afghan immigrants in Iran, there are currently 5600 Afghan prisoners in Iran mostly for drug charges and close to three thousand of them are sentenced to execution.
