Ahmad Karimi’s family has expressed concern regarding their son’s condition. Mr. Karimi was recently transferred to the solitary confinement ward in Evin Prison.A member of Ahmad Karimi’s family has told HRANA that they were prevented from meeting with Karimi when they attempted to visit him on Monday. Their has been no word regarding his condition for the last three days. All phone services to Evin Prison have been cut. Since the Iranian New Year, Ahmad Karimi has met with his family only for a five minute non-contact meeting. Ahmad Karimi and several other prisoners were transferred to solitary confinement several days ago after protesting against the offensive treatment of prisoners.

Security forces tried to disperse families of the 16 political prisoners on hunger strike at Evin prison who had gathered outside the Prosecutor’s Office this morning, July 31st, 2010. According to RAHANA, the families of Hossein Nourani Nejad, Bahman Ahmadi Amoui, Ali Tajernia, Ali Parviz, Massoud Bastani and approximately 60 other individuals were amongst those present. Having been dispersed from in front of the Prosecutor’s Office by security forces, 30 family members of political prisoners continued their protest and gathered in front of the Office of the Minister of Justice.
After protesting against offensive behavior by prison guards and officials and complaining about restrictions regarding their visitation rights, 16 political prisoners at Evin’s ward 350 were transferred to solitary confinement, triggering a hunger strike.
Majid Dari, Majid Tavakoli, Adollah Momeni, Zia (Zieddin) Nabavi, Nader (Ebranim) Babai, Hamid Reza Mohammadi, Peyman Karimi Azad, Babak Bordbar, Jaafar Eghdami, Ali Parviz, Gholam Hossein Arshi, Hossein Nouraninejad and Koohyar Goudarzi, are all currently on hunger strike at Evin prison.
The inhumane conditions at Gohardasht prison in Karaj have critically deteriorated in light of the scorching summer heat in Iran. According to a letter from political prisoner Saeed Masouri, which recently leaked out of prison, he described the prison atmosphere as one “replete with fire, smoke, and burnt and tired faces; red faces with blemishes as a result of louse bites; dirty bare feet; clothes worn inside out due to louses crawling in them; dirty and polluted air coupled with the stench of abandoned garbage; leaking toilets; and dried up vomit from people experiencing food poisoning.”
Last year’s popular protests in Iran almost led to the downfall of the Iranian theocracy, a senior clerical regime official said on July 28.
According to the state-run Jahan News website, the head of the regime’s Guardian Council, Ahmad Jannati said in a speech on Wednesday that the post-June 2009 uprising aimed to overthrow the Iranian regime, which is based on the principle of velayat-e faqih or absolute clerical rule.
“In the 21 years that [Ali Khamenei] has been Supreme Leader, there have been much domestic and foreign sedition, the most ominous of which were the 2009 events.”
Clearly fearful of the overthrow of the theocracy, the Secretary of the Guardian Council, also said, “[They] were under the impression that the revolution is over and nothing will remain of the establishment, because this was a soft war and people would distance themselves from the regime. And, when the establishment loses the people’s backing, it would automatically collapse.”
Jannati added, “In addition to the vast sedition of 2009, in the course of the leadership of Ayatollah Khamenei, there were other examples which on a number of occasions even went close to toppling the establishment.”

Iranian regime officials have grown weary over an increasing number of graffiti in public places calling for people to rise up and launch strikes against the clerical dictatorship, according to reports from Iran.
In Tehran’s south and west subway stations, slogans like “death to dictator,” “death to Khamenei,” referring to the mullahs’ Supreme Leader, and “students, merchants, teachers, workers – strike, strike,” abound on walls and sides of buildings. Subway passengers and employees at the stations have also written the slogan “Khamenei, know that every day will be an uprising,” on the stations’ walls and nearby buildings.

Mohammad Mostafai, judicial lawyer whose wife and brother-in-law (Fereshteh Halimi and Farhad Halimi) have been under arrest since the beginning of last week, has written a letter to Tehran prosecutor.
Fereshteh and Farhad Halimi, wife and brother-in-law of Mohammad Mostafai, lawyer and children rights advocate, have been under arrest since the beginning of last week and have not contacted their family since.
The arrest of Mohammad Mostafai’s family took place after he was summoned to Evin prison last Saturday night and was questioned about his activities regarding adolescents condemned to death.
The next day they summoned him again by phone and arrested his wife and her brother before he had a chance to appear at Evin prison.
These arrests have been designed to put pressure on Mohammad Mostafai and has prompted him to write a letter to Tehran prosecutor:

Greetings,
Since Saturday, the interrogator for the 2nd branch of Shahid Moghadas, has unjustly captured my kind, innocent and tormented wife along with her brother. This is against the principal of ‘crimes and punishments have to be personal’. Taking my two loved ones hostage is abuse of his powers and based on his personal whim.

On Wednesday a legal summon came to my office which asked me to appear at the 2nd branch of the interrogators office for a few explanations. On that day I went to Evin prison at 9 am. A soldier named Mohammad-Khani took me inside. I waited for a long time and then I was called for interrogations. The interrogator read out a few pages of the complaints against me and asked questions regarding the help I was giving to adolescents condemned to execution. Although I was not prepared for those questions, I responded to him with whatever came to my mind and cleared all his questions.


After a few hours without any charges laid out against me, he called Soldier Mohammad-Khani and ordered my release. The solider helped me pass through many security obstacles at Evin prison and using someone’s phone outside the prison I called my wife and told her not to worry and that everything has been resolved.


After than since I did not have my mobile phone with me, I was not able to call my wife again. (The interrogator of the 2nd branch has announced that he has my phone and that I have escaped prison!). This is an absolute falsification. I never ran away. I have my mobile phone with me. You can review the tapes of closed circuit televisions at the prison. At 5 p.m. I went to my office and my secretary told me that my wife had called. I called her and she said that the 2nd branch of the interrogators office had called her summoning me again. Since it was after hours, I decided to go there the next day. The special agent at the interrogators office had asked one of my colleagues to not reveal anything about the summon and he had obliged. My colleague told me that a few plain clothes agents wanted to see me. I went outside a few times and I did not see any agents. I then attended a meeting and time passed.At 11 p.m. I called my wife but there was not answer. I got worried and called her father. He told me that they had come to his office to pick up my wife’s car. The car that my wife uses belongs to her father. Her father uses it all day to attend to some land for expert analysis. But since I had not taken my car, I let my father-in-law use it. (The expert at his work is willing to testify to this. He is a witness that my wife is completely innocent because he has witnessed that my wife was with her father all along). I called again a few minutes later and her father told me that his children have been arrested and transferred to Evin prison.

After hearing this news I was very upset and wanted to go to Evin prison but I could not stand so much lawlessness and violations of basic human rights. Despite the arrest of the person I love most in my life, I decided not to ever set foot in a judicial office where the interrogators do not abide by any basic laws: These include “crimes and punishments have to be personal”, formal charges, charges have to have legal basis: “hostage taking is never legal”, just prosecutions, principal of being neutral, and hundreds of other principals which are violated. I decided not to appear unless the against for the interrogator’s office try hard enough to come and arrest me in my silo that I have built for myself.

You know full well that issuing arrest warrants require certain preconditions. My case is excluded from those conditions because my occupation, place of living and my work are all public. Also in all cases of prosecution, first the accused is summoned and if he or she does not appear then arrest warrants are issued. Arrest warrants are never issued without summons. This was the case when I was first summoned and I did appear at Evin prison. If needed the interrogator could have issued another summon for more questioning or he could have summoned me by phone and I would have appeared again. Have done any research to find out under what law my arrest warrant has been issued? I am sure that the interrogator who works for you has not even bothered to read the judicial laws even once. This is why my wife and her brother have been illegally taken hostage. That’s unless we believe that there are people who consider themselves above the law and do whatever they wish.

The interrogator who works for you or other agents who share your power have not only acted against the law but they have not even employed any moral conscious at all. They have taken away a beautiful six year old girl away from her parents and have stranded her. Through the illegal and immoral action taken by security agents my Parmida has lost both parents. I do not believe any Moslem can take a child away from her mother in this way and then they announce that until Mohammad Mostafai does not show up we won’t release the two. Mr. prosecutor, what part of our judicial code does this belong to? and more importantly I ask the interrogators who have a hand in my wife and her brother’s arrest: if you are a Moslem please tell me where in the holy Sharia laws does it say that an innocent mother whose only concern in life has been the raising of her children can be taken away so cruelly. I swear to God that this is not part of Islam.Farhad Halimi, the borther of my wife had recently wedded and was trying to start a new life. He had studied hard for one year in order to participate in Thursday’s national university exams. But this illegal arrest wasted his whole year’s efforts causing him to miss the exam.
Mr. Prosecutor,For the past few years all my thoughts have been towards saving people who did not deserve to die. I was so occupied with saving these people that I hardly got to see my dear wife and daughter. On this path I have been able to save 18 adolescents who were condemned to death, sometimes by raising funds for their bail. This is a service to my country. I have also saved many older people. Many many times I asked the former head of judiciary for pardons on cases of stoning and my requests have been accepted. My bigger goal was to convince the judicial judges not to step beyond the boundaries of the law. I am willing to show you hundreds of judicial cases where the deputy district attorney, interrogators and the judge have abused their powers issuing unjust sentences, just like my case. And for someone who has always worked towards justice and the interests of the Islamic Republic, is this the way I am paid back for my God loving and human loving actions?
Mr. Dolat Abadi,As the highest ranking official at Tehran’s prosecutor office I am asking you to guide the interrogator to stop these actions and release my wife and brother from captivity and hostage taking. You should know that once the court and the prosecutor’s office puts forward a just case for my trial I will appear in court, even though I am completely innocent and I will accept and endure any verdict.At the end I need to remind you that in the past year I have been summoned by phone by information ministry agents and I have answered their questions. If were to be summoned again, I would have undoubtedly appeared again. But now that these actions have taken place, I am forced to endure the separation from my dear wife and child and my respectable family in an effort to establish rule of law in our country.I leave you and your interrogator are at the mercy of God, the creator. I hope that you won’t let my child cry for her mother, not eating food and wanting her mother back. She needs to hug her mother. If through this separation from her mother she gets hurt, it’s a sin that you have committed. If you believe in the judgment day free the two people who have not committed any sins. It’s unjust and against the our judicial laws to arrest them.

محمد مصطفایی وکیل برخی از پرونده‌های حقوق بشری از جمله پرونده سکینه محمدی است. وی هم چنین وکالت تعداد زیادی از نوجوانان محکوم به اعدام را بر عهده داشته است و تا کنون برای آزادی آن‌ها به همراه فعالان حقوق کودک، گام‌های موثری برداشته است.
روز شنبه، ۲ مرداد، پس از بازجویی چهار ساعته محمد مصطفایی در دادسرای اوین، ماموران امنیتی با حکم جلب به دفتر وی رفتند اما موفق به بازداشت او نشدند. همان شب، همسر محمد مصطفایی (فرشته حلیمی) به همراه برادرش (فرهاد حلیمی) در نزدیکی دفتر مصطفایی بازداشت شدند. دو روز بعد، وکیل این دو اعلام کرد که به خانواده موکلانش اعلام شده که برای آزادی آنها باید محمد مصطفایی تحویل شود.
شادی صدر، وکیل دادگستری و فعال حقوق زنان، در نامه‌ای خطاب به اعضای هیات مدیره کانون وکلا خواسته که در برابر این سیاست گروگان‌گیری سکوت نکنند.
متن این نامه که در اختیار رهانا قرار گرفته به ‌شرح زیر است:
ریاست محترم کانون وکلای ایران، اعضای محترم هیات مدیره
مطمئنا با خبر شده اید که در روز شنبه ۲ مرداد ۱۳۸۹، ماموران امنیتی چند ساعت پس از اینکه با مراجعه به دفتر محمد مصطفایی، یکی از فعال ترین وکلای حقوق بشری ایران، نتوانستند او را بیابند، همسر و برادر همسر وی را در مقابل دفتر او دستگیر کردند و به زندان اوین بردند. بازپرس دادسرای انقلاب در زندان اوین به آنها گفته است تا زمانی که محمد مصطفایی خود را معرفی نکند، آنها در زندان خواهند ماند.
در عین حال، همان شب از تلویزیون دولتی جمهوری اسلامی گزارشی پخش شد که در آن اعلام شد کسانی که باعث شدند پرونده سنگسار سکینه محمدی سر و صدای بین‌المللی ایجاد کنند، منافق و تروریست هستند. سکینه محمدی، مادر دو فرزند، زن ۴۳ ساله ارومیه‌ای است که اجرای حکم سنگسار درمورد او به دلیل فشارهای بین المللی وسیع، متوقف شد. محمد مصطفایی، وکیل سکینه، در انجام وظایف خود، وقتی کلیه راههای قضایی را پیمود و نتیجه‌ای نگرفت، اولین کسی بود که اعلام کرد جان سکینه محمدی در خطر است.
به این ترتیب به نظر می رسد دستگاه قضایی-امنیتی ایران، در حالی که ناگزیر به توقف اجرای حکم سنگسار سکینه محمدی شده است، با پرونده سازی رسانه ای و قضایی علیه محمد مصطفایی، قصد دارد انتقام این تصمیم ناگزیر را از او بگیرد و حالا که موفق به دستگیری او نشده، همسر و برادر او را موضوع این انتقام‌گیری قرار داده است. علاوه بر زیر سئوال بودن ادله منجر به صدور حکم بازداشت برای محمد مصطفایی، هیچ ادله‌ای موجود نیست که همسر و برادر همسر وی در مخفی کردن او کمکی کرده‌اند؛ برعکس، جزییات وقایع اتفاقیه روز شنبه کاملا موید خلاف این موضوع است.
این نخستین بار در تاریخ جمهوری اسلامی نیست که خانواده یک فعال مدنی، به دلیل فعالیتهای او گروگان گرفته می شوند. سیاست سرکوب فعالان مدنی از طریق فشار بر خانواده‌ها، با روشهای مختلفی از احضار و تهدید اعضای خانواده تا بازداشت و اعتراف گیری به زور از آنها، در تمام این سالها، با شدت و ضعف، اعمال می‌شده است. در یکی از تازه‌ترین موارد، همسر شیرین عبادی، عضو دیگر کانون وکلای دادگستری، فعال حقوق بشر و برنده جایزه صلح نوبل را پس از چند روز بازداشت، با تهدید و فشار در مقابل دوربین نشاندند تا علیه او صحبت کند.
اکنون ۵ روز است که فرشته حلیمی و فرهاد حلیمی، همسر و برادر همسر محمد مصطفایی، وکیلی که جز انجام وظایف وکالتی خود در دفاع از نوجوانان محکوم به اعدام، محکومان به سنگسار و همین‌طور زندانیان سیاسی، کاری نکرده است، در زندان به سر می‌برند. دختر ۷ ساله آنها هم اکنون هم از دیدن مادر خود محروم است و هم از دیدار پدر. من، محمد مصطفایی را از زمانی می‌شناسم که در برخی از پرونده‌های زنان محکوم به اعدام یا سنگسار، مثل پرونده نازنین فاتحی با یکدیگر همکاری می‌کردیم. او یکی از وکلای فعال در شبکه وکلای داوطلب بود که با «کمپین قانون بی سنگسار» مشارکت می‌کرد؛ این کمپین در مدت کمتر از دو سال توانست حداقل ۹ زن و ۲ مرد را از سنگسار نجات دهد و در حذف مجازات سنگسار از لایحه مجازات اسلامی تاثیرگذار باشد. در اسفند ۱۳۸۵، وقتی من به همراه ۳۲ نفر دیگر از فعالان حقوق زنان دستگیر شدم، محمد مصطفایی وکالت مرا برعهده گرفت. هیات مدیره کانون وکلا در آن زمان، نامه بسیار موثری در اعتراض به بازداشت من در حال انجام وظیفه وکالت به قوه قضاییه نوشت.
دفاع از حقوق وکلا، از ابتدایی ‌رین وظایف کانون وکلا و یکی از مهمترین دلایل ایجاد این قدیمی‌ترین نهاد مدنی حقوقی است. بنابراین به عنوان یک وکیل، یکی از اعضای کانون وکلای دادگستری مرکز، و همچنین به عنوان یک موکل، از شما که در راس یکی از قدیمی ترین نهادهای مدنی ایران نشسته اید درخواست دارم در مقابل این گروگانگیری و انتقام کشی، سکوت نکنید. هم اکنون، یکی از اعضای این نهاد، به دلیل پذیرش وکالت و دفاع از حقوق آسیب دیدگان، به همراه اعضای خانواده‌اش، تحت شدیدترین فشارها قرار دارند و سکوت شما، نه تنها به معنای عدم انجام وظیفه دفاع از وکلای مدافع است بلکه استقلال شما از دستگاه قضایی-امنیتی را نیز مورد تردید قرار خواهد داد. امروز زمان این است که هر یک از ما، تا جایی که در توان داریم، علیه سیاست گروگان‌گیری و انتقام‌جویی اقدام کنیم؛ سیاستی که اگر دیروز شیرین عبادی و امروز، محمد مصطفایی قربانیان آن بوده‌اند، فردای روز، گریبان تک تک ما را خواهد گرفت.

Appeals Court Finalizes Sentence: Execution Order for Jafar Kazemi Imminent

The execution verdict for Jafar Kazemi was upheld by branch 36 of the Appeals Court by judge Hojatoleslam Zargari. His file has now been processed to carry out the death sentence. There is no legal recourse to save Jafar Kazemi’s life.Kazemi’s lawyer Ms. Ghanavi told a human rights website that her client has spent long periods of time in solitary confinement.

Kazemi was originally sentenced by branch 28 of the Revolutionary Court.

Roudabeh Akbari, Kazemi’s wife, wrote a letter to the UN Secretary General Ban Ki-moon urging him to take steps to stop her husband’s execution.Kazemi was working as a lithograph for textbooks and pamphlets for Amirkabir University when he was arrested on September 18, 2009 at Haft-e Tir Square.

He was taken to solitary confinement in ward 209 of Evin prison and spent 74 days there before he was transferred to ward 350.


Kazemi was also imprisoned from 1981 until the end of 1989.Ghanavi has stated that her client was issued the charge of Moharebeh (waging war against God) for his alleged affiliation with the Mujahedin-e Khalq Organization.


Kazemi has not accepted the charge during his interrogations.It is believed that he did take part in post-election gatherings and chanted slogans but his lawyer says the charge of Moharebeh is baseless. Ghanavi explained that the appeal for Kazemi was never really considered by the court and the Moharebeh charge was never looked into.

According to reports, political prisoner Arjang Davoudi was banned from seeing his family in the last minute on his 16th day of hunger strike.
On Thursday July 29 his family came to Gohardasht Prison in Karaj on promises from prison officials stressing on their visit and they were led to the visiting hall. Political prisoner Arjang Davoudi was also brought to the visiting hall but in the last minute, he was denied the visit which is a method for putting psychological pressure on him and his family. Davoudi is in very poor physical health and is suffering from low blood pressure, headaches, dizzy spells, lack of vision and other side effects of hunger strike and has been taken to the prison infirmary on several occasions

بنابه گزارشات رسيده به "فعالين حقوق بشر و دمکراسي در ايران" زنداني سياسي ارژنگ داودي در شانزدهمين روز اعتصاب غذاي خود و در آخرين لحظات ملاقات با خانواده اش ممنوع الملاقات شد.
روز پنجشنبه 7 مرداد ماه خانواده آقاي داودي با وعده و تاکيد قبلي مسئولين زندان مبني بر ملاقات با عزيزاشان به زندان گوهردشت کرج مراجعه و آنها را به سالن ملاقات هدايت کردند.همچنين زنداني سياسي ارژنگ داودي به محل ملاقات آورده شد ولي در آخرين لحظات بدون هيچ دليلي براي وارد کردن فشار روحي عليه او و خانواده اش اعلام کردند که ممنوع الملاقات مي باشد و حق ملاقات را از آنها سلب کردند.
آقاي داودي در شرايط بسيار بد جسمي بسر مي برد و از عوارضي مانند، افت فشار خون،ضعف شديد ،سر درد،سرگيجه،کم شدن قدرت بينايي و ساير عوارض رنج مي برد و تا به حال چندين بار به بهداري زندان منتقل شده است. (فعالين حقوق بشر ودمكراسي در ايران – 7/5/89)

Iran sentenced the publisher of a banned reformist daily to 11 months in jail on charges of propaganda against the Islamic regime and inciting unrest, ISNA news agency reported on Wednesday.
Seda-ye Edalat (Voice of Justice) was shut down in July 2009, a few weeks after Iran's disputed presidential election, over 'insulting the founder of the Islamic republic,' late Ayatollah Ruhollah Khomeini, reports said at the time.
Tehran's penal court sentenced the publisher, Mostafa Kazzazi, 'to five months in jail for propaganda against the establishment and six months for defaming the Islamic republic and encouraging people to act against security,' ISNA said.The verdict came several months after a trial that opened in March. خبرگزارى ايسنا روز چهارشنبه گزارش كرد ايران ناشر يك روزنامه رفرميست ممنوع شده را به 11ماه زندان محكوم كرد. جرم وى تبليغات عليه نظام جمهورى اسلامى و دامن زدن به ناآراميها قيد شده است.

The death sentence for Jafar Kazemi was upheld by the court of review and his request for appeal was turned down by the 31st branch of the Supreme Court. This sentence was upheld by the 36th branch of the Tehran Appeals Court headed by Hojatol-Islam Zargar.
His lawyer, Ms. Ghanavi said in an interview with a human rights website that her client has spent many days in solitary but was not informed of any other pressure that might have been put on him or his family.
Kazemi, 36, is a lithographer of Amir Kabir University student textbooks and was arrested on September 18, 2009 in Haft Tir Square in Tehran. He was transferred to a solitary cell and was then taken to cellblock 350 in Evin Prison after 74 days. Kazemi was also jailed from 1981 to 1990.


His wife, Roudabeh Akbari had asked for help to stop her husband’s death sentence in a letter to the United Nations. Kazemi was initially tried in the 28th branch of the Revolutionary Court.



“Jafar Kazemi has been charged with enmity with God by supporting the Mojahedin
group although he has not accepted the charges in any of the interrogations”,
Nasim Ghanavi said.
“The charge of enmity with God is one of the crimes for
which lawmakers have to consider the canonical conditions for because it has
canonical roots; including armed measures because most Shiite clerics believe
that a mohareb is someone who uses arms (in resistance). Which is not the case
regarding my client. He only participated in post-election gatherings and he
might have chanted slogans but as a lawyer I believe that the issue of moharebeh
does not definitely relate to him”, she added.
“Unfortunately neither the
initial trial considered our defense nor the court of appeals and the Supreme
Court also ruled that he is a mohareb”, she said regarding the defense in court.
According to this lawyer, his sentence has been transferred to the Sentence
Implementation Department and from a legal standpoint, no legal measures will be
affective to save his life.

حکم اعدام جعفر کاظمي تائيد و به اجراي احکام ارسال شد

حکم اعدام جعفرکاظمي از سوي دادگاه تجديدنظر تاييد و درخواست اعاده دادرسي وي نيز توسط شعبه ۳۱ ديوان عالي رد شده است. اين حکم توسط دادگاه تجديد نظر شعبه ۳۶ استان تهران به رياست حجت الاسلام زرگر تاييد شده است.
خانم غنوي وکيل وي در گفتگو با يک وب سايت حامي حقوق بشر گفت که موکلش مدتها درزندان انفرادي بوده ولي از اينکه انواع ديگري فشار بر وي يا خانواده اش آمده باشد مطلع نيست.
جعفر کاظمي، ۴۶ ساله، ليتوگراف کتب درسي و جزوات دانشگاه امير کبير، روز ۲۷ شهريور در ميدان هفت تير دستگير و به سلول انفرادي بند ۲۰۹ منتقل و پس از ۷۴ روز به بند ۳۵۰ زندان اوين منتقل شد. جعفر کاظمي پيش از اين نيز از سال ۱۳۶۰ تا اواخر سال ۱۳۶۹ زنداني بوده است.
رودابه اکبري،همسر جعفر کاظمي، طي نامه‌اي از دبير کل سازمان ملل براي متوقف کردن حکم اعدام همسرش کمک خواسته است. وي ابتدا در شعبه ۲۸ دادگاه انقلاب محاکمه شده بود.
خانم غنوي پيرامون اتهام موکل اش گفت: «جعفر کاظمي، متهم به محاربه از طريق هواداري گروه مجاهدين است اگرچه هيچ يک از بازجوييها اتهامات وارده را نپذيرفته است.»
وي افزود: « اتهام محاربه از جمله جرائمي است که قانونگذار بايد شرايط فقهي را به سبب اين که ريشه فقهي دارد لحاظ کند؛ از جمله اين که اقدام مسلحانه هست که اکثر علماي شيعه معتقدند محارب به کسي مي گويند که دست به سلاح ببرد. در مورد موکل من اين طور نبوده، ايشان صرفا در اجتماعات بعد از انتخابات حضور داشته است و احتمال دارد شعارهايي هم داده باشد اما به عنوان وکيل معتقد هستم بحث محاربه در مورد ايشان اصلا مصداق پيدا نمي کند.»
نسيم غنوي در خصوص دفاعيات مطرح شده در دادگاه گفت: «متأسفانه نه دادگاه بدوي به دفاعيات ما توجه کرد نه تجديد نظر و ديوان هم همين طور و بحث محاربه را در مورد ايشان صادق دانستند.» به گفته وکيل اين پرونده، حکم جعفر کاظمي در اجراي احکام است و از نظر قانوني هيچ اقدامي براي نجات جان جعفر کاظمي در حال حاضر، ميسري نيست.» (هرانا – 7/5/89)

Dr. Saied Masouri, a political prisoner sentenced to life in prison is currently in Rajayi Shahr (Gohardasht) Prison in Karaj and has given a report on this prison.
The report, which has been sent for us, is as follows:









Though it is probable that life seemingly goes on outside of prison, in
Karaj no one can believe that a few meters away behind the walls of prison which
people pass by, there is a hell and human catastrophe in progress. Just as many
people were living around the Auschwitz and Dachau death camps and they might
not have know what went on inside these camps.
I want to paint you a picture
of the Rajayi Shahr Prison which seems very big for the residents of Karaj but
is actually very small because of the mass crowds held inside. It seems as if it
is a different world here. Something like hell in fictional movies filled with
fire and smoke and blackened and unkempt faces, naked and sweaty bodies which
have become red with lice bites, pants with one leg ripped off used as a
makeshift belt, dirty bare feet, clothes that have been worn inside out because
of lice, ripped rubber slippers, dirty and polluted air, the smell of rotten
trash, the sewage coming from clogged toilets, dried vomit from food poisoning,
mucus from infected throats which can be seen everywhere in prison, the smell of
sweaty bodies which rarely have the privilege of taking a shower in this closed,
hot and polluted space… All of this is completed with the smell of urine of
those who cannot control themselves reaches. And the aggravating shouts and
yells of prisoners waiting in long lines with blackened plastic bottles used as
tea cups; prisoners waiting in long compressed lines for a turn in the bathroom,
shower or …
Tired worn out faces, as a result of malnutrition, hidden under
long beards and disheveled hair, irritant coughs from lung problems as a result
of the closed atmosphere, unusual bodies which reminds a person of starving
African children, scores of prisoners lying in the middle of the halls who have
either fallen into a death like sleep or have been heat stricken and are staring
with glassy eyes at the walls or ceiling. Or others, leaning naked on the walls,
searching for the lice in their clothes.
Several other prisoners stand alone or in groups of two staring at others because they are unable to move around in the density of the prison or those who play with the stiches on their writs or throats which they have received as a result of suicide attempts. They usually have a piece of cloth or towel with them to wipe off the sweat from their face every few minutes which they sometimes use as a mask to fend off the pungent stench or at least make it a little more tolerable. All of this along with the deafening sounds of the loudspeakers and vulgar cursing which invite prisoners to follow their turns for the shower and toilets. All of this can be understood when you realize that in a place that has the capacity of 90 people, 1,100 people are detained. There is one shower for 250 people, 500 people have one soap, 170 people have one toilet (which is usually clogged up and filthy), five people have one cubic cm of space (that is why prisoners sleep in the hallways and staircases), 5 or 6 people share one blanket and are forced to stay out in the sun in the prison yard from 7am to 7pm because they do not fit in the cells or indoors. There is rarely any room to stand in the prison yard and when food is thrown in a piece of newspaper for many prisoners, they can find no other place than the prison yard to sit down and eat. This situation has even annoyed the prison guards because they cannot conduct a headcount and are also in danger of catching all kinds of diseases…
What is more amazing is that the TV (state-run TV inside prison) talks about human dignity, the stature of human beings and even global management from dawn to dusk but does not talk about these hardships in prison because talking about hygiene, showers and toilets is intertwined with national security and bringing it up is a crime in the lines of acting against national security and publishing lies and if someone like 22 year old political prisoner Reza Jushan who was arrested after the elections protests this condition, he is immediately thrown in solitary. Of course I expect nothing less, but the state of Rajayi Shahr Prison (and of course other prisons) is so
appalling that solitary is no solution (for dissent) and therefore Guantanamo
Bay and Abu Ghuraib are like inaccessible dreams fro prisoners and the hope of
execution is a far easier, prevalent and more accessible solution for escape
from this condition.

گزارشي از زندان رجائي شهر/ به هر آنکس که گوش شنوايي دارد...
دکتر سعيد ماسوري زنداني سياسي محکوم به حبس ابد که هم اکنون در زندان رجايي شهر کرج بسر مي برد گزارشي از زندان رجايي شهر تهيه تموده است .
متن اين گزارش که در اختيار خبرگزاري هرانا قرار گرفته است به شرح زير است:
اگر چه ممکن است در خارج از زندان زندگي‌ به ظاهر در جريان باشد ولي‌ قطعاً در همين کرج کسي‌ نمي‌تواند باور کند که چند متر آنطرفتر يعني‌ پشت ديوار زنداني که از کنار آن عبور مي‌کند چه جهنّم و فاجعه انساني‌ در حال وقوع است،همانطور که خيلي‌ها در اطراف اردوگاههاي داخو و آشويتس هم در حال زندگي‌ بودند و شايد به درستي‌ نمي‌‌دانستند درداخل آن چه مي‌گذرد.
ميخواهم تنها در يک پلان شمايي از زندان رجائي شهر که نزد اهالي کرج بسيار بزرگ مينمايد ولي‌ در واقع به دليل ازدحام جمعيت بسيار کوچک است را به تصوير بکشم . اينجا گويي که دنيايي ديگر است ،چيزي شبيه جهنّم در فيلمهاي تخيلي‌،آکنده از آتش و دود و چهرههاي سياه سوخته و ژوليده ، بدنهأي لخت و عرق کرده و سراسر قرمز و آبله اي‌ بر اثر زخم نيش شپش ، شلوار هايي با لنگ پاره شده آن که به عنوان کمربند استفاده شده ، پاهاي برهنه و کثيف لباسهاي پشت و رو پوشيده شده به خاطر شپش، دمپايي هاي پاره و لنگه به لنگه، هواي کثيف و آلوده، بوي زباله‌هاي متعفن شده، گنداب توالت هاي سر ريز شده، استفراغ‌هاي خشک ناشي‌ از مسموميت‌ها ،خلتهاي سينه عفوني‌ شده که همهٔ محوطه را فراگرفته،بوي عرق بدن هايي که در اين فضاي بسته و گرم و آلوده به ندرت امکان حمام کردن مي‌‌يابند...همه و همه با بوي زخم ادرار افرادي که نميتوانند خود را کنترل کنند به اوج مي‌‌رسد و اين همه با فرياد و همهمهٔ سرسام آور زندانياني که با بطري‌هاي پلاستيکي سياه شده به عنوان ليوان چاي در صفهاي انبوه،دو صف ايستاده و يا پشت سر هم در صفهاي چند رديفه و فشرده در نوبت توالت و حمام و غيره صف کشيده‌اند ، رخ ميدهد .
چهره‌هاي تکيده شده ناشي‌ از سو تغذيه ولي‌ پنهان در پشت انبوه ريش و موهاي ژوليده ، سرفه‌هاي دلخراش ناشي‌ از مشکلات ريوي به خاطر فضاي بسته آلوده، بدنهاي غير متعارف که کودکان قحطي زده آفريقا را تداعي مي‌‌کند ، انبوه زندانيان ولو شده در وسط راهروها که يا به خوابي‌ مرگ مانند فرو رفته اند و يا به شکل گرما زده شده وا رفته و با چشماني بي‌ روح به نقطه ايي از ديوار و سقف خيره مانده و يا چمباتمه به ديوار تکيه داده، لخت شده، شپشها را در درز لباس‌هايشان مي‌‌جويند که در حين عبور انبوه نفرات به آنها ميخورند ، تقريبا عادت کرده اند.
انبوهي ديگر که تنها به خاطر اينکه امکان قدم زدن در اين ازدحام را نمي‌‌يابند تنها و يا دو نفره ايستاده ديگران را تماشا ميکنند و يا با بخيه‌هاي روي مچ و يا گردنشان که ناشي‌ از خود زني‌ است بازي ميکنند و عموما هم تکه پارچه يا حوله اي‌ در دست دارند که هم براي خشک کردن عرق سر و صورت هر چند دقيقه به سرو صورت مي‌‌کشند و هم به عنوان ماسکي جلوي دماغ و دهنشان مي‌‌گيرند تا بوي گند و آلودگي هوا را به ميزاني‌ کنترل و تحمل کنند و با همه اينها در هياهوي کر کننده بلندگو و يا فريادها يي‌ با فحش‌هاي رکيک ديگران را به سکوت و رعايت نوبت توالت و حمام و غيره دعوت مي‌کند همراه است واين همه را وقتي‌ ميتوانيم بفهميم که بدانيم در جائي‌ که حد اکثر ۹۰ نفر گنجايش استاندارد آن است ، ۱۱۰۰ نفر محبوس است، براي هر ۲۵۰ نفر ۱ حمام ، هر ۵۰۰ نفر يک شير صابون يا مايع دستشويي هر ۱۷۰ نفر يک توالت ( آن هم اغلب پر و سر ريز کرده است) هر ۵ نفر يک متر مربع جا(به همين خاطر از فضاي راهرو و راه پله‌ها هم استفاده ميشود) و هر ۵ يا ۶ نفر روي ۱ پتو مي‌خوابند و مجبورند از ۷ صبح تا ۷ شب هم بيرون از سلولها و در محوطه هواخوري و جلوي آفتاب باشند چون در سلولها و زير سقف مطلقاً جا نمي‌‌شوند، حتي در محوطه هواخوري هم به ندرت جائي‌ براي ايستادن گير مي‌‌آيد و وقتي‌ غذا براي خيلي‌ها تنها روي تکه ايي روزنامه ريخته ميشود به جز داخل هواخوري جائي‌ براي نشستن و خوردن آن نمي‌‌يابند و اين اوضاع حتي زندانبانان را هم به سطوح آورده چون حتي امکان شمارش و آمارگيري را هم در اين ازدحام جمعيت نمي‌‌يابند و خود نيز در معرض انواع بيماريهايند...
و عجب اينکه تلويزيون از بوق سگ‌ تا پاسي از شب از کرامت انساني‌، جايگاه انسان و حتي مديريت جهاني‌ صحبت مي‌کند ولي‌ از اين اوضاع سخني به ميان نمي ايد چرا که صحبت از بهداشت و حمام و توالت با امنيت ملي‌ گره خورده و طرح آن جرمي‌ در رديف اقدام عليه امنيت و نشر اکاذيب است و اگر کسي‌ هم مثل رضا جوشن جوان ۲۲ ساله ايي که در وقايع انتخابات دستگير شد به اين وضع اعتراض و آنرا بيان کند بلافاصله به سلول انفرادي منتقل مي‌‌شود، البته من هم انتظاري غير از اين ندارم ولي‌ اوضاع رجائي شهر ( و البته بقيه زندانها) بسيار اسفناکتر از آن است که سلول انفرادي راه حل آن باشد و بيخود نيست که براي زندانيان در ايران گوانتانامو و ابو غريب رويايي است دست نيافتني و اميد اعدام شدن راه خلاصي سهل الوصول تر و بسيار متداول تر است و دست يافتني تر...

According to reports, families of political prisoner especially families of death row political prisoners have expressed serious concerns for the sudden cut off of all communications with their loved ones in cellblock 350 in Evin Prison. All calls of political prisoners with their families have been cut off on orders of Ministry of Intelligence interrogators. This issue has led to concerns among families of political prisoners. Currently there are a number of death row political prisoners in cellblock 350 in Evin Prison. They are Jafar Kazemi, Mohammad-Ali Haj Aqayi, Mohsen Daneshpour Moqadam, Ahmad Daneshpour Moqadam among others



قطع ناگهاني ارتباط زندانيان سياسي بخصوص محکومين به اعدام باعث نگراني شديد خانواده ها شده است
بنابه گزارش رسيده به "فعالين حقوق بشر و دمکراسي در ايران" ابراز نگراني شديد خانواده هاي زندانيان سياسي محکوم به اعدام و ساير خانواده ها نسبت به قطع ناگهاني و غير معمول تماسهاي زندانيان سياسي بند 350 زندان اوين هستند.
به دستور بازجويان وزارت اطلاعات تماسهاي زندانيان سياسي با خانواده هاي آنها بطور ناگهاني و غير معمول قطع گرديد.اين مسئله باعث نگراني شديد خانواده ها زندانيان سياسي و بخصوص خانواده هاي که عزيزان آنها محکوم به اعدام هستند ايجاد کرده است... در حال حاضر تعدادي از زندانيان سياسي محکوم به اعدام در بند 350 زندان اوين زنداني هستند که اسامي تعدادي از آنها به قرار زير مي باشد ؛ جعفر کاظمي ،محمد علي حاج آقايي،محسن دانشپور مقدم ،احمد دانشپور مقدم و ... مي باشند. Committee to Fight for Freedom of Political Prisoners

There are concerns for the condition of blogger, children’s rights activist and member of a labor rights group.
According to reports, there is no news on the condition of Behman Ibrahim Zadeh. On July 23 his family went to Evin Prison to visit their son but regime forces refrained from giving them information on his whereabouts.
Ibrahim Zadeh was arrested on June 12 and was severely beaten upon his arrest. His leg and rib cage broke as a result. Security forces initially told Behnam’s family that he had been taken to cellblock 7 in Evin Prison but his family was banned from visiting him. Behnam complained of pain in his rib cage and said that he was in poor health in a short call to his family. He has been kept in an undetermined state since his arrest

بنابر گزارش رسيده از وضعيت بهنام ابراهيم زاده وبلاگ نويس وفعال حقوق کودک و جمعيت دفاع ازحقوق کار خبرى در دست نيست۔ در تاريخ ١ مرداد خانواده بهنام به زندان اوين مراجعه كردند اما مزوران رژيم از دادن اطلاعات به آنها در مورد محل نگهدارى بهنام خوددارى كرده اند۔
بهنام ابراهيم زاده در تاريخ ٢٢ خرداد دستگيرشده و بشدت مورد ضرب وشتم قرار گرفت. در اثر اين ضرب و شتم وى از ناحيه پا و قفسه سينه دچار شكستگى استخوان شد. در ابتدا به خانواده بهنام گفته بودند كه وى دربند هفت زندان اوين بسر ميبرد اما به خانواده اش اجازه ملاقات داده نشده بود. بهنام در تماس كوتاه تلفنى كه با خانواده اش در ابتداى دستگيريش داشت از درد قفسه سينه و وضعيت نامناسب جسمى اش گفته است. بهنام از زمان دستگيريش تا حال در بلاتكليفى و در وضعيت نامعلومى بسر ميبرد.

We ask anyone who cares about Human Rights, to read the heart breaking letter written by Saeed Masouri, describing the harrowing conditions at Rajai Shar Prison.We ask that you read his account and inform the world of the Human Rights violations and atrocities taking place behind the prison walls in Iran’s notorious prisons; for remaining silent is turning our back on humanity, common decency and the dignity for life.


Dr. Saeed Masouri, a prisoner in ward 10, cell 4 of Rajai Shahr “Gohardasht” prison located in Karaj, was arrested December 2000 in Dezful (southwestern Iran). He was sentenced to death by the Preliminary and Appeals courts for association with the PMOI. His sentence was eventually changed to life in prison. He was transferred to Rajai Shahr several years ago. In ten years of detention to date, Masouri spent a total of three years in solitary confinement in Dezful and Tehran. He is detained under hard conditions and has experienced horrible psychological and physical tortures.


HRDAI has obtained a letter written by Saeed Masouri from inside prison:


Although life may go on naturally outside prison, people, even the ones who live in Karaj, would not believe what infernal and humanitarian tragedies take place a few meters away behind the walls of the prison they pass by; almost similar to the situation of the people who lived near Auchwitz and Dachau [concentration camps] and did not realize what was taking place inside.

I would like to paint for you a picture of Rajai Shahr prison. The vicinity may seem large to the citizens of Karaj, but in reality it is very small due to over crowdedness. The prison seems like it is part of a different world. It resembles an inferno described in fiction movies. It is filled with fire, smoke, withered and burned faces, and naked and sweaty bodies marked with red bumps from lice bites. Pieces of torn pants are used as belts. Prisoners have bare and dirty feet. Their clothes are worn inside out as a result of lice infection. In this enclosed and hot place, the air is polluted and filthy as a result of rotted garbage, flooded toilets, dried up vomit from food poisoning incidents, the lingering of mucus from infected chests, and the odour of bodies that rarely get cleaned. This place is overpowered by the smell of urine caused by prisoners who are no longer able to control themselves. Screams of agony from prisoners in line to use the washroom or shower pierce through this place.

Malnourished faces hide behind heavy beards and disheveled hair. Irritating coughs are the result of pulmonary problems caused by an enclosed polluted space. The disproportioned bodies of prisoners bring to mind images of starved children in Africa. There are masses of prisoners who lie in the middle of hallways either because they have fallen into a death-like sleep or they are half conscious from heat-stroke and do nothing but stare at the wall with eyes that lack spirit and shine. Then there are the prisoners who squat and lean against the wall and take off their clothes to inspect for lice. People pass by and bump into them like they are not even there.

There is also a large group of prisoners who are unable to walk in this overcrowded place. They stand alone or in groups of two and either watch others or play with wounds caused by self-inflicted injuries on their wrists and necks. They have towels to dry up the sweat on their face and masks to cover their nose and mouth so the pollution and stink could be tolerated. Vulgar and deafening insults are shouted from the loudspeakers that ask prisoners to be silent and to respect the lineups formed for accessing the washroom and showers.

Rajai Shar prison has a maximum capacity of 90 prisoners, but it currently holds 1,100 detainees. There is only one shower for every 250 prisoners, one soap dispenser for every 500, and one bathroom for every 170 (the toilets are often clogged and overflooded). Every five people have one square meter of space (that is why the hallways and stairs are used), and every five or six people share one blanket to sleep. Prisoners are forced to be outside in the scorching heat every day from 7:00am to 7:00pm, because there is absolutely no space. Even in the yard, there is rarely any spot to stand. When food is served to many on a piece of newspaper, then it is no wonder that there is no room to sit and eat. The conditions have even frustrated prison guards because they are no longer available to keep count of all the prisoners and they are also exposed to the diseases.

It is strange that the Iranian state TV constantly talks of human dignity, a human being’s place in the world, and global management, but does not talk about the conditions inside Rajai Shahr prison. Discussing the hygiene in the prison is linked to national security, so not talking truthfully about prison conditions is equivalent to acting against national security and spreading lies.

When 22 year old Reza Joushan, who was arrested in post-election protests, stood against prison conditions, he was immediately transferred to solitary confinement. I do not expect a better reaction. The situation in Rajai Shar (and of course other prisons) is too tragic to be solved through solitary confinement. There is a reason why it is like an inferno for prisoners inside Iran’s Guantanamo Bay and Abu Ghuraib. Prisoners hope for death by execution because it is an easier and more attainable way to rid the pain.






گزارشی از زندان رجائی شهر به هر آنکس که گوش شنوایی دارد(زندانی سیاسی سعید ماسوری)


اگر چه ممکن است در خارج از زندان زندگی‌ به ظاهر در جریان باشد ولی‌ قطعاً در همین کرج کسی‌ نمی‌تواند باور کند که چند متر آنطرفتر یعنی‌ پشت دیوار زندانی که از کنار آن عبور می‌کند چه جهنّم و فاجعه انسانی‌ در حال وقوع است،همانطور که خیلی‌ها در اطراف اردوگاههای داخو و آشویتس هم در حال زندگی‌ بودند و شاید به درستی‌ نمی‌‌دانستند درداخل آن چه می‌گذرد.

میخواهم تنها در یک پلانشمایی از زندان رجائی شهر که نزد اهالی کرج بسیار بزرگ مینماید ولی‌ در واقع به دلیل ازدحام جمعیت بسیار کوچک است را به تصویر بکشم . اینجا گویی که دنیایی دیگر است ،چیزی شبیه جهنّم در فیلمهای تخیلی‌،آکنده ازآتش و دود و چهرههای سیاه سوخته و ژولیده ، بدنهأی لخت و عرق کرده و سراسر قرمز و آبله ای‌ بر اثر زخم نیش شپش ، شلوار هایی با لنگ پاره شده آن که به عنوان کمربند استفاده شده ، پاهای برهنه و کثیف لباسهای پشت و رو پوشیده شده به خاطر شپش،دمپایی های پاره و لنگه به لنگه، هوای کثیف و آلوده، بوی زباله‌های متعفن شده، گندا ب توالت های سر ریز شده، استفراغ‌های خشک ناشی‌ از مسمومیت‌ها ،خلتهای سینه عفونی‌ شده که همهٔ محوطه را فراگرفته،بوی عرق بدن هایی که در این فضای بسته و گرم و آلوده به ندرت امکان حمام کردن می‌‌یابند...همه و همه با بوی زخم ادرار افرادی که نمیتوانند خود را کنترل کنند به اوج می‌‌رسد و این همه با فریاد و همهمهٔ سرسام آور زندانیانی که با بطری‌های پلاستیکی سیاه شده به عنوان لیوان چای در صفهای انبوه،دوصف ایستاده و یا پشت سر هم درصفهای چند ردیفه و فشرده در نوبت توالت و حمام و غیره صف کشیده‌اند ، رخ میدهد .

چهره‌های تکیده شده ناشی‌ از سو تغذیه ولی‌ پنهان در پشت انبوه ریش و موهای ژولیده ، سرفه‌های دلخراش ناشی‌ از مشکلات ریوی به خاطر فضای بسته آلوده، بدنهای غیر متعارف که کودکان قحطی زده آفریقا را تداعی می‌‌کند ، انبوه زندانیان ولو شده در وسط راهروها که یا به خوابی‌ مرگ مانند فرو رفته اند و یا به شکل گرما زده شده وارفته و با چشمانی بی‌ روح به نقطه ایی از دیوار و سقف خیره مانده و یا چمباتمه به دیوار تکیه داده، لخت شده، شپشها را در درز لباس‌هایشان می‌‌جویند که در حین عبور انبوه نفرات به آنها میخورند ، تقریبا عادت کرده اند.

انبوهی دیگر که تنها به خاطر اینکه امکان قدم زدن در این ازدحام را نمی‌‌یابند تنها و یا دو نفره ایستاده دیگران را تماشا میکنند و یا با بخیه‌های روی مچ و یا گردنشان که ناشی‌ از خود زنی‌ است بازی میکنند و عموما هم تکه پارچه یا حوله ای‌در دست دارند که هم برای خشک کردن عرق سرو صورت هر چند دقیقه به سرو صورت می‌‌کشند و هم به عنوان ماسکی جلوی دماغ و دهنشان می‌‌گیرند تا بوی گند و آلودگی هوا را به میزانی‌کنترل و تحمل کنند و باهمه اینها در هیاهوی کرکننده بلندگو و یا فریادها یی‌با فحش‌های رکیک دیگران را به سکوت و رعایت نوبت توالت و حمام و غیره دعوت می‌کند همراه است واین همه را وقتی‌ میتوانیم بفهمیم که بدانیم در جائی‌ که حد اکثر ۹۰ نفر گنجایش استاندارد آن است ، ۱۱۰۰ نفر محبوس است، برای هر ۲۵۰ نفر ۱ حمام ، هر ۵۰۰ نفر یک شیر صابون یا مایع دستشویی هر ۱۷۰ نفر یک توالت ( آن هم اغلب پر و سر ریز کرده است) هر ۵ نفر یک متر مربع جا(به همین خاطر از فضای راهرو و راه پله‌ها هم استفاده میشود) و هر ۵ یا ۶ نفر روی ۱ پتو می‌خوابند و مجبورند از ۷ صبح تا ۷ شب هم بیرون از سلولها و در محوطه هواخوری و جلوی آفتاب باشند چون در سلولها و زیر سقف مطلقاً جا نمی‌‌شوند، حتی در محوطه هواخوری هم به ندرت جائی‌ برای ایستادن گیر می‌‌آید و وقتی‌ غذا برای خیلی‌ها تنها روی تکه ایی روزنامه ریخته میشود به جز داخل هواخوری جائی‌ برای نشستن و خوردن آن نمی‌‌یابند و این اوضاع حتی زندانبانان را هم به سطوح آورده چون حتی امکان شمارش و آمارگیری را هم در این ازدحام جمعیت نمی‌‌یابند و خود نیز درمعرض انواع بیماری هایند...

و عجب اینکه تلویزیون از بوق سگ‌ تا پاسی از شب از کرامت انسانی‌، جایگاه انسان و حتی مدیریت جهانی‌ صحبت می‌کند ولی‌ از این اوضاع سخنی به میان نمی اید چرا که صحبت از بهداشت و حمام و توالت با امنیت ملی‌ گره خورده و طرح آن جرمی‌ در ردیف اقدام علیه امنیت و نشر اکاذیب است و اگر کسی‌ هم مثل رضا جوشن جوان ۲۲ ساله ایی که در وقایع انتخابات دستگیر شد به این وضع اعتراض و آنرا بیان کند بلافاصله به سلول انفرادی منتقل می‌‌شود، البته من هم انتظاری غیر از این ندارم ولی‌ اوضاع رجائی شهر ( و البته بقیه زندانها) بسیار اسفناکتر از آن است که سلول انفرادی راه حل آن باشد و بیخود نیست که برای زندانیان در ایران گوانتانامو و ابوغریب رویایی است دست نیافتنی و امید اعدام شدن راه خلاصی سهل الوصول ترو بسیار متداول تر است و دست یافتنی تر ....

Death Sentence Confirmed, for Political prisoner Jafar Kazemi, arrested in the last years uprising in Iran:



An appeals court has upheld the death sentence handed down to Jafar Kazemi. His sentence was confirmed by the 36th Branch of the court of appeals presided over by Hojatoleslam Zargari.
His lawyer Ms. Ghanavi told a human rights website that her client has spent long periods of time in solitary confinement.
Jafar Kazemi, a lithograph for textbooks and pamphlets for Amir Kabir University was arrested on September 18, 2009 in Haft e Tir Square and transferred to the solitary ward in section 209 for seventy four days before being transferred to ward 350 of Evin Prison. Prior to this he had been imprisoned between1981 and 1989.
Jafar Kazemi’s wife Rudabeh Akbari has written to the secretary general of the United Nations asking that he takes steps to stop her husband’s execution. He was originally sentenced by the 28th branch of the revolutionary court.
Ms. Ghanavi has stated that her client has been convicted of being a “mohareb” or one “waging war against God” for his alleged affiliations the Mujahedin e Khalq organization. Mr. Kazemi has not accepted this charge during his interrogations.
According to Mr. Kazem’s lawyer, Shi’ite scholars state that the charge of “mohareb” is levied against those who have rose up in armed revolt against the government. Ms. Ghanavi explains that this is not the case with her client. It is believed that he did take part in post election gatherings and chanted slogans but his lawyer says the charge of “mohareb” is not true.
Nasim Ghanavi has stated that their appeal was never truly considered and that the charge of “moharab” was never in question by the court. His file has now been sent to have his sentenced carried out and there is no legal recourse to save Jafar Kazemi’s life.





حکم اعدام جعفرکاظمی از سوی دادگاه تجدیدنظر تایید و درخواست اعاده دارسی وی نیز توسط شعبه ۳۱ دیوان عالی رد شده است. این حکم توسط دادگاه تجدید نظر شعبه ۳۶ استان تهران به ریاست حجت الاسلام زرگر تایید شده است.
خانم غنوی وکیل وی در گفتگو با یک وب سایت حامی حقوق بشر گفت که موکلش مدتها درزندان انفرادی بوده ولی از اینکه انواع دیگری فشار بر وی یا خانواده اش آمده باشد مطلع نیست.
جعفر کاظمی، ۴۶ ساله، لیتوگراف کتب درسی و جزوات دانشگاه امیر کبیر، روز ۲۷ شهریور در میدان هفت تیر دستگیر و به سلول انفرادی بند ۲۰۹ منتقل و پس از ۷۴ روز به بند ۳۵۰ زندان اوین منتقل شد. جعفر کاظمی پیش از این نیز از سال ۱۳۶۰ تا اواخر سال ۱۳۶۹ زندانی بوده است.

رودابه اکبری،همسر جعفر کاظمی، طی نامه‌ای از دبیر کل سازمان ملل برای متوقف کردن حکم اعدام همسرش کمک خواسته است. وی ابتدا در شعبه ۲۸ دادگاه انقلاب محاکمه شده بود.
خانم غنوی پیرامون اتهام موکل اش گفت: «جعفر کاظمی، متهم به محاربه از طریق هواداری گروه مجاهدین است اگرچه هیچ یک از بازجویی¬ها اتهامات وارده را نپذیرفته است.»
وی افزود: « اتهام محاربه از جمله جرائمی است که قانونگذار باید شرایط فقهی را به سبب این که ریشه فقهی دارد لحاظ کند؛ از جمله این که اقدام مسلحانه هست که اکثر علمای شیعه معتقدند محارب به کسی می گویند که دست به سلاح ببرد. در مورد موکل من این طور نبوده، ایشان صرفا در اجتماعات بعد از انتخابات حضور داشته است و احتمال دارد شعارهایی هم داده باشد اما به عنوان وکیل معتقد هستم بحث محاربه در مورد ایشان اصلا مصداق پیدا نمی کند.»
نسیم غنوی در خصوص دفاعیات مطرح شده در دادگاه گفت: «متأسفانه نه دادگاه بدوی به دفاعیات ما توجه کرد نه تجدید نظر و دیوان هم همین طور و بحث محاربه را در مورد ایشان صادق دانستند.» به گفته وکیل این پرونده، حکم جعفر کاظمی در اجرای احکام است و از نظر قانونی هیچ اقدامی برای نجات جان جعفر کاظمی در حال حاضر، میسری نیست.»

Sixteen political prisoners have gone on hunger strike after they were transferred from ward 350 to solitary cells of ward 240 in Evin prison.

RAHANA- Bahman Ahmadi-Amouei and Keyvan Samimi were the first prisoners transferred to solitary cells on Monday July 26 after their objection to the inappropriate behavior of ward 350 officials and its chief Mostafa Bozorgnia. Other political prisoners were transferred from their cells in ward 350 to solitary confinement in ward 240 at 3:00 am on Tuesday July 27.
On Monday July 26, during the weekly prison visits of ward 350 inmates, the political prisoners of this ward and their families were faced with the offensive behavior of officers and ward officials. Therefore, prisoners protested the incident on the same day and even chanted slogans inside Evin visiting hall, after which prison officials send more officers to control the situation and return prisoners to their cells.
According to Kaleme portal, in response to prisoners’ protests and instead of investigating their objections, the officials of ward 350 cut off all telephone lines of this ward and transferred a number of political prisoners including Abdollah Momeni, Bahman Ahmadi-Amouei and Ahmad Karimi to solitary cells.
The names of these prisoners transferred to solitary cells are:
Ali Malihi (student activist and member of Tahkim-e Vahdar student organization), Bahman Ahmadi-Amouei (journalist), Hossein Nouraninejad (journalist and member of Islamic Iran Participation Front), Abdollah Momeni (student activist and spokesman of Advare Tahkim, reformist Iran Alumni Organization), Ali Parviz (student activist), Hamid Reza Mohammadi (political activist), Jafar Eghdami (civil activist), Babak Bordbar (photojournalist), Zia (Zieddin) Nabavi (student activist deprived of continuing his studies), Ebrahim (Nader) Babaei (civil activist and an Iran-Iraq injured war veteran), Koohyar Goudarzi (human rights activist and blogger), Majid Dorri (student activist), Majid Tavakoli (student activist), Keyvan Samimi (journalist), Gholam-Hossein Arshi and Peyman Karimi-Azad (arrested during Ashura incidents on 27 December 2009).
Among these prisoners, Bahman Ahmadi-Amouei has been on hunger strike since Tuesday July 27, while Majid Tavakoli, Abdollah Momeni, Koohyar Goudarzi and two other prisoners started their hunger strike on Wednesday. Other prisoners went on hunger strike today (Thursday) to support their friends’ strike, and said they would not break it until they reach their goals. Prisoners demand that ward officers and officials apologize to prisoners for their inappropriate behavior and return these 16 individuals to the public ward.

On July 17, 2010, Mahboubeh Karami, women’s rights activist and member of the One Million Signatures Campaign, was transferred from Evin prison to Taleghani hospital to undergo a scheduled septoplasty surgery. According to RAHANA, Karami cancelled the surgery to demonstrate against restrictions imposed on her by prison officials.

In a recent conversation with her lawyer and family, Mahboubeh Karami stated that she preferred to stay in prison since the problems inside Evin extend beyond surgery and treatment.

After persistent efforts by her family and lawyers to follow up on her condition, Mahboubeh Karami was summoned for an examination by the medical forensics office. According to the International Support for Women’s Campaign, a letter from the forensics office was sent to the clinic in Evin prison that indicates Karami suffers from depression. The International Campaign for Human Rights in Iran reports that she also experiences respiratory problems.

According to RAHANA, Karami told Evin clinic physicians she screams in her sleep and disturbs her cell mates. A physician diagnosed her with having a deviated septum and suggested she undergoes septoplasty surgery.

Rules enforced at Evin prison state that her temporary detention warrant cannot be changed into a release-on-bail verdict, even if it is for surgery or to treat depression. The rules state that Karami must be medically tended to under prison supervision.

Karami was arrested by security agents on March 2, 2010 at her father’s home. Her brother states that Mahboubeh and her lawyers appeared before the court on June 28, 2010, but judge Pir-Abbasi and the Prosecutor’s representative were not there, so her trial was postponed to August 9, 2010.






خودداری محبوبه کرمی از عمل جراحی تحت شرایط بازداشت

روز گذشته، محبوبه کرمی برای عمل جراحی برای رفع انحراف بینی از سوی زندان اوین به بیمارستان طالقانی منتقل ‏شد، اما به دلیل شرایط زندان از این عمل خودداری کرد. ‏

در پی پیگیری های به عمل آمده از سوی خانواده و وکیل محبوبه کرمی ، پزشکی قانونی محبوبه کرمی را برای معاینه احضار کرد.
به گزارش تغییر برای برابری چند روز پیش پاسخ پزشکی قانونی ‏مبنی بر وجود افسردگی در خانم کرمی به دست بهداری اوین رسید.
محبوبه به پزشک بهداری اوین توضیح داده ‏که شب ها هنگام خواب فریاد می زند و صدای او باعث بی خوابی هم سلولی‌های‌اش شده است. با این وجود، ‏پزشک زندان توصیه کرد که امکان سر و صدا به دلیل وجود انحراف بینی محبوبه است که باید مورد عمل ‏جراحی قرار گیرد.
اما قرار تامین وی به دلیل عمل جراحی و مداوای بیماری افسردگی از بازداشت موقت به ‏وثیقه تبدیل نخواهد شد و تحت نظارت زندان، باید این مداوا صورت بگیرد. ‏
محبوبه در صحبتی که با وکلا و خانواده خود داشته، باقی ماندن در زندان را به دلیل درگیری های داخل زندان ‏برای چنین عمل و مداوایی نامناسب دانسته است. به همین دلیل، امروز که وی به بیمارستان طالقانی برای عمل ‏جراحی بر روی بینی خود منتقل شد، پس از بازگشت به اوین از این عمل انصراف داد. ‏
برادر محبوبه ادامه نگهداری وی را در زندان با توجه به این شرایط بسیار نامناسب دانسته و معتقد است باید ‏هرچه زودتر شرایط بهتری برای وی فراهم شود تا بتواند تحت معالجه قرار گیرد. ‏
محبوبه کرمی، از فعالان کمپین یک میلیون امضاء توسط ماموران امنیتی ۱۱ اسفند پس از تفتیش خانه پدری اش ‏بازداشت شد. قرار بر این بود که دادگاه وی در روز هفت تیر ماه از سوی شعبه ۲۶ دادگاه انقلاب برگزار شود اما به ‏دلیل عدم حضور رئیس شعبه ، روز دادگاه به ۱۸ مرداد ماه انتقال یافت.
On Tuesday 28 July 2009, Iraqi police forces under the direct orders of Nouri Almaliki, the Iraqi Prime Minister, violently attacked Ashraf refugee camp which is home to 3,500 Iranian refugees who have lived there for over 20 years. They are Iranian intellectuals, artists, musicians, leaders, workers and students rights activists who have had to flea their home and families in fear of torture and execution by the Iranian regime.




Famous incident which gave more than 1300 news coverage at the time, of an illegal attack by Iraqi - Badr brigade sponsored by Iran, at the behest of the Iranian spiritual Leader Khameneie, has been commemorated in some European cities, according to our readers.

organisations (PMOI and Fedaeen) which had been the primary victim of the 1988

Iran’s Supreme Leader, Ali Khamenei, former President Ali Akbar Hashemi Rafsanjani, recent presidential candidate Mir Hossein Moussavi, and a number of sitting and retired judges and officials, including former head of the Supreme Court, Abdolkarim Mousavi Ardebili, are all liable to arrest under international law for complicity in the murder of thousands of political prisoners at the end of the Iran/Iraq War. This is the conclusion of a 145-page report by Geoffrey Robertson QC, who urges the Security Council to set up a special court, along the lines of the International Tribunals for Yugoslavia and Rwanda, to try these men “for one of the worst single human rights atr
ocities since the Second World War”.
The report concludes that the leaders were guilty of implementing a fatwa issued by Ayatollah Khomeini in July 1988, which sentenced thousands of political prisoners to death without a trial. At Tehran’s notorious Evin Prison and twenty other prisons throughout Iran, dissidents who had previously been sentenced to various prison terms and had refused to recant their religious beliefs were blindfolded and paraded before judges who directed thousands to the gallows. “They were hung from cranes, four at a time, or in groups of six from ropes hanging from the stage of the prison assembly hall. Their bodies were doused with disinfectant, packed in refrigerated trucks, and buried by night in mass graves, the locations of which are still withheld from their families.”
Mr Robertson concludes that the leaders of Iran planned for this “final solution” when it became clear that they would have to accept a truce with Iraq. Death committees (a religious judge, a prosecutor and an intelligence official) were sent to prisons to arrange the extermination of steadfast sympathizers of Mojahedin Khalq Organization. Then came the turn of the Marxists and atheists who were born in Muslim families and were declared apostates. The men were hanged and the women were tortured until they repented.
The evidence set out in the report shows that the victims were killed because of their beliefs about religion – because they were atheists or because they were Muslims who opposed the Ayatollah’s version of Islam (the “Guardianship of the Jurist”) that had been adopted by the theocratic state. Mr Robertson points out that the crime of genocide includes the destruction of groups because of their religious beliefs or non-beliefs and that those who implemented the fatwa,which directed the extermination of prisoners because of their different religious beliefs, were committing genocide. The significance of this finding is that it would give the international community a legal basis for arresting many of the present leadership of Iran.
The report uncovers official statements justifying the slaughter and identifies those present leaders who are suspected of participating in its implementation and cover-up. The best known are the current Supreme Leader, Ayatollah Ali Khamenei, and Hojatoleslam Ali Akbar Hashemi Rafsanjani, Commander of the Armed Forces at the time, who would have dispatched the killing squads. The report uncovers hitherto unknown statements by Mir Hossein Moussavi justifying the action, the then Prime Minister and now one of the leaders of the reform movement. Mr Robertson says “he has not given any account of his role at the time, or his reaction to it today, although he is frequently asked. His statements at the time were part of the cover-up”.
Mr. Robertson names other currently powerful judges as being complicit in the killings. He says that the scale and cold-bloodedness of these killings, and the fact that they were carefully planned, makes them of greater infamy that the slaughter at Srebrenica and the allied prisoner death marches by Japan at the end of World War II.
The report accuses Tehran of continuing to deny relatives of the victims their right to know where their loved ones are buried. Some months after they were killed, the families were given plastic bags containing their belongings, but were refused all information about their burial places. The location of mass graves has been established in Tehran’s cemetery area, but attempts by families to gather there to mourn on anniversaries of the massacre have been dispersed by the authorities.
The situation in Iran today, the report argues, illustrates the consequences of impunity for crimes against humanity that have never been properly investigated or acknowledged. Some of the leaders who engaged in such a level of lawlessness and barbarity against their own people and their acolytes remain in powerful positions in the judiciary and the state, whose Supreme Leader Ali Khamenei has in the past year called upon the Revolutionary Guards to use violence against peaceful protests. “Those staged television show trials of the 1980s, with televised ‘confessions’ by leftist prisoners wracked by torture and fear for their families, writes Geoffrey Robertson, re-emerged in 2009, this time featuring ‘Green Movement’ reformists confessing to participation in an international conspiracy. Once again, dissidents are being prosecuted for being moharebs (“warriors against God”) and some are being sentenced to death”.
Mr Robertson argues that the Security Council has the power and the duty to set up a special court to prosecute those responsible for the massacre “because there is no statute of limitations on crimes against humanity”.
The inquiry was conducted for the Washington-based Abdorrahman Boroumand Foundation, an NGO concerned with human rights and democracy in Iran.

The International Campaign Speaks to Shiva Nazar Ahari’s Mother


2009 Election: An Arrest Warrant Dated A Week Before The Election


In 2009, she continued her activities with Women’s Convergence Group during the presidential election campaign. There were many civil society women activists from different backgrounds, beliefs, and organizations. They mailed out brochures to different presidential candidates’ headquarters, listing women’s demands; they send them to the campaign headquarters of Mahmoud Ahmadinejad, Mohsen Rezaei, Mir Hossein Mousavi, and Mehdi Karroubi. The Women’s Convergence Group would then go to different campaign headquarters and describe their plans and debate about them. “This all continued until the day the elections results were announced and everyone returned to their homes,” Shiva Nazar Ahari’s mother said.

As the vote counting ended, arrests of political and civil society activists started. Shiva was arrested during the first wave of arrests. “It was 2:00 a.m.on the day after the results were announced. Ministry of Intelligence men came to our home. Shiva wasn’t home, so they went to her office. Shiva was arrested on 14 June, 2009, but her warrant was dated a week prior to that, 6 June 2009. Her name was added to the warrant later,” she said. Arrests with “blanket arrest warrants” issued several days prior to the election is a shared theme among the arrest cases of many who were imprisoned after the election.

Nazar Ahari was arrested during a time when her parents were in very poor health conditions. Describing the night she was arrested, her mother says: “Her father and I were in very bad shape that night. Her father had had open heart surgery and was ordered to remain in a stable mental state. I was undergoing chemotherapy. They took our child and from the day of her arrest on 14 June 2009, we were unable to have any news on her for 25 or 26 days. We went anywhere we could think of, the Revolutionary Courts and the Prosecutor’s Office. Many people had been detained and wherever I went, there was a flood of people just like myself who didn’t know where their children were.”

Her detention lasted more than three months. “This was the arrest where we were not allowed to see her for 80 days. I went to Evin Prison every week, but each time they told me that she was not allowed to have any visitors. She called me 25 days after her arrest to tell me and said: ‘I’m well, Mom. Don’t worry for me. I am in solitary confinement in Ward 209.’ After this, I didn’t hear from her again for another 15 days. Then she called again and during a very short conversation she said: ‘Mom, I won’t be able to call you for two to three weeks now, but don’t worry for me.’ Eighty days went by and then I was allowed to see her in person in the presence of the ‘case specialist’ who worked with Shiva. Up until that day I didn’t know that the ‘case specialist’ had been changed, and I thought the same guy was still in charge [of her interrogation]. When we went to the visitation hall and saw that gentleman, I realized he is the same man who had come that night with the other security forces. Shiva said he is my new “case specialist.” In the end, Judge Sobhani told us to raise her $500,000 bail to release her. For a whole month we kept going back to the Revolutionary Court to get the $500,000 bail amount reduced, because our family could not afford it. In the end the bail was reduced to $200,000 and we still couldn’t afford it. This is when Shiva’s grandfather submitted the deed to his home as collateral,” her mother said.

Another Arrest

Shiva Nazar Ahari was released on 23 September 2009. “But she was not free long enough even for a good visit,” said her mother. On 20 December of the same year, she was arrested when she, along with her companions, were on their way to Ayatollah Montazeri’s funeral. This time she was able to contact her family the next day.

“The telephone rang and she said ‘Don’t worry, I am at Evin Prison.’ I asked her on the phone, ‘Is it possible not to be worried? You didn’t even taste your freedom and you were arrested again?’ Two or three days later she called again and she was not feeling well at all. I had already heard her voice, but I was constantly anxious and I told her ‘Your voice doesn’t sound good at all. Are you sick?’ She said ‘No, I’m not sick.’ The first week we went to visit her they did not allow it, but the second week we met her. When I saw her skin color I asked her why she was so pale. Her general health was very bad, as if she had to make an effort to stay on her feet. She said ‘I am on a dry hunger strike, because they arrested me without cause. I had not done anything.’ Her father was very upset and said, ‘For our sakes, please do not do this. You are now forced to stay in prison, but I beg you not to go on strike. At least while you are here stay healthy.’ She promised to end her strike. I just told her, ‘Have you thought about what I should do if something happens to you?,’” recalled Shahrzad Fariman.

“She said, ‘When I was arrested I was in such a bad shape that I didn’t do any thinking. I was only thinking that I was arrested without any cause, and I was arrested again without any grounds.’ After that, she was in solitary confinement again for 60 days when the weather was very cold. Even though Shiva never had a problem with cold, and during her 25-year-life she would always complain about the heat, it seems the prison was so cold that every time I talked to her she said, ‘Mom, it is very cold here.’ We could not take her any warm clothes. I knocked on any door I could think of to give my kid two sets of warm clothes, or two pairs of socks, but it did not happen,” added Nazar Ahari’s mother.

“The New year arrived and at the time when a lot of the prisoners were being released, I thought Shiva might also be among them, but she was not. From 20 December, when Shiva was arrested, to 23 March, her “case specialist” only allowed one meeting in person in the courtyard of Evin Prison, to which we went along with the family. He called at 10:30 a.m. and said to be there by 11:00 a.m. I said we could not get there so fast, because our distance is too far away from Evin Prison. We saw her for the first time after three-four months. Then, in-person visits became regular, but we could only see her through the cabin, and once a week she was allowed one phone call. All this time she remained in Ward 209. Once every two months her temporary detention order expired, but it was extended again. There was no news of the trial or the Prosecutor. Shiva remained in prison, and we kept staring at the calendar, and every day we said there would be some news by the end of this week, and we were hoping that they would release Shiva. Her birthday also came and went, but Shiva was still in prison,” she added.

Currently, seven months have passed since Shiva Nazar Ahari’s arrest. She was transferred to the General Ward after six months, to a cell, which according to her is a room that she shares with three or four other political prisoners. According to her mother, she has never complained about her situation, not about the prison guards’ treatment, nor about the food.

Nazar Ahari’s family was told that her two court cases would be conjoined in Branch 26 of the Revolutionary Court by 23 May 2010. “Mr. Pirabassi, the presiding judge of this branch, had promised to conjoin the cases within a week and to return it to the court again. From that date until today, ‘the week’ has not ended yet for her case to go back to the court and for her situation to be clarified,” said Nazar Ahari’s mother.





شیوا نظرآهاری فعال حقوق بشر؛ ازکودکی تا هفت ماه در زندان درگفت وگوی تفصیلی بامادرش شهرزاد کریمانشهرزاد کریمان مادر شیوانظرآهاری فعال حقوق بشری که بیش از هفت ماه است در زندان اوین به سر می برد در مصاحبه ای تفصیلی با کمپین بین المللی حقوق بشر در ایران به شرح سرگذشت دخترش پرداخته که به گفته او « باید به خاطر راه درستی که انتخاب کرده «همه ۲۶ سالگی خود را در زندان سپری کند.» شیوانظراهاری پس از انتخابات دوبار دستگیرشد که این دومی ماههاست ادامه دارد. بار اول او فردای روز انتخابات ۲۲ خرداد دستگیر شد. خانم کریمان می گوید حکم دستگیری تاریخ یک هفته پیش از آن را داشت. او بارها تصریح می کند که دخترش هیچ گاه فعالیتی خلاف قانون نداشته است و فعالیت های دخترش برای بهبود وضعیت حقوق بشر مورد تایید وی و پدرشیواست.
بسیاری از زندانیانی که به دلیل فعالیت های سیاسی، روزنامه نگاری، دفاع از حقوق بشر و یا فعالیت های مربو به برابری حقوق زن و مرد در ایران طی سالهای گذشته دستگیرشده اند، درسالهای آغارین دهه بیست یا سی سالگی خود هستند. شیوا نظرآهاری متولد ۲۰ خرداد ۱۳۶۳ است. او درحالی هم اکنون در زندان به سر می برد که اولین بار مزه زندان را در ۲۰ شهریور سال ۱۳۸۱ چشید. یعنی زمانی که تنها هجده سال داشت: ۲۰ شهریور سالگرد حادثه تروریستی ۱۱ سپتامبر. مادر شیوا به کمپین می گوید: « من همیشه به بازجوهایش این نکته را گفتم که اگر راهی برای کارهای سیاسی پیش پای شیوا باز شد، خود شما این راه را جلوی پایش گذاشتید.»
سالگرد یازده سپتامبر و اولین دستگیری شیوانظرآهاری
شهرزادکریمان، این دستگیری را چنین شرح می دهد: « من در آن زمان همه کارهای بچه ها از جمله خرید لوازم تحریر و بقیه کارها را خودم انجام می دادم . ۲۰ شهریور سال ۸۱ سالگرد ۱۱ سپتامبر بود و من به دلیل تصادفی که کرده بودم و جراحی بینی نتوانستم برای خرید دانشگاه برایش کتاب بخرم. تازه ثبت نام کرده بود برای کنکور و در کلاس های کنکور شرکت می کرد. برای اولین بار خودش رفت جلوی دانشگاه که کتاب بخرد بازداشت شد.»
جستجو برای یافتن شیوا ساعت ها ادامه پیدا کرد اما خبری از وی نشد و کسی هم پاسخی نداد تا آنکه درتماس با پلیس ۱۱۰ خانواده درمی یابد که او بازداشت شده است: « یک آقایی از پشت تلفن به من گفت که شما نگران نباشید و از من هم نشنیده بگیرید؛ بازداشت شده است و خودشان تماس می گیرند. بیست روز تمام از او بی خبر بودیم و هر جایی که به ذهنمان می رسید را گشتیم. در تمام این مدت دلخوشی ما همان یک کلام پلیس ۱۱۰ بود که گفته بود اینها بازداشت شده اند. بعد از ۲۰ روز یک آقایی برای تحقیقات محلی مراجعه کرد. پرسیدند که برای چه رفته بود؟ گفتم برای خرید کتاب رفته بود. صورت خودم هنوز باند پیچی بود گفتم وضعیت من اینطور بود و به همین دلیل خودش برای خرید کتاب رفت. دو سه روز طول کشید و به ما خبر دادند که ایشان زندان اوین است در بند ۲۴۰ و تقاضای وثیقه ۴۰ میلیون تومانی کردند. به هر حال وثیقه را فراهم کردیم و آزادشد.»
شیوا هیچگاه با خانواده اش درمورد دوران زندان صحبت نکرد:‌ « گاهی وقتی با دوستانش صحبت می کرد می شنیدیم که می گفت جایی بود که اگر پا را دراز می کردم به دیوار می خورد و دست ها هم همینطور و وضع غذا هم خیلی بد بود. تا زمان دادگاهش شد که جریمه ۲۰۰ هزارتومانی تعیین کردند. پرسیدم برای چه؟ گفتند دو شمع در کیف او پیدا کردیم. گفتم شمع مال خودش نبوده و دربازجویی ها هم به شما گفته است که شمع متعلق به خانمی بوده که کیف همراهش نبوده و به همین دلیل شیوا شمع ها را در کیف اش گذاشته بود.»
شیوا اصرار می کند که ۲۰۰ هزارتومان جریمه را ندهد و به جایش به زندان برود. مادرشیوا ادامه می دهد: « (شیوا) می گفت که پدر من یک بازنشسته است و چرا باید پول زور بدهیم. به هر حال این مبلغ را پرداخت کردیم.»
همان سال ۱۳۸۱ شیوا در کنکور مهندسی عمران قبول شد. فعالیت های او در این دوره در حوزه دفاع از حقوق بشر و کمیته دانشجویی دفاع از زندانیان سیاسی و همچنین حقوق زنان و کودکان خلاصه می شد. به گفته مادرش در این مسیر « برایش فرقی نمی کرد که این کسی که در زندان است وابسته به کجا است. مال کدام سازمان است.» او حتی هنگامی که طرحی برای مبارزه با آنچه «اراذل و اوباش» توسط نیروی انتظامی اجرا شد و درجریان آن از خشونت عریان بی سابقه ای برای عبرت گرفتن و مجازات این افراد استفاده شد نیز چنین رفتارهایی را مورد انتقاد قرار داد. مادرشیوا می گوید: « شیوا بارها و بارها با مادران و خودشان صحبت کرده بود. دوستان دیگرش می گفتند شیوا برای اینها کار نکن، اینها اراذل و اوباش هستند. می گفت من کاری به این حرف ها ندارم. اینها انسان هستند یا نه؟ حقوق انسانی آنها حکم می کند که این رفتارها با آنها نشود.» شهرزادکریمان معتقد است «اگر آن موقع کسی به صدای شیوا گوش می کرد در کهریزک مثل روح الامینی ها و محمد کامرانی ها و خیلی از بچه های دیگری که گل سرسبد مردم بودند از بین نمی رفتند.»
در جریان این فعالیت ها یک بار دیگر در ۱۸ تیرماه سال ۸۳ در بلوار کشاورز بازداشت شد. این بار مادرش هم همراه او بود: « به دفتر پیگیری رفتیم. تا ساعت ۴ صبح دفتر پیگیری بودیم و بعد از ۴ صبح ما را آوردند جلوی خانه پیاده کردند.» سال ۸۳ در تجمعی مقابل سازمان ملل که به منظور همدردی با خانواده زندانیان سیاسی برگزار شد باردیگر مادرشیوا همراه و همدوش دخترش حضور داشت. مادر شیوا می گوید که همه را بازداشت کردند: « من بعد از یک هفته آزاد شدم اما شیوا یک ماه در زندان بود. این بار هم با قرار ۴۰ میلیون تومانی آزاد شد. و در دادگاه به یک سال حبس تعزیری با ۵ سال تعلیق محکوم شد.
شیوانظرآهاری در همین زمان است که درراستای دفاع از حقوق کودکان وارد سازمان غیردولتی «کودکان کار» شد. به گفته مادرش او در پاسگاه نعمت آباد به کودکان درس می داد تا زمانی که تحصیلش در مقطع لیسانس تمام شد و وارد بازار کار شد. با این حال هفته ای یک یا دو بار و هر زمانی که وقتی پیدا می کرد به مدرسه ای که در پاسگاه نعمت آباد درجنوب تهران بود می رفت و به بچه ها درس می داد. به گفته مادرشیوا او درفاصله سال ۸۱ تا ۸۳ سه یا چهاربار به همین شکل و با زمان های کوتاه بازداشت دستگیر می شود.
انتخابات ۸۸: دستگیری با حکمی با تاریخ یک هفته پیش ازانتخابات
سال ۱۳۸۸ همزمان با انتخابات ریاست جمهوری او فعالیت خود را در مجموعه «همگرایی زنان» برای انتخابات ریاست جمهوری ادامه داد. در این گروه زنان فعال جامعه مدنی از طیف های مختلف فکری و کاری حضور داشتند. آنها مطالبات زنان را به شکل بروشورهایی برای ستادکاندیداهای مختلف ریاست جمهوری ارسال می کردند. از ستادانتخاباتی محموداحمدی نژاد تا محسن رضایی، میرحسین موسوی و مهدی کروبی. گروه «همگرایی زنان» با مراجعه به ستادهای انتخاباتی به گفت وگو و طرح برنامه های خود پرداختند. مادرشیوا می گوید این فعالیت ادامه داشت «تا روزی که نتایج انتخابات اعلام شد و همه به خانه هایشان برگشتند.»
باپایان رای شماری آرا بازداشت فعالان سیاسی وجامعه مدنی آغاز شد. شیوا جزو اولین موج بازداشت ها بود. مادر وی می گوید: «‌ ساعت ۲ صبح بعد از اعلام نتایج آقایان اطلاعاتی به منزل ما مراجعه کردند و چون شیوا منزل نبود به محل کارش مراجعه کردند. شیوا روز ۲۴ خرداد بازداشت شد اما صدور حکم مربوط به یک هفته قبل و تاریخ ۱۶ خرداد بود و بعد نام او را نوشته بودند.» بازداشت با «حکم فله ای» که روزها قبل از انتخابات صادرشده بود یکی از موارد مشترک در پرونده بسیاری از بازداشت شدگان پس از انتخابات که روانه زندان شدند بود.
این بازداشت درحالی انجام شد که پدر و مادر وی در بدترین وضعیت سلامتی خود بودند. مادر شیوا در شرح شب بازداشت می گوید: « آن شب تا خود صبح وضع من و پدرش بسیار بد بود. پدر شیوا عمل جراحی باز قلب کرده است و باید از نظر عصبی شرایط مناسبی داشته باشد و خود من باید تحت شیمی در مانی باشم ولی بچه ما را بردند و از تاریخ ۲۴ خرداد که او را بردند تا ۲۵ یا ۲۶ روز هیچ اطلاعی از او نداشتیم. باز هم به هر جایی که فکرم می رسید رفتم به دادگاه انقلاب و داستانی. چون آن زمان خیلی ها بازداشت شده بودند هر جا که می رفتم با سیل آدم هایی مواجه می شدم که همه مثل من بودند و نمی دانستند که بچه هایشان کجاست.»
این بازداشت اما بیش از سه ماه روز به طول انجامید: « همان بازداشت بود که مدت ۸۰ روز ما هیچ ملاقاتی نداشتیم من هر هفته به زندان اوین مراجعه می کردم اما هر دفعه به من می گفتند ممنوع الملاقات است. تنها بعد از ۲۵ روز اولیه تلفن زد و گفت مامان حالم خوب است، نگران من نباشید من در سلول انفرادی در بند ۲۰۹ هستم. بعد از آن دوباره ۱۵ روز هیچ خبری نبود و دوباره تلفن زد و خیلی کوتاه گفت مامان بعد از این دو سه هفته نمی توانم تلفن بزنم ولی نگران من نباش. ۸۰ روز گذشت و بعد از آن یک ملاقات حضوری با اجازه خود کارشناسی که با شیوا کار می کرد دادند. من هم تا آن روز نمی دانستم که کارشناس عوض شده و فکر می کردم همان آقای قبلی است. وقتی که به سالن ملاقات حضوری رفتم و این آقا را دیدم تازه متوجه شدم که همان آقایی است که آن شب با بقیه ماموران امنیتی آمده بودند و شیوا گفت که ایشان کارشناس جدید من هستند. در نهایت بازپرس او آقای سبحانی گفت که قرار ۵۰۰ میلیونی او را تامین کنید تا آزادش کنم. مدت یک ماه ما در راه دادگاه انقلاب و خانه بودیم تا بتوانیم این مقداری تخفیف برای این قرار ۵۰۰ میلیون تومانی بگیریم چون از عهده خانواده بر نمی آمد در نهایت باز هم نتوانستیم و قرار تبدیل به ۲۰۰ میلیون تومان شد. باز هم نتوانستیم آن را تامین کنیم تا این که پدربزرگ شیوا سند خانه خود را به عنوان وثیقه گذاشت.»

یک بازداشت دیگر: «اینقدر آزاد نبود که سیرببینیمش»
شیوانظرآهاری اول مهرماه آزاد شد. مادرش می گوید: « اما آنقدر آزاد نبود که ما سیر ببینیمش.» در تاریخ ۲۹ آذرماه سال گذشته هنگامی که وی به همراه عده بسیار دیگری عازم مراسم فوت آیت الله منتظری بود در میانه راه دستگیر شد. او این بار توانست که فردای روی بازداشت با خانواده خود تماس بگیرد و بازداشت خود را اعلام کند.
شهرزاد کریمان مادر شیوا می گوید: « تلفن زد و گفت ناراحت نباش من اوین هستم. پای تلفن به او گفتم مگر می شود ناراحت نبود؟ اصلا تو رنگ آزادی را دیدی که دوباره بازداشت شدی؟ دو سه روز بعد از آن دوباره تلفن زد و اصلا حالش خوب نبود. من قبلا هم صدایش را شنیده بودم اما مدام اضطراب داشتم و به او گفتم شیوا اصلا صدایت خوب نیست مریضی؟ گفت نه مریض نیستم. اولین هفته که رفتیم به ما ملاقات ندادند. اما هفته دوم ملاقات دادند. وقتی رنگ او را دیدم گفتم چرا اینقدر رنگ پریده ای؟ حال عمومی اش خیلی بد بود انگار که مجبور بود خودش را سرپا نگه دارد. گفت اعتصاب غذای خشک داشتم به خاطر این که بدون دلیل من را بازداشت کردند. من هیچ کاری نکرده بودم. پدرش خیلی ناراحت شد و گفت بابا فقط به خاطر ما شما این کار را نکن. حالا مجبوری در زندان بمانی اما از تو خواهش می کنم اعتصاب نکن. لااقل اینجا هستی سالم باشی . به ما قول داد که دیگر اعتصاب نکند. من فقط به او گفتم فکر نکردی که اگر بلایی سرت بیاید من چه باید بکنم؟ گفت آن موقع که بازداشت شدم آنقدر وضعم بد بود که هیچ فکری نکردم. فقط به این فکر می کردم که من بدون دلیل و بدون هیچ منطقی دوباره بازداشت شده ام. بعد از آن مدت ۶۰ روز دوباره در سلول انفرادی بود در زمانی که هوا بسیار سرد بود. با این که شیوا از نظر سرما هیچ وقت مشکلی نداشت و طی این ۲۵ سال همیشه از گرمامی نالید اما آنقدر زندان سرد بود که هر بار با او صحبت می کردم می گفت اینجا خیلی سرد است مامان. ما نمی توانستیم برایش لباس گرم ببریم و به هر جایی که فکر می کردم سر زدم که بتوانم دو دست لباس گرم و یا دو جفت جوراب به بچه ام برسانم اما نشد. عید شد و وقت آزادی هایی که همه را آزاد می کردند گفتم حتما شیوا هم جزو آنهاست و آزاد می شود اما نشد. بعد از این همه وقت از بیست و نهم آذر که شیوا بازداشت شد تا سوم فروردین کارشناس او در محوطه اوین یک ملاقات حضوری داد که با خانواده رفتیم . ساعت ده و نیم زنگ زد و گفت تا ساعت ۱۱ آنجا باشید. من گفتم ما به این سرعت نمی توانیم چون فاصله ما تا اوین خیلی دور است. برای اولین بار بعد از سه چهار ماه او را دیدیم. بعد ملاقات‌های حضوری مرتب شد اما به صورت کابینی می رفتیم و او را می دیدیم و هفته ای یک بار هم تلفن داشت اما همچنان در بند ۲۰۹ بود. هر دو ماه یک بار قرار بازداشت تمام می شد و دوباره قرار را تمدید می کردند. از دادگاه و بازپرس هیچ خبری نبود. همچنان شیوا در زندان بود و ما هم به این تقویم نگاه می کردیم و هر روز می گفتم این هفته تا آخرش یک خبری می شود و امیدوار بودم که شیوا را آزاد می کنند. تولدش هم امد و رفت اما شیوا همچنان در زندان بود.»
درحال حاضر هفت ماه از بازداشت شیوانظرآهاری می گذرد. او بعد از شش ماه به بندعمومی زندان منتقل شد. اتاقی که به گفته وی شامل یک اتاق وسه چهارنفر از زندانیان سیاسی است. به گفته مادرشیوا او هیچ وقت از وضعیت اش شکایتی نکرده است، نه از وضعیت رفتارزندانبانان نه از وضعیت غذا.
به خانواده نظرآهاری گفته می شود که در دوم خرداد ماه سال جاری دو پرونده وی در شعبه ۲۶ دادگاه انقلاب تجمیع خواهد شد: « آقای پیرعباسی قاضی این شعبه قول داده بودند که ظرف یک هفته این پرونده تجمیع شود و دوباره به دادگاه برگردد. از آن تاریخ تا به امروز ، هنوز این یک هفته تمام نشده است که پرونده به دادگاه برگردد و تکلیف او هر چه زودتر روشن شود.»
شیوا کودکی درسخوان و دلسوز، دوستی مهربان
شهرزدا کریمان می گوید: « از همان ابتدای بچگی بسیار باهوش و فعال بود. نسبت به هم سن و سال های خودش بسیار دلسوز بود. بسیار محتاط بود و بچه پرشور و شری نبود از این نظر که کارهای ناهماهنگ داشته باشد. در دوران دبستان همیشه شاگرد ممتاز بود. حتی کلاس دوم ابتدایی که یک ماه و نیم به دلیل ضربه ای که به سرش خورده بود جراحی شد. قسمتی از جمجمه اش باز شد و خونی که در آن جمع شده بود تخلیه شد برای امتحانات ثلث دوم سر کلاس حاضر نشد با این حال معدل او در همین وضعیت هم ۲۰ شد. کل دبستان را با معدل ۲۰ به پایان رساند. همینطور دوره راهنمایی که سال سوم راهنمایی نمره کارنامه اش ۲۰ بود به طوری که مدرسه ای که ثبت نام نمی کرد چون کروکی محله به این مدرسه نمی خورد، وقتی که با کارنامه اش مواجه شدند گفتند این جزو بچه های نابغه است و حتما باید اینجا ثبت نام شود. در دوره پیش دانشگاهی هم همینطور بود.»
او می افزاید: «طی این مدت پنج شش سال من هیچ ناراحتی از این بچه نداشتم. از هیچ نظر از او کوچکترین دلخوری نداشتم . حتی یک بار نشد که من چیزی را به او تذکر بدهم. او همه چیز را خودش مراعات می کرد و امکان نداشت که من یا پدر یا خواهر و یا برادرش کوچکترین مشکلی با او داشته باشیم.»
کمک کردن برای شیوا از خانه شروع می شد جایی که دلبستگی زیادش به پدرومادر او را برای ادامه فعالیت هایش به جلو می راند: «چون از نظر درسی خیلی عالی بود همیشه در درس ها کمک همه خواهرانش بود. بعد از این که رفت سر کار همیشه این را می گفت که من سعی می کنم طوری کار کنم که به بابا فشار نیاید چون برای درس خواندن من خیلی زحمت کشیده است. من می دانم که بابا بازنشسته است و سعی می کنم تمام محبت های شما را جبران کنم. به همان نسبت هم وقتی پیش بچه های جمعیت کار و خیابان می رفت همین رفتار را داشت. دوستانش که می آمدند اینجا می گفتند بچه های مرکز هم بی قرار شیوا هستند و همه اش حال او را می پرسند و می گویند خاله شیوا کجاست چرا دیگر نمی آید مگه ما را دیگر دوست ندارد؟ و آنها هم نمی دانستند چه جوابی بدهند….برای خودش هیچوقت هیچ چیزی نخواست. هر وقت که حقوق گرفت هر چه که بچه ها نیاز داشتند برایشان گرفت. به قدری سر کارش محبوب است که هنوز هم در شرکت بعد از این که سه ماه زندان بود برگشت بلافاصله برای کار خواستندش. الان که هفت ماه است شیوا نیست هنوز هم مهندسان و مدیرعامل شرکت زنگ می زنند و از من حالش را می پرسند و همیشه به من می گویند امکان ندارد ما جای شیوا را به کسی دیگر بدهیم. آنقدر این دختر خوب و مسئولیت پذیراست.»
مادرشیوا ادامه می دهد: « رابطه شیوا با ما و با همه خوب است. یعنی شما در فامیل هم اگر کسی صحبت کند هیچ کسی نیست که از شیوا یک ذره ناراحتی داشته باشد و در میان دوستانش هم همینطور است. اگر هر جور با او رفتار کنند امکان ندارد به کسی عکس العملی نشان دهد. با ما بسیار بچه خوب و دلسوزی هست. هنوز که هنوز است با وجود این که انفرادی بود دوستانی که از زندان آمده بودند و با من صحبت می کردند می گفتند حتا روزی که خواهر کوچکش کنکور داشت شیوا روی دیوار یادداشت کرده بود. بی قرار بود و می گفت امروز نازآفرین کنکور دارد خدا کند خوب امتحان بدهد. اولین تلفنی که زد از من پرسید که خواهرش کنکورش را خوب داد؟ گفتم تو از خودت بگو مادر چه کار داری به امتحان او؟ گفت نه من اینجا مدام نگران او هستم.»
شهرزادکریمان از فعالیت های دخترش بسیار مطمئن است و آن را می ستاید. او می گوید: « من راهش را قبول دارم چون راه اشتباهی نمی رفت. آخر مگر دفاع کردن از حقوق مردم و حقوق بشر جرم است؟ وقتی من می شنوم که می گویند اقدام علیه امنیت ملی برایم خیلی سنگین است. اقدام علیه امنیت یعنی کسی اسلحه دستش بگیرد و کاری کند که امنیت مردم به خطر بیفتند. ولی شیوای من حتا راضی نمی شود که مورچه ای زیر پایش آزار ببیند و تمام هم و غم اش کمک به مردم است بعد یکی از اتهامات شیوا را اقدام علیه امنیت ملی می زنند.»
شیوا نظر آهاری و آرزوهایش
مادرشیوا درمورد آرزوهای شیوا، دخترزندانی‌اش می گوید: « همیشه می گفت آرزو دارم هیچوقت تبعیض بین آدم ها نباشد. یعنی یک روز نباشد که از یک مسیری رد می شوم ببینم که بچه ای برای فروختن یک فال التماس می کند. یا این که کسی مرز بندی داشته باشد بین دفاع از حقوق انسان ها. من همیشه سعی می کنم که این طور مسائل نباشد . من فکر نمی کنم که کسی که وضعیت مالی بهتری دارد باید همه در مراسم هایش باشند و آن که ندارد نه. یک بار آمد خانه و یک عالمه فال دستش بود. گفتم اینها چیست که گرفته ای گفت بچه ای به من گفت اگر من به خانه بروم و فال هایم را نفروخته باشم کتک می خورم. می رفت به مرکز و می گفت گاهی می بینم که یک طرف صورت بچه ای کبود است می پرسم برای چه کبود شده می گوید پدرم زد برای این که نتوانستم این مقدار پول به خانه ببرم. آرزو می کرد که بچه ها مجبور نباشند کار کنند یا اعدام نشوند. محیطی برای بچه ها نباشد که نتوانند آنطور که باید و شاید رشد و زندگی کنند.

وی در نقد اتهاماتی که به دخترش زده می شود و نگهداشتن او برای ماهها در زندان ادامه می دهد: « آخر شیوا چه امنیتی را به خطر انداخته است؟ تمام کارهایش در چارچوب نظام جمهوری اسلامی است و با این نظام هیچ سر عنادی ندارد و برای انسان ها کار می کند. این راهی نیست که من قبول نداشته باشم و چه من و چه پدرش و تمام مردم ایران. اگر شیوا و شیواها به نظرسنجی گذاشته شوند همه می فهمند که راه شیوا نه تنها غلط نیست بلکه راه درستی می رود و بی دلیل در زندان است . زندان جای شیوا و شیواها نیست. زندان جای قاتل ها و دزدها و کسانی است که امنیت مردم را به خطر می اندازند. آخر شیوای من چه کرده است که باید بهترین سالهای عمرش را و کل ۲۵ سالگی اش را در زندان باشد و ۲۶ سالگی اش را در زندان جشن بگیریم. من هر چه که با خودم فکر می کنم نمی توانم بپذیرم که راه شیوا طوری است که باید در زندان باشد.»
و این نکته ای نیست که مادرشیوا با کسانی که او را بازجویی می کنند مطرح نکرده باشد: « به کارشناس او هم گفتم که امکان ندارد شیوای من راه غلط برود. حرف آخرم این است که تمام شیواها و تمام بچه هایی که در زندان هستند از این وضع نجات پیدا کنند. زندان را بگذارند برای کسانی که باید در زندان باشند و به ناموس مردم تجاوز کرده اند یا قتل انجام داده اند. اما این بچه ها هیچ کار اشتباهی انجام نداده اند و همه این بچه ها مثل شیوای من هستند و هیچ کدام کاری انجام نداده اند که بهترین سالهای عمرشان را باید در زندان بگذرانند. فقط همه آنها را به خدا می سپارم و آروز می کنم هر روز که خداوند سلامتی را ازشان دریغ نکند در این شرایط سخت زندان و دوری از خانواده ها و بتوانند آن وضع را تحمل کنند.»
آخرین سخن شهرزاد کریمان که صدایش هر بار که از شیوا سخن می گوید با اشتیاق معنی داری همراه می شود این است: «آرزو می کنم که هر چه زودتر درهای زندان باز شود و این گلها به آغوش خانواده هایشان برگردند.»
زمینه خبر:
شیوا نظر آهاری؛ فعال حقوق بشر و سردبیر وب سایت کمیته گزارشگران حقوق بشر، در روز ۲۴ خردادماه درمحل کار خود بازداشت شد. شب قبل از بازداشتش، ماموران به خانه او رفته بودند و خانه را تفتیش کرده و وسایل شخصی او را با خود برده بودند. شیوا نظرآهاری، ۳۶ روز در انفرادی در بند ۲۰۹ زندان اوین بود و طبق گزارش ها مورد شکنجه قرار گرفته تا به آنچه که بازجو می خواهد، اعتراف کند. در شهریورماه، دستور آزادی او با وثیقه سنگین ۵۰۰ میلیون تومانی که خانواده او قادر به پرداخت آن نبود صادر شد. با پیگیری خانواده، این وثیقه به ۲۰۰ میلیون تومان تبدیل شد که همچنان خانواده از پرداخت آن ناتوان است. در روز ۲۶ شهریورماه سرانجام وکیل و خانواده او موفق شدند با شیوا ملاقات کنند. شیوا در این ملاقات به خانواده خود گفت که به گفته بازجو حتی اگر وثیقه هم پرداخت شود او آزاد نخواهد شد
