Report on deplorable prison conditions; thousands of drug offenders on death row

Fars state-run News Agency: There have been various statements made regarding the increase of the prison population and this shows that judicial authorities have to put more effort into solving existing problems which are mostly related to a delay in carrying out the new Islamic Penal Code.
Last year, a member of the Judicial Commission in the 8th Majlis, Eunic Mousavi talked about the unsuitable conditions in some prisons and said, “The condition in some prisoners is such that prisoners are forced to sleep on stairs and two inmates have to share one blanket”…
In summer this year, Mohammad-Ali Asafani, the spokesperson for the Judicial Commission in the 9th Majlis stressed that prisons are packed with prisoners and criminals and added, “Unfortunately because of the many criminal designations in the law, most criminals with any kind of criminality are imprisoned”, he said.
Currently there are more than 1,700 criminal designations and experts hope that with the implementation of the new Islamic Penal Code, the number of criminal designations will decrease…
The Assistant Head of the Judicial Commission in the Majlis said that the first thing in the path of decreasing the number of prisoners is to reform the law so that imprisonment will not be the only punishment for law breakers”.
“The second way is for the Judiciary to determine what it wants to do with the many thousands of drug offenders who have been sentenced to death and say what it wants to do with this many prisoners. Currently, there are a few thousand prisoners who have been sentenced to death and their legal processes have ended but for some reason, their sentences have still not been carried out”, he added. Iran sentences PMOI supporter to 7 years of prison for exposing prison brutality

Zahra (Mahboubeh) Mansouri was sentenced to two years of prison and five years of suspended prison in a court of review.
According to reports, Mansouri who is more than 60 years old, was arrested by security forces on June 1, 2011 and was detained for 90 days in a solitary cell in Section 209 in Evin Prison...
Mrs. Mansouri who was released on bail on August 19, 2011, was charged with smuggling a film from Rajayi Shahr [Gohardasht] Prison in Karaj which showed political prisoner Mohsen Dokmeh Chi [a few days before his death in prison].
Mohsen Dokmeh Chi was suffering from pancreas cancer and passed away as a result of negligence and lack of medical care in prison.
Mrs. Mahboubeh Mansouri is suffering from epilepsy and has to regularly take her medicine and live in a stress free environment.
She is the sister of political prisoner Mohammad-Ali Mansouri and a supporter of the families of political prisoners.
Mohammad-Ali Mansouri has been in detention since September 2, 2007. He was sentenced to 17 years of prison to be served in Rajayi Shahr Prison in Karaj on charges of having links to the PMOI. (Human Rights Activists in Iran – Sep. 11, 2012)

Mother of Ashraf resident sentenced to prison after husband dies in prison
The Tehran Court of Appeal sentenced the wife of political prisoner Mohsen Dokmeh Chi, who died as a result of [cancer], to three years of prison.
Maryam Alangi’s three year prison sentence which was issued by the 15th branch of the Revolutionary Court in Tehran presided over by Judge Salavati was recently upheld by the 36th branch of the Court of Appeal headed by Judge Zargar.
According to this sentence, Mrs. Alangi has to serve her prison term in Rajayi Shahr Prison in Karaj but because the female section in this prison has been shut down, her place of detention is not known.
Mohsen Dokmeh Chi was a well-known Bazaar merchant in Tehran who was arrested in September 7, 2009 for financially aiding the families of political prisoners. He was sentenced to 10 years of prison and died on March 28, 2011 as a result of pancreas cancer because of the negligence of prison authorities and several months of delay in being transferred to hospital. افزایش جمعیت زندانها؛ معضل قانونی یا سوءمدیریت
مدتی است اظهارنظرهای مختلفی درباره افزایش تراکم جمعیت کیفری زندانها مطرح شده است و این موضوع نشان‌دهنده‌این است که مسئولان قضایی هرچه سریع‌تر باید برای رفع نواقص موجود در این زمینه که بیشتر آن مربوط به تأخیر در اجرای قانون جدید مجازات اسلامی است، تلاش کنند.
یونس موسوی، عضو کمیسیون قضایی مجلس هشتم، سال گذشته از وضعیت نامناسب برخی زندانها خبر داد و گفت: وضعیت در برخی زندانها به‌گونه‌ای است که زندانیان مجبور هستند روی پله‌ها بخوابند و هر دو نفر از یک پتو استفاده کنند...
مردادماه امسال هم محمدعلی اسفنانی سخنگوی کمیسیون قضایی مجلس نهم، با تأکید بر این‌که هم‌اکنون زندانها از زندانیان و مجرمان اشباع شده است
٬ افزود: متأسفانه به‌علت تعدد عناوین مجرمانه در قانون٬ بیشتر افراد مجرم با هر نوع عنوان مجرمانه به زندان می‌‌روند.
در حال حاضر بیش از 1700 عنوان مجرمانه وجود دارد که کارشناسان امیدوار هستند با اجرای قانون جدید مجازات اسلامی، این تعداد عنوان مجرمانه کاهش یابد...
حمیدرضا طباطبایی نایب رئیس کمیسیون قضایی مجلس شورای اسلامی با بیان این‌که اولین کار در راه کاهش جمعیت کیفری این است که قانون اصلاح شود تا حبس، تنها گزینه برای مجازات متخلفان نباشد، ‌ادامه داد: دومین راه این است که قوه ‌قضاییه تکلیف خود را با چند هزار زندانی موادمخدر محکوم به اعدام روشن کند و بگوید می‌خواهد با این تعداد زندانی چه کند. در حال حاضر چندین هزار زندانی هستند که محکوم به اعدام هستند و روال قضایی آنها طی شده است اما به دلایلی هنوز حکمشان اجرا نشده است. احكام زندان

صدور ۷ سال حکم قطعی برای زهرا (محبوبه) منصوری در دادگاه تجدید نظر
خبرگزاری هرانا - زهرا (۵محبوبه) منصوری در دادگاه تجدید نظر به ۲ سال حبس تعزیری و ۵ سال حبس تعلیقی محکوم گردید.
بنا به اطلاع گزارشگران هرانا، ارگان خبری مجموعه فعالان حقوق بشر در ایران، حکم قطعی زهرا (محبوبه) منصوری که بیش از ۶۰ سال سن دارد و در تاریخ ۱۱ خرداد ماه سال ۱۳۹۰ توسط نیروهای امنیتی بازداشت شده و قریب ۹۰ روز را در سلولهای انفرادی بند ۲۰۹ زندان اوین بسر برده بود توسط دادگاه تجدید نظر به تایید رسید...
گفتنی است، محبوبه منصوری که در تاریخ ۲۸ مرداد ماه ۱۳۹۰ با قید وثیقه آزاد گشته بود، متهم به خروج فیلم محسن دگمه‌چی از زندان رجایی شهر کرج شده است.

لازم به یاد آوریست، محسن دگمه‌چی زندانی سیاسی بیماری بود که در زندان به سرطان پانکراس روده مبتلا شده بود و بر اثر بی‌توجهی و عدم رسیدگی به موقع مسئولین فوت کرد.
خانم محبوبه منصوری نیز از بیماری صرع رنج می‌برد و می‌بایست بطور مستمر داروهای خود را مصرف نماید و در محیطی بدور از استرس زندگی نماید.
قابل ذکر است که محبوبه منصوری خواهر زندانی سیاسی محمد علی منصوری و از حامیان خانواده‌های زندانیان سیاسی است.
محمد علی منصوری که از ۱۱ شهریورماه سال ۱۳۸۶ در بازداشت به سر می‌برد، به اتهام ارتباط با سازمان مجاهدین خلق به تحمل ۱۷ سال حبس تعزیری و تبعید به زندان رجایی شهر کرج محکوم شده است. (هرانا – 21/6/91)

همسر محسن دگمه‌چی به سه سال حبس قطعی در تبعید محکوم شد
دادگاه تجدید نظر استان تهران مریم النگی همسر محسن دگمه‌چی، زندانی سیاسی که در اثر بیماری فوت کرده بود را به سه سال حبس قطعی در تبعید محکوم کرد.
بنا به اطلاع گزارشگران هرانا، ارگان خبری مجموعه فعالان حقوق بشر در ایران، حکم مریم النگی که به ۳ سال حبس در شعبه ۱۵ دادگاه انقلاب تهران به ریاست قاضی صلواتی محکوم شده بود، بتازگی عینا در شعبه ۳۶ تجدید نظر به ریاست قاضی زرگر به تایید رسیده است.
طبق حکم صادره مریم النگی باید محکومیت خود را بصورت تبعید در زندان رجایی شهر کرج سپری نماید ولی بدلیل اینکه بند زنان زندان مذکور تعطیل شده است محل گذراندن حبس وی نامعلوم است.
مریم النگی همسر محسن دگمه‌چی از بازاریان سر‌شناس بازار تهران بود که در ۱۶ شهریور ۱۳۸۸ بدلیل کمک مالی به خانواده زندانیان سیاسی بازداشت و به ۱۰ سال حبس محکوم شد نامبرده در حین تحمل حبس در زندان به سرطان پانکراس روده مبتلا شد که بدلیل کوتاهی مسئولین و تاخیر چند ماهه در اعزام وی به بیمارستان در تاریخ ۸ فروردین ۱۳۹۰ فوت کرد.
