Top Iranian cleric says criminals have to receive maximum punishment without due process
http://www.mehrnews.com/fa/NewsDetail.aspx?NewsID=1364388
Ayatollah Makarem Shirazi severely criticized the Judiciary and said that the sentences passed by courts are lifeless [too light].
The religious authority of Shiites cited the repeated crimes by troublemakers and said that sentences passed by the courts were lifeless. He asked Judicial officials to run judicial [court] branches like the trials of Amir al-Momenin [revered Shiite saint]…
“An important problems that our judicial system has is that it follows the corrupt western judicial system where a case is referred to the judiciary from the police station and then the formalities of choosing a lawyer and then the lawyer’s recommendation to the criminal to deny all his clear and recorded initial confessions and to accuse security officials of torture and then getting in line for a few months then the issuing of an initial sentence, then the court of review and finally the issuing of a lifeless sentence after months which is not only not deterrent but rather emboldens the troublemakers”, Ayatollah Makarem Shirazai said.
“With this method of work, security will never be brought to the country and troublemakers and security disrupters will not be put in their place, especially if their crimes are organized by the enemies”, he added.
“We propose that judicial [courts] branches be established for this end like the trials of Amir al-Momenin Ali with the presence of a number of brave religious officials and [the procedures] be carried out with precision but with speed without formalities and that at most in one week these criminals be given the maximum punishment for their crimes so that others learn and the respected Majlis [Iranian Parliament] also solve the legal problems”, he said.

Prison
Prison Condition

Plight of seven detained netizens still worrying one year after their arrest 18 July 2011

Exactly one year after seven young netizens were arrested in a series of raids by intelligence ministry agents, Reporters Without Borders is reiterating the call for their release that it made in a letter on 23 February to United Nations High Commissioner for Human Rights Navanethem Pillay and Ayatollah Sadegh Amoli Larijani, the head of the Iranian judiciary.
Arrested on 17 and 18 July 2010, Iman Masjedi, Amir Latifi, Mohammad Reza Gholizadeh, Ladan Mostoufi Ma’ab, Hanieh Sate Farshi, Hojat Nikoui and Sepehr Ebrahimi, all students aged from 19 to 28, were unjustly accused of anti-government propaganda, “insulting what is holy,” actions against national security “in collaboration with organizations hostile to the Revolution,” insulting the Prophet and Moharebeh (rebelling against God). Under Iran’s criminal code, all these crime are punishable by death.
A Tehran revolutionary court withdrew the charges of insulting the Prophet and Moharebeh on 16 April but heavy sentences were nonetheless handed down. Masjedi and Ebrahimi were sentenced to eight years in prison. Gholizadeh and Farshi were given seven years. Nikoui and Ma’ab got five years. And Latifi was sentenced to seven years in prison and 74 lashes.
The lawyers and families of these detainees were only recently notified of the sentences.
Their situation is now very worrying. After their arrest, they were placed in Section 209 of Tehran’s Evin prison and were pressured to admit to organizing an anti-religious network of blasphemers.
They were subjected to long periods in solitary confinement and tortured in order to obtain the confessions that were used against them during their trial. Their defence lawyers were not allowed to meet them or see the prosecution case file.
These netizens are all now ill or suffering serious physical and psychological effects from the treatment they have received. Ma’ab and Farshi are being held in Section 5 of Gohardacht prison for women. Masjedi and Gholizadeh are in Section 350 of Evin prison. Nikoui, Ebrahimi and Latifi are in Rajaishahr prison in Karaj, a town to the northwest of the capital.
It is one of Iran’s most troubled prisons, with a reputation for torture, rape and murder. Their lives are in danger. Some of them have been injured in knife attacks by fellow inmates.
Prisoner rights are flouted in Iran. No consideration is shown for the health of detainees. Hossein Ronaghi Maleki, a blogger who was arrested on 13 December 2010 and sentenced to 15 years in prison, is still serving his sentence although he underwent a kidney operation and his state of health is now alarming.
He is not getting the treatment he needs and could die in prison. He is also being denied the one day of leave that detainees normally get every month.
The imposition of disproportionate sentences on dissidents is common in Iran. Saeed Malekpour and Vahid Asghari were sentenced to death last January on charges of anti-government agitation and insulting Islam. Malekpour’s sentence was overturned but he is still in prison. Navid Khanjani, a young blogger, was sentenced to 12 years in prison in January 2010.
The case of these seven netizens is not unique. Sakhi Righi, the administrator of the Balochistan-s blog, was arrested on 18 June 2009 in Zahedan, the city where he was born, and received the heaviest jail sentence ever passed on an Iranian blogger, 20 years, on charges of publishing false information and actions against national security.
Because of its repressive legislation and, above all, because it continues to detain 22 journalists and 16 netizens, Iran is ranked 175th out of 178 countries in the latest Reporters Without Borders press freedom index and is on the Reporters Without Borders list of “Enemies of the Internet”. Iranian MP: opponents of public hangings have been educated in the West
Nayereh Akhavan, the representative of the people of Isfahan said in Majlis {Iranian Parliament} regarding sentences related to retribution [an eye for an eye, death sentence] in public, “It seems that the implementation of such sentence is effective in preventing some crimes”.
“The principle of handing out punishments and implementing them is to punish criminals but in some cases, based on the decision of the judge seeing to the case, such sentences are carried out in public”.
“One can definitely not ignore or deny the effects and results of such sentences in public because it will definitely punish the criminal and also [act as a] warning for those who are watching the scene”, Akhavan who is a member of the Judicial Commission in the Majlis said.
In answer to a question that some people and specialists believe that the implementation of the death sentence in public can hurt the spirit of citizens and cause negative effects in them, Akhavani said, “These people have mostly been educated in Western academies”. A convicted female drug smuggler, identified as Begom N., along with fellow trafficker Khodadad M. were also executed in prison in the city of Rafsanjan, in the same province, the report added.

New Iran public execution video highlights ‘brutal’ death penalty
http://www.amnesty.org/en/news-and-updates/new-iran-public-execution-video-highlights-%E2%80%98brutal%E2%80%99-death-penalty-2011-07-21
Graphic new video footage of a public hanging in Iran this week highlights the brutalisation of both the condemned and those who watch executions, Amnesty International said today.
The video provided to Amnesty International was shot on 19 July, and shows the execution by hanging of three men in Azadi Square in the city of Kermanshah. The men had been convicted of rape.
The three men are shown standing on top of buses as guards drape ropes fixed to a bridge overhead around their necks, before a crowd of onlookers including children.
The crimes for which the men were condemned and the execution is announced over a loudspeaker, then the buses are driven away.
“These latest public executions underline the continuing horror of the death penalty in Iran,” said Hassiba Hadj Sahraoui, Amnesty International’s Deputy Director for the Middle East and North Africa.
In the video, numerous people are seen photographing or filming the execution.
“Not only those executed, but all those who watch public executions, including, children, are brutalised and degraded by the experience. These public displays of killing perpetuate a culture of acceptance of violence and bloodlust, rather than a belief in justice,” said Hassiba Hadj Sahraoui.
“We have also been informed that the arrest, trial and execution of these men took barely two months, which raises serious questions about the fairness of the trial”.
Tuesday’s hangings are part of a continuing rise in the number of public executions in Iran since late 2010, and a rise in executions overall.
The authorities have acknowledged at least 28 public executions so far this year. Amnesty International has received reports of at least another six which the authorities have not acknowledged.
“It is deeply disturbing that despite a moratorium on public executions ordered in 2008, the Iranian authorities are once again resorting to this inhuman practice.” said Hassiba Hadj Sahraoui.
According to UN human rights experts, executions in public serve no legitimate purpose and only increase the cruel, inhuman and degrading nature of this punishment.
“All executions violate the right to life. Those carried out publicly are a gross affront to human dignity which cannot be tolerated,” said Hassiba Hadj Sahraoui.
The executions follow several widely publicized gang rapes of women this year in Iran. In some cases, officials blamed the victims for failing to adhere to the official code on dress or gender segregation.
“Executions after speedy unfair trials are no solution to the extremely serious problem of rape in Iran, which feeds on the acceptance of violence against women at all levels of society,” said Hassiba Hadj Sahraoui.
“The Iranian authorities should be aiming to combat this culture of violence rather than perpetuate it through these public displays of brutality”.
Iran comes second only to China in the number of executions carried out annually. The Iranian authorities do not publish official statistics on their use of the death penalty, despite repeated calls for transparency by UN human rights bodies.
UN guidelines on the use of the death penalty, in those countries that retain this punishment, state that it should only be used for the most serious crimes. This is understood as meaning intentional crimes with lethal or other extremely grave consequences. Most executions in Iran relate to drug-trafficking offences and rape.
