Iran hangs man in Qom

Iran on Saturday hanged a man convicted of murdering a child in the city of Qom, south of the capital Tehran, the Fars news agency reported.
The man sent to the gallows was only identified by the initials H.S. and was sentenced to death after the court found him guilty of killing an eight-year-old boy who was on his way from home to a nearby grocery shop.
He was hanged in a prison in Qom in the presence of the victim's family. (AFP, Fars state-run News Agency – Jul. 30, 2011)

A young biker who raped a 16 year old boy with the complicity of one of his friends was hanged at dawn yesterday in the Central Mashhad Prison…
The court sentenced one of the convicts who was a 19 year old man to execution and sentenced the other convict to lashes. The convicts appealed the sentence and the case was referred to the Supreme Court but the judges in the 16th branch of the Supreme Court upheld the court’s sentence after carefully examining the case. Don`t praise Iran’s war on drugs

The Iranian regime won high praise last month from Yuri Fedotov، executive director of the UN Office on Drugs and Crime. Iran had 'one of the world`s strongest counter-narcotics responses'، he said، and its good practices 'deserve the acknowledgement of the international community.’
His remarks came a little more than two weeks after Iran`s state media announced that 13 drug traffickers had been executed in Mashhad`s Vakilabad prison since 21 March.
In May، the judiciary announced that at least 300 more were on death row for drug-related offences.
So far this year، official Iranian sources have reported more than 100 of these executions. Iranian and international human rights groups fear the numbers are much higher.
If retributive justice is the sole hallmark of a 'strong' anti-narcotics response، Fedotov`s words are spot on. Last year، Iranian authorities signalled plans to intensify prosecutions for drug crimes. They amended the anti-narcotics law، which already imposed corporal punishment for less serious drug crimes and the death penalty for trafficking، possession or trade of more than 5kg of opium، 30g of heroin or morphine (and repeated offences involving smaller amounts) or the manufacture of more than 50g of synthetic drugs such as methamphetamines a capital offence.
Last October، prosecutor general Gholam-Hossein Mohseni-Ejei announced that his office would review some drug-related cases in the interests of fast-tracking them through the courts. That meant some death sentences for drug-related crimes were no longer subject to appeal in the supreme court.
These draconian measures، many of which violate fundamental rights under international law، initiated a staggering wave of executions.
Human Rights Watch believes that many of those executed may have had unfair trials، with little or no legal representation.
There is also credible evidence that the authorities executed groups of convicted drug offenders without notifying their families or lawyers.
It is against this reality that Fedotov hailed Iran`s anti-drug campaign، and called on the international community to 'follow suit.’
To be sure، Iran plays a critical and strategic role in the international 'war on drugs'. The UN anti-drug agency says that Iran، which borders Afghanistan and Pakistan and is located along major drug smuggling routes، intercepts more illegal opium and heroin/morphine drug shipments than any other country - 89% of the opium shipments seized worldwide and 41% of heroin/morphine shipments.
The human cost of Iran`s war on drugs has been extremely high. Over the past 30 years، 3،700 police officers have been killed and tens of thousands injured in anti-narcotics operations، according to the UN agency. With 1.2 million drug-dependent users، Iran also has one of the world`s most severe addiction problems، the agency says. Its figures show that drug addiction and HIV rates have soared in recent years، with injecting drug users accounting for almost 70% of the country`s 22،000 detected HIV cases.
In praising Iran`s 'strong' anti-narcotics response، Fedotov focused on Iran`s seemingly effective supply-and-demand reduction programmes، including innovative treatment and rehabilitation measures for more than 150،000 people in communities and prisons.
Yet Fedotov said nothing، publicly at least، about the other human tragedy that is unfolding - the dozens of prisoners Iran has hanged and unceremoniously buried following flawed trials، or the hundreds of others who await a similar fate.
The silence is especially puzzling since the UN agency opposes the death penalty for drug-related offences.
Under article 6(2) of the International Covenant on Civil and Political Rights، which Iran has ratified، the death penalty may be applied only to the 'most serious crimes.’
The UN Human Rights Committee has said that drug offences do not constitute 'most serious crimes'، and that use of the death penalty for drug offences violates international law.
Human Rights Watch opposes capital punishment in all circumstances and has specifically stated its opposition to the death penalty for drug crimes.
In March، as Iran was ramping up its executions، the UN drug agency adopted a multilateral technical co-operation programme 'to support national efforts on drugs and crime by promoting United Nations standards and international best practices'. The European commission، European Union member states and several other governments including Japan، Norway، Australia and Canada، provide money، technical assistance and legislative support to Iran under the programme. Rights groups have raised serious concerns that the assistance may play a part، direct or indirect، in Iran`s human rights violations.
At the very least، Fedotov and his agency should set the record straight on Iran`s abysmal anti-narcotics record when it comes to the rule of law، the administration of justice، freedom from torture and ill-treatment and the right to life.
They should also demand accountability for these rights violations and take measures to ensure that in assisting Iran`s anti-drug measures they are not complicit in violations carried out in the name of a 'strong' anti-narcotics response.
Failure to do so، as Iranian authorities continue their killing spree، would be reckless and irresponsible. (The Guardian- Aug. 5, 2011)

Top cleric encourages people not to grant amnesty and use death sentence as revenge

According to the Fars News Agency from Qom, Ayatollah Mohammad Taqi Mesbah Yazdi who is a member of the Expediency Council said, “There are various instances where a person has to choose between retribution and amnesty”…
“If amnesty emboldens the [criminal] one has to decline and carry out the divine sentences because shortcomings on this issue can lead to more corruption for that person and will cause much harm for the society”…
“Carrying out the divine sentence is not conditioned on a personal plaintiff and the attorney general holds the offender accountable because amnesty and pardoning sometimes leads to the impudence of the [criminal]”, he added. (Fars state-run News Agency – Aug. 5, 2011)

گزارشات: ايران يک مرد را در قم دار زد

خبرگزاري فارس گزارش داد، روز شنبه ايران يک مرد را به اتهام قتل يک کودک در شهر قم جنوب تهران پايتخت ايران حلقه آويز کرد.

اين مرد که به به پاي دار فرستاده شده است فقط با علايم اختصاري اچ. اس معرفي شده است. دادگاه وي را به اتهام کشتن يک پسر8ساله که درحال تردد از مسير خانه به يک خواربارفروشي نزديک بوده است، به مرگ محکوم کرد.

دادگاه... يکي از متهمان را که جوان ۱۹ ساله اي بود به اعدام و متهم ديگر را به تحمل شلاق محکوم کرد. رأي صادره از سوي دادگاه مورد اعتراض متهمان قرار گرفت و به ديوان عالي کشور ارسال شد اما قضات با تجربه شعبه ۱۶ ديوان عالي کشور پس از بررسي دقيق پرونده، حکم صادره از سوي دادگاه را تأييد کردند. سپيده دم روز گذشته متهم رديف اول اين پرونده به دار مجازات آويخته شد. مبارزه عليه مواد مخدر ايران را ستايش نکنيد

5 اوت 2011- گاردين- ساعت خبر 1300 به‌وقت بغداد- فراز صانعي ( faraz sanei ) - رژيم ايران در ماه گذشته ستايش زيادي از جانب يوري فيدوتوف ( yuri fedotov ) مدير اجرائي دفتر سازمان ملل در امور مواد مخدر و جنايت un office on drugs and crime دريافت کرد...

صحبتهاي او حدود دو هفته بعد از اين‌که مطبوعات دولتي ايران اعلام کردند از 21مارس (فروردين 90) تاکنون 13 قاچاقچي مواد مخدر در زندان وکيل آباد مشهد اعدام شده‌اند مطرح شده است.

در ماه مه قوه‌قضائيه ايران اعلام کرد که حداقل 300نفر ديگر به اتهام موضوعات مواد مخدر در انتظار اجراي حکم اعدام هستند.

در سال جاري منابع رسمي ايران بيش از 100 مورد اعدام را در ايران گزارش کرده‌اند.

گروهاي حقوق‌بشري بين‌المللي و ايراني از اين نگران هستند که تعداد اعدام شدگان بسيار بيشتر از اين رقم مي‌باشد...

سال گذشته مقامات ايراني به طرحي اشاره کردند که مجازات متهمان مواد مخدر را سرعت خواهد بخشيد...

به اين مفهوم که مجازات اعدام براي بعضي از پرونده هاي مواد مخدر ديگر قابل استيناف در دادگاه عالي ايران نيست.

اين اقدامات بي‌رحمانه که بسياري از آنها نقض حقوق اساسي و بنيادي تحت قوانين بين‌المللي مي‌باشند، باعث دامن زدن به موجي از اعدامهاي تکان‌دهنده در ايران شده است.

يوري فيدوتوف به‌طور علني هيچ چيزي راجع به تراژدي انساني که ده‌ها زنداني در ايران به‌دنبال محاکمات غيرمنصفانه

اعدام شده و بدون هرگونه مراسمي دفن شده‌اند و صدها نفري که در انتظار سرنوشت مشابه‌يي هستند صحبتي نکرده است.

اين سکوت خصوصا از اين زاويه حيرت‌آور است که اين آژانس سازمان ملل مخالف مجازات اعدام براي جرايم در ارتباط با مواد مخدر مي‌باشد...

کميته حقوق‌بشر سازمان ملل گفته است که استفاده از مجازات اعدام براي جرايم در ارتباط با مواد مخدر نقض قوانين بين‌المللي است.

در ماه مارس در حالي که ايران در حال پيش‌بردن اعدامهاي خود بود آژانس مواد مخدر سازمان ملل يک برنامه چند جانبه تکنيکي ” براي حمايت از تلاشهاي کشوري در ارتباط با مواد مخدر و جنايت جهت ارتقا استانداردهاي سازمان ملل و بهترين کارکرد بين‌المللي ”را به تصويب رساند.

کميسيون اروپايي، کشورهاي عضو اتحاديه اروپا و چندين دولت ديگر از جمله ژاپن، نروژ، استراليا و کانادا تحت اين برنامه به ايران پول و کمکهاي تکنيکي و لجستيکي ارائه مي‌کنند.

گروههاي حقوق‌بشري نسبت به اين کمکها که ممکن است مستقيم و يا غيرمستقيم در نقض حقوق‌بشر توسط ايران نقش داشته باشند اظهار نگراني جدي کرده‌اند.

فيدوتوف و آژانس او بايد پرونده وحشتناک ايران در مبارزه با مواد مخدر وقتي موضوع حاکميت قانون، اجراي عدالت، عدم به‌کار گيري شکنجه و بدرفتاريهاي حقوق‌بشري و حقوق زيستن مطرح مي‌شود

را به‌طور واقعي علني نمايد.

آنها بايد هم‌چنين خواستار حسابرسي و مورد مواخذه قرار گرفتن موارد نقض حقوق‌بشر شده و اقداماتي براي تضمين اين‌که کمک به اقدامات ضد مواد مخدر ايران مشارکت در موارد نقض حقوق‌بشر از طرف آنها که به نام يک واکنش قوي ضد مواد مخدر در ايران صورت مي‌گيرد نباشد.

کوتاهي از اين کار درحالي‌که مقامات ايراني به قانون شکني و کشتار ادامه مي‌دهند بي‌اعتنايي و يک برخورد غيرمسئولانه مي‌باشد. (سايت گاردين 14/5/1390)

آيت‌الله مصباح‌يزدي: كوتاهي در اجراي حدود الهي موجب ضرر مي‌شود

به گزارش خبرگزاري فارس از قم، آيت‌الله محمد‌تقي مصباح‌يزدي عضو خبرگان رهبري ‌با بيان اينكه برخي اوقات در اجراي مسائل اخلاقي ابهاماتي وجود دارد، اظهار داشت: موقعيت‌هاي مختلفي وجود دارد كه انسان بايد ميان قصاص، عفو و گذشت يكي را انتخاب كند...

رئيس مؤسسه آموزشي و پژوهشي امام خميني(ره) گفت: اگر بخشش موجب جسارت بيشتر ظالم شود بايد از اين كار صرف نظر كرده و حدود الهي را اجرا كرده زيرا كوتاهي در اين زمينه سبب فساد بيشتر شخص و ضررهاي زيادي به جامعه مي‌شود...

وي افزود: اجراي حدود الهي در برخي مواقع مشروط به شاكي خصوصي نيست و مدعي‌العموم فرد خاطي را مورد بازخواست قرار مي‌دهد، زيرا عفو و گذشت گاهي موجب تجري ظالم و ضررهاي زيادي به جامعه مي‌شود. (فارس – 14/5/90)
