Parents of two brothers in danger of imminent execution on political charges speak out on day of execution

According to a decision by judiciary and security officials of the Islamic Republic of Iran, two brothers identified as Mohammad and Abdollah Fat-hi will be hanged in a few hours (dawn of Tuesday May 17) in Isfahan Prison.
Judicial officials have charged these two brothers with enmity with God by armed robbery and creating an anti-government group.
Bijan Fat-hi, the father of these two young men said, “Moharebeh means waging war with God or with an Islamic government but my sons have neither waged war with God no with the Islamic government”.
On March 27, 2010, seven people identified as Mohammad and Abdollah Fat-hi, Davoud Jamshidian, Saied Javanmardi, Mohsen Goudarzi, Daniel Amir Bavarai and Ibrahim Javanmardi were arrested by security forces in the town of Chalous in Mazandaran and were transferred to Isfahan.
The 24th branch of the Isfahan Revolutionary Court headed by Judge Moqzi tried these men in a two hour trial and sentenced them to death.
This is while after their case was referred to the Supreme Court, the judges announced that the maximum punishment for the case should be 5-17 years of prison. According to this, the death sentence for five of the suspects was revoked while the death sentence for Mohammad and Abdollah Fat-hi was upheld. According to their family, officials have said that there have been orders from above that these two have to be executed.
Bijan Fathi cited his political activities and the activities of his son’s uncle (mother’s brother) who was sentenced to death in 80’s, and said that the death sentence for his sons was a kind of a personal retaliation.
“My sons are facing the same fate as those who were executed for visiting Camp Ashraf in Iraq”…
Despite the poor condition of Mrs. Fat-hi, the mother of these two young men, we asked her a few questions in this regard:
Mrs. Fat-hi: Neither me nor their lawyer and not even my sons were informed that the sentence would be carried out and they have not seen a written death sentence. (Officials) use this excuse that since the case is security related, there is no need for their lawyer or us to be informed… We have referred to wherever was possible, to the Sentence Implementation Unit, Amnesty Commission and other place but we received negative answers and no one showed us the sentence.
I told them that I need to know for what reason my sons are being executed…
Their lawyer is Mr. Ahad Dahnavi who was their superficial lawyer for one year and in the past year was not only not accepted by the court, but was not even allowed to interfere in the case after the Supreme Court upheld the death sentence.
He was in court but was not allowed to defend his clients. They did not even read the medical files of my children and the judge did not even know that my son was married and the fact that he was not married was even included in the initial sentence. In short, what I want to say is that this sentence was pre-decided…
Before they were transferred to cellblock AT in the Dastgerd Prison in Isfahan (in late January), I did not see them in prison for six months. After that, I saw them once a month from behind a glass partition. But they were thrown in solitary sometimes and the visits would be cut off. For example in the month of Ramadan, they were in solitary…
Q: Were your children tortured during their detention? Did you notice this in your visits with them?
Mrs. Fat-hi: Yes, we wrote a letter of complaint in this regard and sent it to the SSF interrogator. The signs of torture are still evident on both of their bodies. When they were initially arrested, they were even threatened to sexual abuse and rape. Even the head of the Criminal Intelligence Department interrogated my son’s wife and asked her completely personal questions to the extent that I am ashamed to repeat them.
My daughter in law filed a complaint to the Military Court in Isfahan against those who had tortured her husband but instead of being held accountable, my daughter in law was taken for interrogation and threatened.
The issue of looking into our complaint against the SSF also was in vain and in January, when we went to the military court for the last time to follow up this issue they told us that they could not look into the complaint and literally said that these people carried out these tortures with the orders of the judge…
If this case is not political then why were they asked about their uncle when they were arrested? Their uncle was a political prisoner in the 80’s and was sentenced to death but was granted amnesty by Mr. Montazeri. He was in prison for 5 years and then left the country. My brother legally left the country.
Now you can judge yourself; what is the connection of a person who was convicted in the 80’s and even served his prison term with this case? (Human Rights Activists in Iran – May 17, 2011)

“His Last Wish Was To Embrace Me, But They Didn’t Allow It,” Says Mother Of Executed Inmates
On 17 May the death sentences of two brothers, Mohammad and Abdollah Fathi Shoorbariki, were carried out. Their mother, Mahvash Alasvandi, told the International Campaign for Human Rights in Iran that her children’s grievances were never reviewed and their last wishes of embracing their mother were not granted. “All we said was that their complaints be reviewed before executing them. We said what is the rush? They are in your hands and they are not going anywhere. You have held them for nine months. Review their complaint first and then execute them. But unfortunately they didn’t do this.”
Abdollah and Mohammad Fathi Shoorbariki were arrested along with five others last March on charges of armed robbery from Karaj jewelry stores. Branch 4 of the Isfahan Revolutionary Court issued their death sentence, and it was upheld during the appeal process.
In a March 1 letter addressed to the Isfahan Military Court, Abdollah Fathi filed a grievance against individuals he called “my torturers,” naming Colonel Hosseinzadeh, Isfahan Police Chief, Major Ghodratollah Rahimi, Lieutenant Bahrami, and several other military personnel, claiming he had been tortured by flogging, severe beating, and being threatened with rape. A day later, he wrote a letter to the Judges’ Court, filing a grievance against Judge Moghtazi, Mohammad Reza Habibi, the Deputy Prosecutor of Isfahan, and Investigative Judge Najafi, of Branch 10 of the Isfahan Court, claiming that they did not follow due process in his and his brother’s cases and did not take note of their grievances.
“Their lawyer was not informed about the executions at all. Only one day before, they contacted me from the prison and said to come in tomorrow morning because we want to execute the kids, and I couldn’t believe it. This morning, after I saw my children, I asked the warden of Ward A-T and the Deputy Head Warden of the prison: ‘Are you going to finally show me the sentence document, so that I know on what verdict my kids are being executed?’ and they told me that the verdict had not yet arrived, and that the Judge still had it. I asked them ‘Will you show it to my kids?’ They said ‘Sure.’ I said ‘How would I know that you showed it to them?’ My son said: ‘Mom, don’t argue any more, it’s useless,’” said Alasvandi.
“We were in front of the prison at 4:00 a.m. There was a large crowd outside the prison, too.
We kept knocking on the door, but they wouldn’t open it. They said that they will open the door right at 6:00 a.m. After I entered and they conducted a body search, I entered the prison courtyard where everyone had gathered, the prison authorities and 30 to 40 armed soldiers. They spread a blanket on the ground and told me to sit down until they brought the kids. They brought them out one at a time, and Abdollah came first”.
“I heard that the convict’s last wishes are asked just before execution and then the execution is carried out. But when my son said ‘Untie my hands so that I can embrace my mother,’ they said ‘The law doesn’t allow us to do this.’ I said ‘Sweetheart, you know that everything is according to law here and this place is full of law-abiding individuals. It’s O.K., I will embrace you.’ But it was hard for me to see that my son’s last wish which was embracing me was not carried out,” continued Alasvandi.
“I still don’t know whether my sons’ charge was moharebeh (enmity against God) or robbery. I don’t believe they were at war with the regime or with God,” the executed brothers’ father, Bijan Fathi, told the Campaign. Referring to his and his brother-in-law’s political activism, he said that during his sons’ interrogations, they were accused of connections to their uncle who was previously sentenced to d«eath (and later pardoned) during the 1980′s mass executions; the uncle now lives abroad. Death sentence

Kurd political prisoner in danger of imminent execution

Civil rights activists in Sanandaj have announced that the death sentence of jailed Kurd student Habibollah Latifi was sent once again to the Sentence Implementation Unit after it was upheld by the Supreme Court.
His death sentence was to be carried out on December 26, 2009 but was halted after protests and gatherings outside of prison and requests by his lawyers.
According to reports from Kurdistan, this sentence was referred to the Supreme Court 7 months ago and was sent once again to the Sentence Implementation Unit after 24 hours.
A date has not been set for the execution of this student but as those informed about his case have noted, his sentence is subject to ‘discretionary time’ and can be carried out at any moment…

http://www.dadgostariyazd.com/tabid/38/ctl/Edit/mid/369/Code/329/Default.aspx
