Iran’s law says it’s ok to hit children until ‘their skin color changes’
The head of the Justice Lawyers Center criticized the current laws for the punishment of parents who abuse their child and said that according to the laws of the Islamic Republic, child punishment is legal if it does not lead to a change in the child’s skin color [bruises] …
“The first paragraph of article 59 in the Islamic Penal Law cites the limits in child punishment. It is stipulated in this article that if the father and mother do not go over the boundaries of the conventional punishment, they will not be penalized for punishing the child. The description that the Legal Department of the Judiciary has for conventional punishment is a punishment that does not result to a change in skin color”, he said. Iran human rights chief says flogging, stoning and amputation is not torture
The Secretary of the Human Rights Department in the Judiciary said that westerners take advantage of retribution [eye for an eye] sentences, amputations and stoning.
“The west interprets some of these sentences but in Iran it is interpreted based on Islam and the constitution”, he said…
“In another example, it can be said that the west and western human rights say that flogging is torture while in our view, for a convict sentenced to this, flogging is a punishment and penalty”…
“The west says that anyone can change their religion or promote their new religion but in Iran there is freedom of religion… but Baha’is have no right to promote their religion and this is banned in Iran. Imam Khomeini was also asked [about this issue] and he said that various religions live in Iran based on citizenship laws but have no right to promote their religions”…
“Another issue that westerners have problems with is the issue of retribution. This is while retribution [eye for an eye] is very beautiful and important and in a way defends the rights of the society...”
The advisor to the head of the Judiciary said regarding charges against Iran on minor executions, “Not executing people under 18 is one of Iran’s commitments and is included in our law as well but in some cases the judge decides that for example a 17 year old who has committed three murders and knows the consequences of such an act, should be sentenced to death but in general the execution of those who are under 18 is banned and in special cases, committees have to be held”…
Larijani said, “One of the conditions for Turkey’s admittance into the European Union was to abolish stoning and its [EU] goal was only to promote adultery in an Islamic society”. (Mehr state-run News Agency – Jun. 1, 2011)

Security forces beat political prisoners in front of families

During Thursday’s family visits in Rajayi Shahr Prison in Karaj, political prisoner Massoud Bastani was beaten by prison agents in front of his mother and wife.
According to reports, the families of political prisoners said that this prison has increased its security measures and that during their visits with their loved ones, political prisoners and their families were treated with violence.
According to other reports, prison agents used profane language, insulted and even beat in some cases political prisoners and their families following the prisoner’s expressions of anger and regret over reports that security forces attacked the funeral of Ezatollah Sahabi and the ensuing death of his daughter in the funeral.
A number of political prisoners have gone on a hunger strike from a few days ago but prison and judicial officials still refuse to see to their condition and demands.
Notably, Massoud Bastani who is detained in Rajayi Shahr Prison is suffering from illnesses in his jaw and mouth and has digestive problems. Despite having spent months in prison, this journalist is still denied a medical leave from prison. (Jaras website – Jun. 2, 2011)

اعمال ضد بشري و مجازاتهاي بيرحمانه

قطع عضو, شلاق, شكنجه, تحقير و توهين

تنبيه کودکان تا وقتي رنگ پوست شان عوض نشود، قانوني است!

رئيس کانون وکلاي دادگستري با انتقاد از قوانين موجود در رابطه با مجازات در نظر گرفته شده براي والديني که دست به کودک آزاري مي زنند؛ به اين مهم اشاره کرد که طبق قوانين جمهوري اسلامي، تا وقتي رنگ پوست کودک عوض نشود، تنبيه قانوني تلقي مي شود...

بر اساس گزارش خبرآنلاين، رئيس کانون وکلاي دادگستري با تشريح قوانيني که در مورد کودک آزاري در کشور وجود دارد، گفت: "در بند يک ماده ۵۹ قانون مجازات اسلامي، راجع به حدود تنبيه کودکان نکته‌اي وجود دارد. در اين ماده گفته شده که در صورتي که پدر و مادري از حدود متعارف تنبيه تجاوز نکنند، بابت تنبيه کودکان مجازات نمي‌شوند. توصيفي که اداره حقوقي قوه قضاييه از تنبيه متعارف دارد اين است که تنبيه متعارف آن است که باعث تغيير رنگ پوست نشود." لاريجاني: شلاق و سنگسار و قطع عضو، شکنجه نيست

دبير ستاد حقوق بشر قوه قضائيه در نشست تخصصي حقوق بشر با تشريح احکام قصاص، قطع يد و سنگسار و نوع سوء استفاده غرييها از اين احکام گفت: در برخي از اين احکام غرب خود تفسير مي کند ولي در ايران تفسير بر مبناي اسلام و قانون اساسي است...

لاريجاني اظهار داشت: در مثال ديگري مي توان گفت که غرب و حقوق بشر غربي مي گويد شلاق شکنجه است در حاليکه در تفسير ما شلاق براي مجرمي که حکمش شلاق است تنبيه و مجازات است...

مشاور قوه قضائيه با بيان اينکه برخي از معاهدات غرب را بحث حقوق بشر پذيرفته ايم ولي اين دليل نمي شود که تفسير آن را به عهده غربيها بگذاريم، گفت: غرب مي گويد هر انسان مي تواند دين خود را عوض کند و يا دين جديد را تبليغ کند ولي در ايران آزادي دين وجود دارد.. ولي همين بهائي ها حق تبليغ دين خود را ندارند و در ايران ممنوع است. در اين مورد از امام خميني (ره) هم پرسشي شد که ايشان گفتند اديان در ايران بر اساس قرارداد شهروندي زندگي مي کنند ولي حق تبليغ ندارند...

مشاور قوه قضائيه افزود: مبحث ديگري که غربي ها با ايران مشکل دارند بحث قصاص است در حاليکه قصاص بسيار زيبا و مهم است و به نوعي از حقوق افراد جامعه دفاع مي کند...

مشاور رئيس قوه قضائيه در مورد اتهاماتي عليه ايران مبني بر اينکه ايرانيها فرزندان خود را اعدام مي کنند، گفت: عدم اعدام افراد زير 18 سال جزو تعهدات قانوني ايران است و در قانون ما هم آمده است ولي در پاره اي از موارد قاضي تشخيص مي دهد که به عنوان مثال فرد 17 ساله اي که سه قتل را انجام داده و مسئوليت اين کار را مي داند حکم اعدام برايش صادر مي شود ولي در کل اعدام زير 18 سال ممنوع است و در موارد خاص کميته اي بايد تشکيل شود...

لاريجاني گفت: يکي از شرايطي که غرب براي ورود ترکيه به اتحاديه اروپا داشت اين بود که ترکيه بايد قانون سنگسار را حذف کند و هدفش تنها ترويج زنا در جامعه اسلامي است. (خبرگزاري مهر – 11/3/90)

ضرب و شتم مسعود باستاني در برابر خانواده

در جريان ملاقات امروز پنجشنبۀ زندانيان سياسي زندان رجايي شهر با خانواده‌هاي خود، مسعود باستاني از سوي ماموران زندان در برابر چشمان همسر و مادرش مورد ضرب و شتم قرار گرفت.

به گزارش رسيده به جرس، امروز خانواده‌هاي زندانيان سياسي رجايي شهر از تشديد فضاي امنيتي و برخوردهاي خشن‌تر و زشت با خود و عزيزان دربندشان در جريان ملاقات خبر داده‌اند.

تارنماي ميزان خبر نيز گزارش داد که در پي انتشار اخبار مربوط به حمله ماموران به مراسم تشييع مهندس سحابي و شهادت فرزند ايشان در سالن ملاقات زندان رجايي شهر و تاثر و ابراز خشم زندانيان سياسي، ماموران با هجوم به سالن ملاقات اقدام به توهين و هتاکي و بعضا ضرب و شتم زندانيان سياسي اين زندان نمودند.

طي روزهاي اخير، تعدادي از زندانيان سياسي زندان رجايي شهر، در اعتصاب غذا به سر مي‌برند و مقامات زندان و قضايي، کماکان به وضعيت آنان بي‌توجه هستند.

گفتني است مسعود باستاني اين روز‌ها در زندان رجايي شهر محبوس است و با مشکلاتي همچون مشکل فک و دهان و بيماري‌هاي گوارشي در رنج است. اين روزنامه نگار پس از گذشت ماه‌ها از محکوميت خويش، همچنان با مرخصي وي جهت درمان بيماري‌هايش مخالفت مي‌شود. (جرس – 12/3/90)
